A;~E 2 3 2013 ~~wn Clerk ZBA FILE: 6642 NAME OF APPLICANT: Robert and Deana Finora PROPERTY LOCATION: 165 Orchard Street New Suffolk, NY SCTM# 1000-117-05-33 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the properly under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 19, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION.' The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is a non-conforming 7,899 sq. fi. parcel located in the R- 40 zone. It is improved with a 1 ½ story frame house with attached rear deck. It has 87.80 feet of frontage on Orchard Street, 90.00 feet along the west property line, 87.75 feet on the north property line and 90.00 feet on the east property line as shown on the survey dated February 28, 2013 prepared by Nathan Taft Corwin, III, LS. BASIS OF APPLICATION: Request for Variance from Article III Code Section 280-15 and the Building Inspector's February 15, 2013 Notice of Disapproval based on an application for building permit to construct accessory building, at: 1) accessory building is proposed in a location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to replace a garage that was destroyed by a tree during a severe storm with a similar size garage in the same front yard location where the code requires a rear yard location. ADDITIONAL INFORMATION: During the hearing, the applicant was asked to supply photos of similar accessory buildings located in the front yard and comments from the neighbors immediately adjacent to their property. On April 5, 2013, the applicant provided several photos of accessory structures located in the front yard and on April 10, 2013, the Board received an e-mail from an adjoining neighbor in support of the application. Page 2 of 3 April 18,2013 ZBA File#6642 - Finora SCTM: 1000-43-1-7 F1NDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 4, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An original garage was built in the proposed front yard location prior to the enactment of zoning and existed without detriment to the neighborhood until it was demolished by the applicants' because it had been severely damaged by a fallen tree. The proposed accessory building is proposed in the same location as the one that had previously existed and which would maintain the character of this neighborhood. 2. Town Law §267-b(31(b~(2L The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The accessory building could be located in the rear yard. However the applicant testified that the rear yard is prone to frequent flooding due to its lower elevation and locating the accessory building in this flood prone area would not be feasible. 3. Town Law §267-b(3)(b){3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the substantiality is mitigated when considering that the applicant desires to construct the accessory building with similar dimensions and in the same location where an accessory building previously existed. 4. Town Law §267-b{3){b}(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b{3)(b){5). The difficulty has not been self-created. The difficulty is created by the lower elevation of the rear yard, causing frequent flooding, and the existing accessory building being destroyed by a storm. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an accessory building in a front yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to GRANT~ the variance as applied for, and shown on the Survey prepared by Nathan Taft Corwin III, L.S. dated Feb. 28, 2013 and the architectural drawings prepared by Sheds Unlimited, drawn by Chris Stoltzfus, Pages 1 through 6 inclusive and all dated 12/28/2012. Any deviation from the survey, site plan and/or archilectural drawings' cited in this decision will result in delays and/or a possible denial by the BuiMing Department ora buiMing permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This is an application related to a previous and similar structure on the referenced property; the previous structure, which was a storage shed of an identical footprint, placement and of similar dimensions, was destroyed by wind during Hurricane Sandy in the fall of 2012. A permit for demolition of the previous structured was filed with your office in December 2012 along with a detailed property survey of my lot and the surrounding region. The enclosed includes: Building Permit Application Building Plans / Specifications for the proposed structure Foundation / Pad recommendation on behalf of my builder Property survey and area Please note, the proposed structure is designed and to be used as a storage shed only and not intended for livable space. This structure will not be used as a garage or used to store vehicles. The builder is Sheds Unlimited and the proposed unit will be assembled onsite by the builder in a pre-fabricated manner (portions of the structure will be pre-fabricated offsite). The proposed and recommended foundation for the structure by the builder is on a level, compacted pad of crushed gravel secured in a level fashion by pressured treated 6X6 perimeter. This will provide optimal support and water drainage for the underside of the structure, which is built on 7 pressure treated skids followed by 2X4 Floor Joist at 16" on center. The structure will be secured to the earth via anchors as illustrated in the detailed plans. As mentioned, the proposed structure is similar in dimensions and size from the previous structure. Desired placement of the shed is requested on the same footprint as the previous shed as indicated on our property survey (enclosed). The previous structure was approximately 16.5' X 24.5' by 17% tall with wood floor (no concrete flooring). Due to the layout of our property and typical flood conditions during excessive storm surges on certain parts of the property, we are requesting placement on our property of the proposed shed to be identical to that of the previous shed as outlined on the property survey (this is also one of the higher grades on the property). Options outside this footprint are limited. The previous MAR ~ 2013 BOARD OF APPEALS structure that was destroyed included an attic / loft area which was extremely important and useful for us due to storage constraints on our existing house on the property. Our crawlspace / basement in the main house is unsuitable for storage and due to the age and design t~f the existing house, we do not have an accessible attic. Our goal with the proposed structure is to maintain the look and charm of our neighborhood. We are planning to have barn-like swing doors in the front and matching wood windows with shutters and flower boxes throughout. The primary and sole purpose of the shed is for general storage, lawn equipment, beach gear and storage of small beach-sailboats (ie Sunfish, beach catamaran).
