SOUKUP LIFETIME TRUST SCTM#1000-128-4-7 No permits were found for the proposed actions. En-Consultants on behalf of JANET T. SOUKUP LIFETIME TRUST requests a Wetland Permit to reconstruct storm damaged (Hurricane Sandy) +3'x+20' timber stairway down embankment; reconstruct at top of stairway a storm destroyed 8'x10' wood deck previously located at base of stairway; and construct 4'x8' steps to beach in place of storm destroyed steps. Located: 500 Birch Drive South, Laurel. SCTM# 128-4-7 It is my recommendation that the proposed actions are INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structures described were not constructed pursuant to Southold Board Trustees permit under Chapter 275 Wetlands and Shorelines regulations. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS LWRP CONSISTENCY ASSESSMENT FORM All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Yes ['--] No ['--] Not Applicable The project consists of the reconstruction of a deck and stairway that were damaged or destroyed during Hurricane Sandy. The stairway is being constructed down a bank, which pursuant to Town of Southold Wetlands Permit No. 8035 is being renourished, revegetated, and maintained as a nonturf buffer in association with the reconstruction of the adjacent storm damaged bulkhead located to the south of the subject property. The deck and stairs are consistent in scope and location with many others present along this stretch of developed shoreline, including those present on the adjacent parcel to the east, reconstruction of which was also approved by Wetlands Permit No. 8035. Thus, together with the work being conducted on the adjacent lands, the project will maintain previously existing site conditions and will have no adverse impact on the quality or function of the adjacent beach or wetland ecosystem, consistent with Policy 6.
