Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: March 18, 2013 Re: Proposed Wetland Permit for WILLIAM & MILLICENT TUFANO SCTM#1000-122-9-9.6 En-Consultants on behalf of WILLIAM & MILLICENT TUFANO requests a Wetland Permit to construct approximately 84 linear feet of vinyl bulkhead in place of (and approximately 12 inches higher than) existing storm damaged (Hurricane Sandy) timber bulkhead; construct +50' and +51' vinyl returns in place of (and approximately 12 inches higher than) existing timber returns; place approximately 100 cubic yards of clean sand/loam fill landward of bulkhead; and construct 4'x4' wood platform and +4'x5' steps to beach alongside westerly return in place of storm damaged steps. Located: 2482 Camp Mineola Road, Mattituck. SCTM# 122-9-9.6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The structures predate regulations requiring wetland permits for these types of structures. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria Ilae project seeks to replace an existing timber bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location and +/12" higher to maintain the property's historical method of shoreline stabilization and to provide a reason increase in protection for the upland property and existing residence against erosion and flooding caused by storm surge. The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1977, and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead the subject and adjacent, similarly bulkheaded property would be exposed to severe erosion, flooding, and damage to the residential structures located thereon.
