No permits for structures were found.
Lehnert Construction on behalf of LEHNERT FAMILY IRREVOCABLE TRUST requests a Wetland
Permit to remove the two (2) storm damaged retaining walls and replace with new single retaining wall;
existing wood decks (18.8'x14.4') at bulkhead to be rebuilt and replaced in-kind. Located: 6605 Nassau
Point Road, Cutchogue. SCTM# 111-13-2
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that above actions to
remove the two (2) storm damaged retaining walls and replace with new single retaining wall;
are CONSISTENT with the LWRP.
The proposal to rebuild, replace existing wood decks (18.8'x14.4') at bulkhead in-kind is not
permissible under current regulations is recommended as INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The structure described was not constructed pursuant to Southold Board Trustees
permit pursuant to Chapter 275 Wetlands and Shorelines regulations and is not
permissible under current regulations.

assessment is inteaded to supplement other information used by a Town of Southold agency in
makinE a determlna!ion of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
vninor action list, policies and explanations of each policy contained in the Town of Southold Local
· Waterfront Revitalization Prograra. A ~rooosed action will be evaluated as to its signifiean~
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

'affect the achievement of the LWRP policy standards and conditions contained in the consistency

Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands' j,urisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
