APREA 500 BEACH COURT, EAST MARION SCTM# 37-7-9.1 Dear Mr. Aprea: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, May 21, 2014: WHEREAS, THOMAS J. APREA applied to the Southold Town Trustees for an Amendment to Wetland Permit#8085 and Coastal Erosion Permit#8085C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated September 20, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Wetland Permit#8085 and Coastal Erosion Permit #8085C to place approximately 300 feet of barrier cloth and approximately 1' in diameter rocks in front of and on top of existing bulkhead; reduce height of seawall by removing one (1) redi-rock block row which is to be placed seaward of wall for toe protection; install an architectural stone embedded on top of the wall to be no higher than 4"; for the existing lighting along seaward side of bulkhead which is to be Dark Sky compliant; install aluminum stairs to beach; for the as-built +/-2,000 cubic yards of fill landward of seawall; and that a review of the southwesterly groin be made to ensure that it's in compliance with Wetland Permit #5844; and as depicted on the site plan prepared by D'Amaro Engineering and Surveying, P.C., last dated April 18, 2014 and stamped approved on May 21, 2014. I am also acknowledging receipt of your letter dated April 4, 2014 requesting an as-built survey/site plan. It is my understanding that the Board stated in the meeting that the wall height is one Redi- block (18") too high. In due consideration of this, I will remove one 18" course of block from the wall to conform with the Town's requirements. After I complete construction under my open permit I will instruct my engineer to complete an as-built survey showing all of the data requested in your letter, i.e., the Coastal Erosion Hazard Area line, elevation of the top of the seawall, first floor elevation of the building and the final seawall construction. I will be continuing with this construction in the next couple of weeks and expect to complete this work on or before the deadline for the June meeting of the Board in May. No. 1000-037.00-07.00-009.001; Our Job No. 220 AD Seawall Report Dear Mr. Aprea: This report is being prepared at your request to address concerns of the Board of Southold Town Trustees ("Board") regarding the recent construction of a seawall at the above referenced address. As you are aware, I was only recently retained last week to provide professional services on your property and accordingly did not have any knowledge of the construction documentation and permit process up to this point. I briefly inspected the seawall on Saturday, November 30, 2013 and met with the Board at the site this morning. The Board stated to me that they have several concerns regarding the seawall construction, which I will outline below. Board Concerns. 1. A required 30-year maintenance agreement has not been filed, 2. The exposed face of the seawall is greater than 4 feet, and 3. The seawall is located too close to the bulkhead. Background. On October 29, 2012, the remnants of Hurricane Sandy made landfall at this location. The storm event is commonly called Superstorm Sandy and was associated with a large tidal storm surge. I will not go into any 1 ,A meteorological specifics here as the severity of the storm is well documented and acknowledged by all parties.' As you may recall, you stated that the subject property sustained damage from the storm surge: racking of the dwelling due to wave action, partial destruction of a large deck due to wave action, partial destruction of a bulkhead due to moving water forces, and the loss of several thousands of cubic feet of beach sand. An authorization to permit repair work to the bulkhead and construct a seawall was issued on March 20, 2013 ("Permit").2 The relevant Permit verbiage states: Wetland Permit to repair 42'of existing bulkhead located on inlet to Spring Pond; and erect ready-rock sea wall along property behind existing bulkhead to stop any more erosion of property; and replace sand behind seawall; and as depicted on the survey prepared by Nathan Taft Corwin III, Land Surveyor, last dated February 26, 2013, and stamped approved on March 20, 2013. Subsequent to the issuance of the Permit, the bulkhead was repaired, the seawall constructed and sand fill was placed. As of this date, construction has not been completed— stone armoring at the seaward base of the seawall has not been installed. Design Plan Inadequacies. I have reviewed the design plan prepared by Mr. Corwin and as approved for construction by the Board ("Plan"). It is my professional opinion that the Plan contains a serious design flaw that renders the seawall subject to immanent failure due to wave scour. The Plan shows the proposed location of the Redi-Rock wall to be a distance varying between 4 to 8 feet behind (landward) of the existing bulkhead.3 At this location, the bulkhead cutoff wall would not provide the required scour protection at the toe of wall.4 The Redi-Rock seawall is a massive concrete block gravity wall that does not contain a foundation or other integral device to resist the design scour ' The Town issued an Emergency Work Permit shortly after the storm event. 2 Permit No. 8085 &8085C issued to Thomas J.Aprea 3 As scaled off the lines shown on the plan—dimensions are not provided. a The toe of wall is defined as the front,base portion of the wall. It is at this point that soil loads are largest as the wall resists overturning. 2 level expected during a storms Scour at the toe of this type of seawall is the primary mode of failure during a storm event: both incoming wave force and reflected wave force removes sand from the seaward side of the wall, the front of the wall settles into the void thus created, the wall tilts seaward, the seawall overturns into the seawater, and progressive erosion occurs behind the wall very quickly from this point forward threatening the dwelling and other protected structures. As it is imperative to prevent toe scour in any seawall, proper engineering design and construction practice focuses on this aspect of coastal protection. An example of this is contained in a Coastal Engineering Technical Note prepared by the U.S. Army Corps of Engineers, which states in part: Toe Protection. Erosion at the toe of the seawall may undermine the structure's foundation and cause the wall to tilt seaward. Conversely, loss of backfill will create a cavity into which the wall can tilt landward. Toe protection usually consists of a layer of quarrystone large enough to not be removed by wave forces and an underlying layer of granular material or geotechnical filter fabric to prevent soil from being washed through voids in the quarrystone. If the seawall is built on soft or sand soil, a sheetpile cutoff wall, driven deep enough to prevent scour from undermining the wall, may be required at the toe as shown in Figure 3. In severe wave climates both quarrystone and cutoff wall may be required. Ground water accumulated behind the wall may create an upward hydraulic pressure or even an upward flow at the toe which may remove soil there. The cutoff wall lessons the pressure at the toe, and the quarrystone blanket and filter prevent the removal of soil. The bulkhead acts as the cutoff wall in this application only if it is located at the toe of the seawall. The Plan erroneously places the seawall several feet behind the cutoff wall as mentioned above leaving the seawall toe completely unprotected. The importance of a cutoff wall for this type of seawall (that has no effective toe protection) cannot be overstated since in a severe tidal storm event such as Sandy, scour could reach a level many feet below the normal shore line level swallowing any stone revetment or armor. 5 It is my understanding that Sandy caused localized scour levels as much as 8 feet below sea level. 6 Coastal Engineering Technical Note,Seawalls—Their Applications and Limitations,CETN-III- 8,3/81,U.S.Army Corps of Engineers Coastal Engineering Research Center. You have stated to me that at the time of the start of construction of the seawall the contractor insisted on constructing the seawall directly behind the cutoff wall (bulkhead) and in conformance with his knowledge of proper seawall installations. As discussed above, it is my professional opinion that the contractor's suggestion is a mandatory part of installing a proper seawall and it is fortuitous that his field change was implemented to protect the dwelling and the life safety of its occupants. Furthermore, you stated that you called the Town to schedule an inspection at this time in accordance with the Permit requirements and was informed that only a final inspection will be done after the completion of construction. Construction then commenced without notifying the Town that the field change was made to move the seawall. Proposed Resolution of the Board's Concerns. 1. With regard to the 30-year maintenance agreement, I have been advised by the Board that the Town has local jurisdiction for complying with NYS DEC Part 505 Coastal Erosion Management.' Pursuant to this regulation you are required to execute the agreement (copy attached) stating in part that you will "maintain this structure with materials designed to endure 30 years and/or equivalent to the original approved structure." I can herewith certify that the materials and placement of those materials currently meet this requirement; and I have advised you to comply with this requirement. I understand that you are amenable to this and will resolve this concern by executing the maintenance agreement. 2. With regard to the exposed face of seawall being greater than 4 feet, the Board opined that their approval of this exposed height as shown in the Permit documents is based on aesthetic considerations pursuant to the Local Waterfront Revitalization Policies and its stated objective to limit hardened shoreline. The preexisting bulkhead and groins had already categorized this property as hardened shoreline prior to the storm. The installation of the seawall did not add to the length of hardened shoreline. Topographic elevations are not shown on the Plan, therefore, the permitted elevation of the seawall cannot be 'Town Code Chapters 275& 111 8 Here specifically referring to the erosion control structures consisting of the concrete block gravity seawall,cutoff wall,stone armor,and geosynthetic fabric(after construction is complete). 4 determined. Of course, none of the foregoing relieves you from complying with the 4 feet of permitted exposed face of wall unless an amendment to the permit is obtained. You will have to complete construction of the structure in one of the following manners; a. Replace the top 14" of bulkhead that was destroyed during the storm, b. Add stone armoring in front of the seawall, or c. Remove the 7" high capstone to bring most of the seawall into conformance, and add one or both of the measures in a or b above at any points where the present exposed face is greater than 4'-7". The Board suggested that the overall height of the wall be reduced by the removal of the top course of 18" high blocks. I do not recommend this since the resulting seawall will not adequately protect the dwelling structure and life safety of its occupants.9 It should also be noted that the top block has a flat top surface for a finished appearance. Removal of this block would expose the raised key on the lower block. 3. With regard to the seawall being too close to the bulkhead, there is no recourse other than an amendment to the Permit. As expressed above, the approved location of the seawall as proposed on the Plan is fatally flawed because it is structurally deficient. I trust that you can reach an amiable solution to all of the Board's concerns using the analysis and recommendations discussed above. The riprap will be in front of my bulkhead and just in front of the seawall to stop erosion from undermining the seawall and to stop any further sand from spilling into the inlet to Spring Pond which is the entrance to Gardiner's Bay Estates by water. Wave breaks, riprap, have been used to stop or deter strong waves and currents from eroding coastal communities as well as jetties, seawalls and bulkheads. By the way, the mayor of New York City has started a project to erect an 11' high seawall around lower NY harbor to stop any further damages from strong storms like Sandy. Also, Japan is erecting seawalls to stop tsunamis. This problem is not just a local problem, so I cannot see anyone in their right mind being opposed to this project. Fortunately for my community, my property is a natural barrier island to the community and my neighbors have the piece of mind of being behind my property and seawall which will hopefully stop any surges and strong waves from breaking it. As for the low voltage accent lighting under the top of the seawall is concerned, as you can see by this photo the lights on Mrs. Mooney's house are very much brighter than the red 1 watt accent lights under the top of the seawall. These lights are NOT visible from Mrs. Mooney's house or any neighbor's house in the community. Two weeks ago a DEC inspector came back to my house to inspect how the project was going and was pleased to see the outcome, since he was also at my house just after Sandy had ravaged it. During his visit he stated that the lights were also an aid to navigation. I would like to point out that flood insurance does not cover property such as land, decks, bulkhead and sand loss, it only covers the structure and its contents. The expense for this project came out of my pocket. I have been a resident of Southold Town since 1969 and have paid flood insurance for 25 years. I must say, in closing, that the Southold Town Trustees office and its employees such as Amanda and Elizabeth have been tremendously helpful to me and other residents of Southold Town working on recovering from the ravages of monster storm Sandy.
