TERMS AND CONDITIONS The Petmittee Caroline & Dougall Fraser, Jr., residing at 7955 Nassau Point Road, Cutchogue, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. Herrmann Eh-Consultants 1319 North Sea Road Southampton, NY 11968 RE: CAROLINE & DOUGALL FRASER, JR. 7955 NASSAU POINT ROAD, CUTCHOGUE SCTM# 118-4-7 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, February 20, 2013 regarding the above matter: WHEREAS, En-Consultants on behalf of CAROLINE & DOUGALL FRASER, JR. applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 30, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Headng was held by the Town Trustees with respect to said application on February 20, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of CAROLINE & DOUGALL FRASER, JR. to construct a +50' Iow-profile vinyl groin in-place of existing +64' groin and remove most seaward :1:14' of existing groin; remove and replace 3'xl 0' steps to beach; with the conditions that top of groin be no less than 4' from top of bulkhead and not longer than 50'; and all remnants of old groin to be removed off site; and as depicted on the site plan prepared by En-Consultants, last dated March 7, 2013 and stamped approved on April 2, 2013. My wife and I are homeowners whose property is 800 feet "downstream" of the proposed project. The jetty topic has been a sensitive one along this stretch of waterfront and we, along with other homeowners along this sensitive and erosion-prone section of bay front, are facing long term decisions regarding the best way to mitigate the continuous loss of sand below our bulkheads. There are a number of private jetty's of varying ages along the eastern shore front of Nassau Point. By walking the beaches or viewing aerial photography, it would appear that the jetty structures do have the effect of building or retaining beach elevations and protecting bulkheads fi.om incessant wave action, during normal weather. Certainly, there is a benefit of accumulating sand in the vicinity where the jetty structures are located. However, the aerial photos and personal observation would suggest that properties downstream (southward in this location) are disadvantaged. I have been told, although I do not have any primary documentation to this effect, that the original approval for the Fraser jetty a number of years ago, was for a "low profile" jetty. Apparently what was built at that time was not "low profile" according to what I am told are the definitions and specifications used by the Board of Trustees. Thus I was disturbed to observe this past autumn that a replacement structure of durable vinyl was being erected without, as I would have expected at that time, a public notice regarding that project. And this replacement did not appear to be "low profile." We are not at all opposed to the installation of "low profile" jetty structures. We are interested in the Trustees' deliberations and decision regarding the Fraser application because we, as well as other adjoining neighbors, need to consider a jetty solution as one of our own options. Thus, hopefully, we can look to your decision on the Fraser permit as an indication of the Trustees' thinking as to "best practices" for the mitigation of beach erosion by property owners in this vulnerable area. Bottom line, we favor your approving for Fraser a "low profile" jetty, provided that a "low profile" jetty, per your specifications and dimensions, is the final outcome of the project. And we hope that your decision on this application would be indicative of your willingness to consider similar applications by other neighboring property owners.
