The property is located at 6245 Cox Lane, _+560' northeast of County Road 48 & Cox Lane, Cutchogue. Donald Wilcenski: Motion carries. 6:02 p.m. - 8 Hands Farm - This site plan is for the proposed construction of a 60'x120' (7,200 sq. ft.) metal barn on a 25.69-acre Town of Southold Development Rights parcel and the conversion of an existing 4,200 sq. ft. barn to a farm stand on the adjacent 1.84-acre reserved parcel that includes a two-story dwelling in the A-C Zone. The property is located at 4735 Cox Lane, _+550' s/o CR 48 and Cox Lane, Cutchogue. Donald Wilcenski: Motion carries. 6:04 p.m. - New Suffolk Waterfront Fund, Inc. & Robins Island Holding, LLC This proposed Lot Line Change will transfer 1.12 acres from SCTM#1000-117-8-18 to SCTM#1000-117-8-19. SCTM#1000-117-8-19 will increase from 0.46 acres to 1 acres and SCTM#1000-117-8-18 will decrease from 3.43 acres to 2.31 acres in the M-II Zoning District. The property is located at 650 & 380 First Street, on the east side of First Street, approximately 32.20' south of King Street in New Suffolk. Donald Wilcenski: At this time, I would like to ask anybody from the general audience if they would like to address the Board on this application, please state and sign your name for the record. Abigail Wickham, Esq., 13015 Main Road, Mattituck, attorney for the applicant: Here with me this evening is the chair of the New Suffolk Waterfront Fund, Barbara Schnitzler, a number of Board Members and other members of the organization. Also counsel for Robins Island Holding, Valerie Marvin is here, and Martin Reed of Barrett Bonacci & Van Weele, who are the surveyors on file who have prepared the map in front of you. As the Board is aware, we have received a variance from the Zoning Board of Appeals to accomplish this Lot Lline Change. I also know the Board is aware-- but I would like to clarify for the record--that this is an application and a hearing that Southold Town Planninq Board Pa.qe Four March 181 2013 addresses the Lot Line Modification which is nearly losing the division line between the two properties to the north so that the Robins Island Holding parcel will now be well over an acre (1.58), and the Waterfront parcel will be 2.31. That is the only application before you this evening. As you know, there have been a number of discussions as a result of our application to the Zoning Board of Appeals for other specific uses on the property. We will be coming back to you when those proposed uses have been refined and plotted out and planned for a site plan--at which time you will be asked to address all the specifics of on-site parking and review the Health Department, Architectural Review and all those other elements will be incorporated. Tonight we are just moving the boundary lines. If anyone has any questions, we are available to ask. Thank you. Donald Wilcenski: Thank you. I would like to reiterate the counsel's comments with regard to this application and public hearing. It is with regard to a Lot Line Change; it has nothing to do with a site plan application. Would anybody from the audience care to speak to the Board at this time? Please state and write your name for the record. George Maul, 2665 Jackson Street, New Suffolk: I just have a question. I believe that before there was a subdivision there was an easement from the Peconic Land Trust on these two pieces. I'm noticing now on this application that there only seems to be a Peconic Land Trust easement on the south portion of the piece. I'd like to know how that happened, when that happened, and what that means. Gall Wickham: The plan in that respect has not changed. There are two easements shown on the map. One is a Peconic Land Trust Conservation Easement which will affect _+1.118 acres on Parcel #2, which will be the Robins Island Holding parcel. That is the entire parcel which is going to be conveyed from New Suffolk Waterfront Fund to Robins Island Holding and merged with their existing parcel. That will be essentially a nature preserve, but it will allow Robins Island Holding to have certain uses on the property, including (and this is in your file) a small boat shed near or attached to the existing building and a small parking lot which will be impervious. So that is on the map and has been. The other proposed easement which we are close we think to finalizing with NYS Parks Department is on proposed Parcel #1 which is the parcel being retained by New Suffolk Waterfront Fund. That consists of over an acre of property along the north side of Main Street and going somewhat northerly in the front area of the property and also encompassing the entire beach area and revetment area and a large portion of the bulkheaded shorefront to the south of the restaurant building. That language has tentatively been approved by NYS; it hasn't been finalized yet, but basically it will require that area of the property be dedicated to park purposes. So it won't be built on except by specific park-related things that the NYS Parks Department would allow. Of course, the site plan would be something we would have to come back here on. Right now the only anticipated structures on that area would be possibly some sort of viewing platform or boardwalk along the front. So, both of those easements that this gentleman referred to are shown on your map. Thank you. Donald Wilcenski: Thank you. Does that answer your question? Southold Town Plannin,q Board Pa.qe Five March 18, 2013 George Maul: No, that doesn't really answer my question. Because on the third piece that Gail didn't speak about, which is the piece where the Galley Ho is, there doesn't appear to be any easement on that property now. Was there one when it was one piece of property? And how did it go away is what I am asking--not about the New York State construction easement. Gail Wickham: There are only two pieces, there are not three pieces. On Parcel #1- which is the second item I just spoke about--that is where a portion of Parcel #1 will have the New York State Parks easement. The remaining portion of the property, which will contain the existing buildings and the marina and some of the waterfront--a good (inaudible) of the waterfront-will not be subject to that particular easement, but will be available to be utilized so that the parcel can have some viability in order to be able to sustain itself. Those pieces are regulated by the M2 zoning. What I might want to mention is that by virtue of taking so much of this property subject to a Parks easement, they are not going to be able to have a ferry terminal or a hotel or some of the awful things--large (inaudible) that M2 zone would otherwise allow to occur on the property. So it will dramatically reduce the intensity commercially of what can happen on that property. But there is a commercial aspect to it, and that's what we are coming back to with site plan as soon as possible. Thank you. Donald Wilcenski: Does that answer your question? There are only two lots. Geor.qe Maul: No, I wasn't asking about the lots and I wasn't asking about the NYS easement. I am asking about the Peconic Land Trust easement that was on this entire piece of property which now seems to only be on one half of the property. Gail Wickham: OK, I'll try it again. I think what he is referring to is some sort of easement--there was never a Peconic Land Trust easement on the entire property. The Land Trust owned the entire property and sold it to the Waterfront Fund. The Land Trust does have on the property a right of first refusal. So, should the Waterfront Fund ever sell the parcel, they would have to offer it first to the Land Trust and that would give them a supervisory role toward what the Land Trust goals would be of waterfront usage. In fact, they have already consented to the sale to Robins Island Holding pursuant to that right of first refusal and waived it for that. But they will always have a finger in the pie so to speak. Donald Wilcenski: OK, so just to make it clear to you, Mr. Maul, the property was owned by Peconic Land Trust--it was not an easement intact on that. George Maul: Can I just say that I understand that the property was owned by Peconic Land Trust and I believe that the Peconic Land Trust represented to the community that there was a conservation easement on the entire piece of property. That was the way that I believe it was represented by Peconic Land Trust. SUBDIVISIONS - CONDITIONAL FINAL DETERMINATIONS Bayberry Estates - This proposal is for a Standard Subdivision of a 50.1-acre parcel into 18 lots and two (2) open space parcels where the lots range in size from 0.6 acres to 0.8 acres, with the open space parcels totaling 35 acres excluding the wetlands in the R-80 Zoning District. The property is located on the w/s/o Laurel Avenue, approximately 150' s/o Yennecott Drive, Southold. SCTM#'s 1000-55-6-35 & 36, 56-1-1 Pierce Rafferty: Mr. Chairman, I will offer the following resolution: WHEREAS, this proposal is for a standard subdivision of a 50.1-acre parcel into 18 lots and 2 open space parcels where the lots range in size from 28,235 square feet to 36,400 square feet with the open space parcels totaling 35 acres, excluding the wetlands, in the R-80 Zoning District; and WHEREAS, on April 14,2011, the Southold Town Planning Board granted Conditional Preliminary Plat Approval upon the plat entitled "Subdivision Map Bayberry Estates - Preliminary Plat", prepared by Howard W. Young, L.S., dated October 31, 2006 and last revised on August 24, 2010 with conditions; and WHEREAS on August 8, 2011, the agent submitted a completed Storm Water Pollution Prevention Plan (SWPPP); and WHEREAS, on August 23, 2011, the agent submitted a Letter of Water Availability; and WHEREAS, on September 9, 2011, the agent requested an Extension of Preliminary Plat Approval; and Southold Town Planning Board Page Seven March 18, 2013 WHEREAS, on September 13, 2011, a referral was sent to the Office of the Town Engineer to review the submitted SWPPP; and WHEREAS, on September 13, 2011, the agent submitted the Final Plat Application, Full Environmental Assessment Form, six sets of the Final Plat and the Final Road and Drainage Plans, a Draft Performance Bond Estimate, and the Town of Southold LWRP Consistence Assessment Form; and WHEREAS, on September 26, 2011, the Southold Town Planning Board, at their Work Session, considered issuing an extension of Conditional Preliminary Plat Approval; and WHEREAS, on October 4,2011, the agent submitted Covenants and Restrictions and an Open Space Conservation Easement; and WHEREAS, on October 17, 2011, the Planning Board extended Conditional Preliminary Plat Approval; and WHEREAS, on October 20, 2011, the agent submitted one copy of the Final Plat stamped by the Suffolk County Department of Heath; and WHEREAS, on November 10, 2011, the agent submitted Exhibit A of the Covenants and Restrictions; and WHEREAS, on December 27, 2011, the Office of the Town Engineer responded with comments to the referral sent; and WHEREAS, on March 12, 2012, the Planning Board accepted the Town Engineer's comments; and WHEREAS, on July 26, 2012, the Assistant Town Attorney submitted a Draft Drainage Easement to the Planning Department; and WHEREAS, on August 28, 2012, the agent was sent a revised Open Space Conservation Easement, a Draft Drainage Easement, and the Draft Covenants and Restrictions; and WHEREAS, on September 21, 2012, referrals were sent to the Office of the Town Engineer, the LWRP Coordinator, the Suffolk County Planning Commission and the Southold Town Fire District; and WHEREAS, on September 24, 2012, the agent submitted the Final Plat Application Fee in the amount of $500.00; and WHEREAS, on September 28, 2012, the Southold Fire District responded to the referral and requested that a fire hydrant be installed on the n/e corner of Doctors Court and O'Malley Drive; and Southold Town Planning Board Page Eight March 18, 2013 WHEREAS, on October 5,2012, the Office of the Town Engineer responded to the referral with comments; and WHEREAS, on October 9, 2012, the agent submitted an Open Space Conservation Easement; and WHEREAS, on November 8, 2012, the Planning Board reviewed the referral responses; and WHEREAS, on November 19, 2012, the Suffolk County Planning Commission responded with comments; and WHEREAS, on November 19, 2012, the Planning Board, at their Work Session, requested that changes be made to the Final Plat per referral comments, and accepted the Draft Bond Estimate; and WHEREAS, on November 30, 2012, the Town of Southold Local Waterfront Revitalization Program (LWRP) Coordinator reviewed this application, and has recommended the proposed project be found consistent with the policies of the Southold Town LWRP; and WHEREAS, on December 3, 2012, the Planning Board reviewed and accepted referral responses from the Suffolk County Planning Commission and the LWRP Coordinator; and WHEREAS, on December 17, 2012, the agent submitted three set of the Final Plats and the Final Road and Drainage Plan; and WHEREAS, on December 17, 2012, the Southold Town Planning Board set the Final Plat Public Hearing and made a determination of a Negative Declaration; and WHEREAS, on January 14, 2013, the Final Hearing on the Final Plat was held and closed; and WHEREAS, on February 11,2013, the Planning Board reviewed the comments from the Public Hearing; and WHEREAS, on February 11,2013, the Planning Board, at their Work Session, requested 12 Paper Copies and 4 Mylars of the Final Plat be submitted with an approved Health Department Stamp; and WHEREAS, on February 27, 2013, the applicant submitted 12 Paper Copies and 4 Mylars of the Final Plat with an approved Health Department Stamp; and WHEREAS, pursuant to Southold Town Code §240-21. Young, L.S., dated July 12, 2011 and last revised on November 19, 2012. This approval is conditioned upon the successful submission and acceptance of the following items/conditions: 1. Submission of a Park and Playground Fee in the amount of $119,000.00 ($7,000.00 per created lot (17)) pursuant to SS 240-53. Reservation of parkland on subdivision plats containing residential units. 2. Submission of an Administration Fee in the amount of $26,483.00 pursuant to §240-37(A) (6% of the Bond Estimate) of the Southold Town Code. 3. Submission of $828,800.00 to comply with the affordable housing buy-out amount (the 2010 buy-out rate is 207,200.00 x 4 = 828,800.00) pursuant to §240-10 (B)(c)(2)(a). SCTM#1000-125-4-24.23 Pierce Rafferty: Mr. Chairman, I would like to make the following resolution: WHEREAS, this amended site plan is for a proposed 5,000 sq. ft. addition to an existing 4,204 sq. ft. maintenance building & pump house on 154.7 acres in the A-C Zoning District, Laurel; and WHEREAS, the applicant submitted an application for site plan review on October 4, 2012; and WHEREAS, on December 3, 2012, the Planning Board accepted the application for review; and WHEREAS, on December 3, 2012, the Southold Town Planning Board, pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA), initiated the SEQRA lead agency coordination process for this Unlisted Action; be it therefore Southold Town Planning Board Page Fourteen March 181 2013 RESOLVED, that the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act §617.6, establishes itself as lead agency for this Unlisted Action; Bill Cremers: Second.
