BELLANDO SCTM#1000-117-10-10 Jeffrey Patanjo on behalf of JOHN W. BELLANDO requests a Wetland Permit to remove and replace 100 linear feet of existing bulkhead with vinyl bulkhead; raise bulkhead top cap elevation 4' above existing; import 130 cubic yards of clean sand fill behind bulkhead; plant disturbed bluff with beach grass; replace existing deck and stairs to pre-hurricane location and dimensions. Located: 1370 Jackson Street, New Suffolk. SCTM# 117-10-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, to remove and replace 100 linear feet of existing bulkhead with vinyl bulkhead; raise bulkhead top cap elevation 4' above existing; import 130 cubic yards of clean sand fill behind bulkhead; plant disturbed bluff with beach grass; is CONSISTENT with the LWRP. Further, it is my recommendation that proposal to replace the existing deck is INCONSISTENT with the below listed LWRP policy. A permit was issued by the Board for the stairs and decks in 2009 (below). However, condition requires code compliance if the 11' x t5' deck is replaced, 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The 252 square foot deck is not a permissible action pursuant to 275-11 Construction and operation standards, A (6). 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (6) Decks and platforms. No decks or platforms shah be permitted on or near bluffs. Platforms associated with stairs may not be larger than 32 square feet. [Amended 10-11-2005 by L.L.
