Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: February 13, 2013 Re: Proposed Wetland Permit for MARK MILLER SCTM#1000-81-3-24.2 Costello Marine Contracting Corp. on behalf of MARK MILLER requests a Wetland Permit to remove the existing stairway to beach; remove 160' of existing bulkhead; construct 173'+ of new bulkhead in- place, extending bulkhead to south property line; reinstall existing stairway to beach in-place; fill void areas landward of bulkhead with clean trucked-in fill approximately 125 cubic yards; re-grade areas; provide 10' wide non-turf buffer and re-vegetate with native plantings. Located: 1000 Paradise Point Road, Southold. SCTM# 81-3-24.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of $outhold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this. recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions i~luding Building Permits and other ministerial permits not located within the Coastal Erosion/~ag~rd zlrea. / 2. Before answering the questions in Section C, the preparer of./tfiis form should review the exempt minor action list, policies and explanations of each policy c9~6tained in the Town of Southold Local Waterfront Revitalization Program. A proposed actio)g'will be evaluated as to its significant beneficial and adverse effects upon the coastal area (wh~ includes all of Southold Town). / 3. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III -Policies; Page 2 for evaluation criteria. ~Yes [--] No ~'~ Not Applicable The existing bulkhead on this properly showing its age and Hurricane Sandy removed significant amounts o£wood sheathing leaving certai~ spots unprotected. We are proposing to reconstruct the e~sting bull;head then extend the bulkhead 13 'to the proper(y line to ensure the entire proper¢y is protected from storm surges. Our proposal will not have any effect on the communiO, character or preservation o£ open space. Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. A new bulkhead is attempt o£ the upland property owner to maintain their property. The visual quality and scenic resources will be restored to when construclion is complete. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria The existing bulkhead is needed to protect the upland property from storm surges. The new bulkhead will control further erosion and maintain the integrity of this properly. Our proposal will not increase flooding or erosion in this ~wea. The present condition of the bulkhead is poor due to the damage caused by HurtTcaoe S~ndy ~nd its age.
