Jeffrey Patanjo on behalf of 430 WSD LLC, cio PETER COSOLA requests a Wetland Permit to
remove and replace 100 linear feet of existing bulkhead with new vinyl bulkhead; install 20' long returns
on both sides and an additional 100' long X 4' tall vinyl retaining wall set back 10' landward on top of
proposed bulkhead to be replaced; remove and replace existing 7'x18' lower deck; stabilize upper
18.25'x27' deck with new timber supports; establish a 10' wide non-turf buffer along the top of the bank;
and to legalize the "as-built" 24.5'x20' stone patio and associated walkways. Located: 430 West Shore
Drive, Southold. SCTM# 80-5-2.1
The proposed actions to remove and replace 100 linear feet of existing bulkhead with new vinyl
bulkhead; install 20' long returns on both sides and an additional '100' long X 4' tall vinyl
'retaining wall set back t0' landward on top of proposed bulkhead to be replaced and establish a
t 0' wide non-turf buffer along the top of the bank are CONSISTENT with the LWRP provided that
the applicant gains permission to complete the actions. I reviewed the actions as new construction as
they do not have existing permits.
It is my recommendation that the proposed actions to remove and replace existing 7'x'18' lower
deck, stabilize upper 18.25'x27' deck with new timber supports and to legalize the "as-built"
24.5'x20' stone patio and associated walkways are INCONSISTENT with LWRP Policy 6.3 (below)
and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The structures described were not constructed pursuant to Southold Board Trustees
permit and with the exception of the 24.5'x20' stone patio, are not permissible under
Chapter 275 Wetlands and Shorelines regulations.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
