Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: February 12, 2013 Re: Proposed Wetland Permit and a Coastal Erosion Permit for SOUNDFRONT HOLDINGS, LLC SCTM#1000-51-4-8 En-Consultants on behalf of SOUNDFRONT HOLDINGS, LLC requests a Wetland Permit and a Coastal Erosion Permit to construct approximately 65 linear feet of steel bulkhead with 20' and 10' returns at toe of bluff in-place of (and +12" higher than) existing storm damaged concrete seawall to be removed; remove existing collapsed steel sheet piling wall from behind concrete seawall; construct approximately 47 linear feet of vinyl retaining wall with +9' and +10' returns at top of bluff and backfill with approximately 15 cubic yards of clean sandy fill to be trucked in from an approved upland source; remove collapsed steel sheet piling retaining wall from face of bluff and reuse materials to construct retaining wall landward of proposed vinyl retaining wall to retain upland soils during construction; construct timber terrace retaining walls on face of bluff to retain proposed fill and plantings; re-nourish bluff face with approximately 130 cubic yards of clean sandy fill to be trucked in from an approved upland source; re-vegetate bluff face with native vegetation; remove collapsed stairway and construct new 4'x50' stairway with landings down bluff face; construct 5'x6' landing and 4'x12' steps to beach off proposed bulkhead; replace collapsed brick patio on grade behind proposed retaining wall; and establish approximately 10' wide non-turf buffer seaward of Coastal Erosion Hazard Area boundary. SCTM# 51-4-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of $outhold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The due to property size, the relocation of the existing structure is not practical. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section II1 - Policies Pages 8 through 16 for evaluation criteria ~ Yes -- No ~ Not Applicable The project seeks to replace an existing storm damaged concrete seawall with a steel bulkhead in the same location (and +/-12" higher); to restore and provide a reasonable increase in the historically maintained protection of the bluff, upland property, and existing residence against erosion and flooding; to restore the bluff via terracing, sand renourishment, and revegetation; and to restore and maintain pedestrian access down the bluff and to the beach. The existing, developed site has been improved with and supported and protected from flooding and erosion by the existing concrete seawall since prior to 1977, and there is no viable non-structural alternative means of maintaining and protecting the bluff and the upland portion of the property in their current location. Without replacement and maintenance of the seawall, the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon; and without the restoration of the vegetated bluff face, it would not be able to serve its protective role to the property as its sole natural protective feature. The project will effectively maintain the historically existing conditions along this bulkheaded shoreline without any significant change hi or significant adverse impact on the adjacent beach or neighboring properties, which are also stabilized at the blufftoe by bulkheads, except that the project will result in 1) a net reduction in the area of the fronting beach occupied by structure as a result of the removal of the large concrete "knees" supporting the existing seawall; and 2) the vegetative restoration of the bluff face currently covered by collapsed structures.
