Re:
Proposed Wetland Permit for PATRIClA CONGDON O'BRIEN
SCTM#1000-128-4-1
En-Consultants on behalf of PATRIClA CONGDON O'BRIEN requests a Wetland Permit to remove
existing storm damaged timber bulkhead (including +6' section of bulkhead and existing return located
beyond westerly property boundary) and construct in its place approximately 96 linear feet of vinyl
bulkhead, a +16' vinyl return along the westerly property line, and a +36' return along the easterly
property line; reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x14' steps;
reconstruct 4'x8' steps to beach; and backfill with approximately 500 cubic yards of clean sandy fill to
be re-vegetated with native planting to restore storm eroded area landward of bulkhead to pre-storm
conditions. Located: 5000 Great Peconic Bay Boulevard, Laurel. SCTM# 128-4-1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed actions
remove existing storm damaged timber bulkhead (including +6' section of bulkhead and
existing return located beyond westerly property boundary) and construct in its place
approximately 96 linear feet of vinyl bulkhead, a +16' vinyl return along the westerly property
line, and a +36' return along the easterly property line; reconstruct in prior location a t4'x20'
storm damaged wood deck and 4'x14' steps; reconstruct 4'x8' steps to beach; and backfill with
approximately 500 cubic yards of clean sandy fill to be re-vegetated with native planting to
restore storm eroded area landward of bulkhead to pre-storm conditions, are CONSISTENT with
the LWRP.
The proposal to reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x'14'
steps and reconstruct 4'x8' steps to beach are INCONSISTENT with LWRP Policy 6.3 (below) and
therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The structures described were not constructed pursuant to Southold Board Trustees regulations
and a Chapter 275 Wetlands and Shorelines permit,
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its siRnificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southoid that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LWRP Section III - Policies; Page 2 for evaluation
criteria.

NATURAL COAST POLICIES
Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP
Section III - Policies Pages 8 through 16 for evaluation criteria
~ Yes ~ No ~ Not Applicable
The project seeks to replace an existing timber bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location to
restore the property's historical method of protection against erosion and flooding; and to reconstruct a previously existing deck and
stairways that were also damaged or destroyed during the storm. The existing, developed site has been improved with and supported and
protected fi.om flooding and erosion by a bulkhead since prior to 1970, and there is no viable non-structural alternative means of
maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the
bulkhead the subject and adjacent properties would be exposed to severe erosion, flooding, and damage to the residential structures
located thereon. Therefore the project is consistent with Policy 4.
Attach additional sheets if necessary
Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III
- Policies Pages 16 through 21 for evaluation criteria
Yes [--] No 7] Not Applicablc
The project is consistent with Policy 5 to the extent that the previously existing treated timber bulkhead will be replaced with a bulkhead
constructed with vinyl sheathing.
Attach additional sheets if necessary
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including
Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22
through 32 for evaluation criteria.
Yes [~ No ~ Not Applicable
Other than the ecological benefit of replacing a treated timber bulkhead with untreated vinyl sheathing, the project will effectively
maintain the historically preexisting conditions along this bulkheaded shoreline without any change in or significant adverse impact on
the adjacent unvegetated wetland area or tidal waters of the Town. Therefore, to the extent Policy 6 is applicable to the project, the
proposed work is consistent with the policy.

Policy 7. Protect and improve air quality in the Town of Southold. See LWRP Section III - Policies

substances and wastes. See LWRP Section III - Policies; Pages 34 through 38 for evaluation criteria.

PUBLIC COAST POLICIES
Policy 9. Provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold. See LWRP Section III - Policies; Pages 38 through 46 for evaluation
criteria.
~ Yes ~ NoN Not Applicable
Insofar as Policy 9 can be applied to the current project, the project is consistent with Policy 9 because thc proposed replacement of the
existing structure will in no way impede or preclude public access along the adjacent shoreline.
Attach additional sheets if necessary
