Proper-T-Permit Services on behalf of JOHN REARDON requests an Amendment to Wetland Permit
#7723 to repair and maintain the wood jetty structure damaged by Hurricane Irene from the seaward
end of the structure for approximately 60'+, cut top through-bolts to re-orient piles and loosen wales on
one side of the existing structure as necessary to replace missing and/or storm damaged wood
sheathing with 2" vinyl sheathing and re-assemble the structure in-place; and increase the size of the
proposed deck to be constructed between the bulkhead and the retaining wall from 10'x20' to 10'x150'.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
$outhold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

munity character, preserves open space, makes efficient use of infrastructure,
makes beneficial use of a coastal location, and minimizes adverse effects of
development.

The repair of an existing jetty is not inconsistent with the character of the water-
front community, and because of the relatively small footprint of the existing struc-
ture it is felt that there is no adverse impact on the desired preservation of open
space. Infrastructure use is not a factor since the project is accessory to and ac-
cessed from private property. The maintenance of the erosion control purpose of
the jetty is certainly a beneficial use of the coastal location, and there is no incre-
mental increase in development in the area since the jetty already exists, and has
for many years, in the same form as it will have after completion of the project.

The jetty repair and s~'engthening will be done in such a manner that upon comple-
tion of the project there will be no apparent change in the project site, since the
construction members will replace those formerly existing. The existing jetty,
which will retain its current form, is compatible with many other existing shoreline
structures in the area, and will not adversely affect dynamic landscape elements
(tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambi-
ent light) wh/ch might contribute to ephemeral visual qualities.

It is intuitively obvious that the likelihood of the activities proposed contributing to

existing jetty, which currently provides those features, is tending toward failure
and its repair is required in order that these protective features continue in effect.

The application is incomplete - No cross sections of the proposed work have been provided.
Proper-T Permit Services on behalf of JOHN REARDON requests a Wetland Permit to reconstruct 200'
of storm-damaged bulkhead using vinyl sheathing, increasing height by 1'+/- with stairs to grade on
seaward side; replace 184' of storm-damaged concrete retaining wall, with stairs from upland grade
and 5' returns at each end, with 200' of retaining wall, using vinyl sheathing, with stairs from upland
grade and 8' returns at each end; construct new deck 10'X 20' between bulkhead and retaining wall;
and fill area between bulkhead and retaining wall with clean sandy soil from upland location, approx.

The proposed action (increasing height by t'+/- with stairs to grade on seaward side; replace t84'
of storm-damaged concrete retaining wall, with stairs from upland grade and 5' returns at each

returns at each end); has been reviewed to Chapter 268, Waterfront Consistency Review of the Town

Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the replacements of
bulkheads is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP
Note: The construction of a proposed 200 square foot deck is not a permissible action pursuant
to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3
(below) and therefore, INCONSISTENT with the LWRP.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
~ccordance with the Resolution of the Board of Trustees adopted at the meeting held on February 22, 2012, and
~n consideration of application fee in the sum of $250.00 paid by John Reardon and subject to the Terms and
Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to reconstruct 200' of storm-damaged bulkhead using vinyl
sheathing, increasing height by 1'+ with stairs to grade on seaward side; replace 184' of
storm-damaged concrete retaining wall, with stairs from upland grade and 5' returns
at each end, with 200' of retaining wall, using vinyl sheathing, with stairs from upland
grade and 8' returns at each end; construct new deck 10'x20' between bulkhead and
retaining wall; and fill area between bulkhead and retaining wall with clean sandy soil
from upland location, approximately 350 cubic yards; and as depicted on the site plan
prepared by Proper-T Permit Services, last dated February 1, 2012, and stamped
approved on February 22, 2012.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these pre.sonts to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee John Reardon, residing at 920 Cedar Point Drive East, Southold, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that

That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there wilt be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permiltee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
