SCTM#1000-96-2-10.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type Il category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 20, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is located in the AC zone and is improved with a two story dwelling with attached deck, accessory garage,two accessory sheds and a barn. It contains 25.7 acres of land labeled development rights easement and 80,000 sq. ft. of land labeled reserved area. The reserved area contains all the current improvements. It has 764.38 feet of frontage on Cox's Lane, 1,066.26 feet along the western property line, 1,301.46 feet along the southern property line, 529.80 feet along the eastern property line, then the property jogs with 562.18 feet along the northern property line and then 616.16 feet along the eastern property line to form an "L" shaped parcel. As shown on the survey prepared by Peconic Surveyors, P.C., John T. Metzger, LLS, dated January 10, 2007, certifications added January 26, 2007. BASIS OF APPLICATION: Request for Variance from Chapter 72, Article II, 72-5 (B), 72-6 (1 & 3) and the Building Inspector's October 17, 2012, updated January 8, 2013 Notice of Disapproval based on an application for building permit to convert a portion of an existing barn to a farm stand, at; 1) less than the code required setback of 50 feet from the road, 2)the criteria of bona fide agricultural production has not been shown. RELIEF REQUESTED: The applicant requests variances to convert a portion of the existing barn to a farm stand with the existing front yard setback of 17 feet from Cox's Lane, where the code requires a permanent farm stand structure be set back at least 50 feet from the road. Additionally, it was determined by the Building Department that the applicant did not show that they meet the criteria of bona fide agricultural production. ADDITIONAL INFORMATION: The Zoning Board requested comments from the Planning Board. In a memo dated January 29, 2013, the Planning Board stated that it supports the granting of the variance applied for because the proposal is consistent with the Town's Comprehensive Plan goal of supporting and maintaining agriculture Page 2 of 3—March 21,2013 ZBA File#6625—Harbor View Farm,LLC SCTM: 1000-70-13-20.7 which the applicant will be furthering by proposing to converting an existing agricultural building to a new agricultural use. Additionally, the Zoning Board received a copy of a letter to the applicant/land owner dated February 7, 2013 from the Land Preservation Committee approving the applicant's request to construct a new 60 ft. x 120 ft. Morton barn building in the Town's preserved easement area to house farm animals interconnected to the farm stand use. During the public hearing the adjacent landowner voiced concerns about potential traffic impacts of the proposed farm stand and access by the public to the property. These concerns were addressed to the neighbor's satisfaction at the hearing. Another neighbor spoke in favor of the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 7, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. The operation provided sufficient evidence to the Board to illustrate that the farm is bona fide agricultural production The threshold issue before the Board is whether this operation qualifies as "bona fide agricultural production" within the context of Chapter 72 "Agricultural Uses" of the Town Code. At the public hearing the applicants testified that they have already planted the subject property in forage which would yield $40,000 +/- in hay sales; their current flock of sheep is valued at $22,000 and that once lambing has occurred this Spring up to an additional 10 sheep (total 70) will add a value of$41,000. Moreover, sales from wool are expected to yield $10,000. They also plan to plant about 2 acres on their residual property in vegetables for faun stand sales, and eventually sell their own cheese products as well as wool and yarn. A records search has found that the previous owner of the subject parcel received an agricultural assessment from the Town in 2008, verifying that the land had been in agricultural production for more than 2 years prior to transfer to the applicant. II. Area Variance for the Farm Stand 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The properties along Cox Lane are primarily in agricultural use, some improved with farm houses similar to the applicant's parcel. The subject parcel and barn have historically been used for agriculture. The applicant is currently operating a sheep farm on another property and plans to move to the subject property with their herd. The proposed farm stand will operate in a portion of a barn that already exists and there is ample room for safe parking in an area off the road adjacent to the barn. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The farm stand is proposed in a portion of an existing barn. To expect the applicant to construct a farm stand in a conforming location would be a financial hardship and would eliminate additional land that is proposed for harvest. 3. Town Law 4267-b(3)(b)(3). The variance for the front yard setback granted herein is mathematically substantial, representing 66% relief from the code. However, the barn has been existing in the current location since prior to zoning without any detriment to the area and has a Pre-CO dated January 8, 1992. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The off street parking area is proposed of permeable material. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The barn in which the proposed farm stand is to be located has been in its current location since prior to zoning. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a farm stand while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Goehringer, and duly carried,to GRANT, the variances as applied for, and shown on the survey prepared by Peconic Surveyors, P.C., John T. Metzger, LLS, dated January 10, 2007, certifications added January 26, 2007, and the three page hand drawn building plans date stamped by the Zoning Board on January 9, 2013. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require anew application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. You further explain that the proposed expansion will not be visible from outside the building and will have no effect on the setback variance relief for the farm/barn building granted by the ZBA. Based upon the information provided, I have determined that your request to amend the interior space of an existing building is de minimus in nature because the proposed change does not constitute an increase in the degree of non-conformity, and the intent of the original ZBA decision will not be altered. Under date of March 26, 2013 ZBA File 6625, the Zoning Board of Appeals granted relief permitting conversion of a portion of the inside of an existing barn to a farmstand. As part of its presentation the applicant presented a diagram of the proposed farmstand to indicate its approximate size and location. The stand was within an existing farm building. While the size of the stand was not an issue,the Building Department has noted that the original diagram showed a stand of approximately 900 square feet. The actual farmstand is 1,300 square feet. Under the circumstances where the farmstand is within a building, the location or size of the farmstand does not effect the setback and has no discernible impact. I submit this increase in size is of no consequence and should be treated as de minimis. The property where we propose to put the farm stand was purchased by us in 2011 from the Peconic Land Trust with the intent to build a multi-faceted,sustainable farm operation with the centerpiece of our operation based on products generated from the raising of sheep. We are currently leasing land in Mattituck where we have a flock of 37 Icelandic sheep, which we anticipate to be as many as 70 following the spring lambing season. The sheep are a multi purpose breed, raised in Iceland for meat but also prized for their fleece and the suitability of their milk in the production of premium cheese products. The property we purchased in Cutchogue from the Peconic Land Trust is part of the county agricultural district 1 and has been in agricultural production for many years. Most recently it was leased by Sang Lee to grow his organic vegetables. Currently the land is planted in some vegetables and a variety of forage in anticipation of the move of our sheep to this property. Historically the land has been used in bona fide agricultural production and will continue to be used in this manner. We project initial revenues based on the current flock size and average lambing rates for the breed,of$42,560. The land is a single parcel comprised of 25.69 acres with development rights sold and 1.84 acres on which are located a 4200 square foot double barn structure and a house. We would like to utilize the north half of the barn (2100 sq ft.) for a farm stand. We do not want to change the footprint of the barn, rather we propose placing the entrance for the farm stand on the north side of the structure,away from the road and facing the proposed future parking area.
