The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, February 20, 2013
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6661 to include a proposed 12' to 18' return running south to north
attached to the existing bulkhead to prevent further erosion to the southeast corner of
the property; add fill to re-establish eroded area and re-vegetate with beach grass; and
to include the repair or replacement of the existing 10'x10' deck with 3' wide stairways
on the north entrance to existing dwelling; and as depicted on the revised project plan
prepared by Charlotte C. Burkard, received on January 30, 2013 and stamped approved
on February 20, 2013.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Tues., February
12, 2013 the following recommendation was made:

CHARLOTTE BURKHARD requests a Wetland Permit to construct approx. 99 linear ft. of
vinyl bulkhead in place of existing, ston'n-damaged bulkhead and backfill scoured area landward

The in-place replacement of existing timber retaining wall, replacement of lost fill, and plantings
is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A
and B of the Town of Southold Town Code.
Thc proposed action tins been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and thc Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on thc LWRP Consistency Assessment Form
submitted to this department, as well as thc records available to me, it is my reconunendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, inchtding upgrading buildings to meet buildtng or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEIIA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit ".

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfxont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
