That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The O'rerrall side has large rocks against my wall. The previous owner has the same wall which was not sufficient as evidenced by the Sandy Storm. As a result of this storm, my adjacent wall collapsed and brought down a portion of my retaining wall ( not the bulkhead) I would like to recommend a better option to protect my walls. I will email you photos of the wall in question. The 0' Ferrall's are very nice neighbors who have been very forthcoming with their plans to repairthe Storm damage. This was a surprise visit, as I did not receive notice of the hearing that is now taking place on February 20th ..on a property which abuts my property at 11360 Main Road. I have not had the time to review the application and understand and absorb the effect that this major reconstruction will have on my real property interests. From what I gathered from the docket, I must voice my objections to the scope of application. My concerns are seated in the heart of the application, a request to rebuild the entire 131' shoreline structure in new vinyl bulkheading and to install 16 ' returns at either end of intended structure. How can the Trustees justify the approval of ripping down the remaining /still standing eastern end of the seawall which withstood Sandy's wrath and replace it with a modern, vinyl (and most likely a structurally inferior design) that can only be accomplished by digging out earth that is very much intact and abutting my property? OFarrell/Cerasani CPage 2/3) How can the placement of 16' returns at the property line possibly be installed without compromising the integrity of my current shoreline structure? A 16' return on the eastern property line would be a very disruptive to the integrity of the existing, intact embankment awhich still stands at the eastern end of the property, specifically where you and the other Trustess stood to observe the middle and westerly, damaged portions. The construction of 16' returns would most certainly cross/damage the integrity of the still standing portion of the remaining structure. Leaving the Eastern portion of the shoreline structure undisturbed will help preserve the integrity of my shoreline structure. Please note: When the Papson property, immediate to the west O'Farrell underwent "repairs" to its seawall several years ago, the heavy equipment shook the earth to the point that abutting western portion of the O'Farrell (formerly Ungerleider) 100- year-old seawall collapsed soon thereafter. Cause and effect? It cannot be proven unless a time lapse camera had been installed yet: Most likely. The remaining seawall on the eastern end of the O'Farrell shoreline, although it appears to match O'Farrell's, may very well be partially on my property if you strictly observe the metes and bounds of the property. I strongly object to removing the remaining portion of the seawall and to the construction of a return on the eastern end of the proposed structure. In regard to metes and bounds, I do not see a surveyor' mark on the remaining portion of the seawall itself showing where the O'Farrell property actually begins. The only on site surveyor's mark is well above the seawall and the angle of the actual metes and bounds up to the seawall itself is not apparent. My great- grandfather and his brother cooperatively connected the walls and the definition of where the O'Farrell wall begins/ends on the eastern end is not clearly marked and should not be mistaken by simply using a visual observation to determine where one begins and ends. 3/31 31.3-1• I • • I respectfully ask that the Trustees strongly suggest to the O'Farrells that they reapply instead to install a rock revetment to secure what remains of the remaining seawall and to ensure it's integrity, much like the existing revetment has done did on the western end of the shoreline. And, thereafter, allow a partial rebuilding of a structure/revetment of the shoreline structure, far removed from my property line. It is more than obvious that the rock revetment in front of the main part of my seawall is the major reason my seawall is still standing and that the partial rock revetment protecting the Papson property is the reason for that wall's mostly intact condition. Let's continue the good sense that a rock revetment makes along the shoreline vs. the new vinyl elixirs. A 16' return on the eastern property line would be hard to create without certainly damage to my property's integrity and would require the senseless removal of the still -standing portion of the O'Farrell seawall. I feel that the fact that the O'Farrell did not consult with me on their application and specificswas perhaps intentional. I previously had a conversation in the autumn of 2012, pre -Sandy, regarding their plans to rebuild their waterfront structure prior to Sandy. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water -dependent uses in coastal hazard areas. Locate new development which is not water -dependent as far away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The location of the proposed deck is within the Coastal Erosion Hazard Area (CEHA) and will be constructed on the bluff. All development is prohibited on a bluff pursuant § 111-12 unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities on a bluff may include open timber piles or other similar open work supports with a top surface area of less than 200 square feet and removed annually. Therefore, the deck, as proposed, is prohibited on the bluff pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS. The deck is not an unregulated activity or a specifically allowed action identified in the section. 6.3 Protect and restore tidal and freshwater wetlands. A. Without replacement and maintenance of the bulkhead, the subject and adjacent properties which are also presently stabilized with existing concrete seawalls, would be exposed to severe erosion, flooding, and damage to the residential structures located thereon.
