Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. On the enclosed survey, please not the surveyor has denoted the top of the bluff based upon a garden the neighbor had erected and maintained for years (shaded area on the right of the property). This encroachment has been remedied pursuant to the sale of the property, and the new owners, our clients, have allowed the garden to remain while we proceed with the permit process. The surveyor has intimated that had that man-made garden not been there, he would have positioned the location of the top of the bluff closer to the Sound, more closely following the natural slope of the area. This positioning is more favorable to our client with regard to his setbacks. Therefore, I am respectfully requesting a field inspection to ascertain the correct location of the top of the bluff so the surveyor can accurately portray the house positioning on the survey, and we can correctly follow all jurisdictional rules and regulations as we proceed with this building project.
