THIS INDENTURE, made the I~' day of December, two thousand twelve, BETWEEN
BARNACLE LLC, a Florida limited liability company, 815 Royal Palm Place, Vero Beach, Florida 32960,

party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings end improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as follows:
BEGINNING at a monument set on the southeasterly line of Equestrian Avenue at its intersection with the
northeasterly line of Beach Avenue, said monument being located 655.55 feet North of a point which is 3840.6t
feet West of another monument marking the United States Coast and Geodetic Survey Triangulation Station
"PROS"; and
RUNNING THENCE along said Beach Avenue line South 47 degrees 07 minutes 40 seconds East, 146.37 feet;
THENCE North 27 degrees 29 minutes 11 seconds East, 102.00 feet to a point;
THENCE North 62 degrees 05 minutes 00 seconds West, 127.05 feet to a point on the said southeasterly line of
Equestrian Avenue, this line abutting northeasterly on other land now or formerly of the party of the first part;
THENCE along said Equestrian Avenue line South 16 degrees 03 minutesA0 seconds West, 5.00 feei to a
monument; ;
THENCE still along said Equestrian Avenue line South 41 degrees 46 minutes 00 seconds West, 61.10 feet to the
monument set at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed, dated February
10, 2010 and recorded in the Office of the Suffolk County Clerk on February 23, 2010 in Liber 12617 page 056.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights Df the party of the first part in and to said premises; TO HAVE AN D TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
