6:00 p.m. - Corazzini, Richard -This proposed site plan is fora 6,000 s.f. addition to
an existing 3,150 s.f. building for office space and storage on a 6.8 acre parcel in the LI
Zoning District. The property is located at 6245 Cox Lane, 1560' n/e/o CR 48 & Cox
Lane, Cutchogue. SCTM#1000-84-1-32.1
6:02 p.m. - 8 Hands Farm -This site plan is for the proposed construction of a 60' x
120' (7,200 s.f.) metal barn on a 25.69 acre Town of Southold Development Rights
parcel and the conversion of an existing 4,200 s.f. barn to a farmstand on the adjacent
1.84 acre reserved parcel that includes atwo-story dwelling in the A-C Zone. The

Bayberry Estates -This proposal is for a Standard Subdivision of a 50.1 acre parcel
into 18 lots and two (2) open space parcels, where the lots range in size from 0.6 acres
to 0.8 acres, with the open space parcels totaling 35 acres, excluding the wetlands in
the R-80 Zoning District. The property is located on the west side of Laurel Avenue,

APPROVAL EXTENSIONS
Colony Pond -This proposal is for a standard subdivision to subdivide a 13.540-acre

Peconic Recycling & Transfer II -This site plan is for new construction of a building

The Southold Town Planning Board, at a meeting held on Monday, March 18, 2013,
adopted the following resolutions:
WHEREAS, this proposal is for a standard subdivision of a 50.1-acre parcel into 18 lots
and 2 open space parcels where the lots range in size from 28,235 square feet to
36,400 square feet with the open space parcels totaling 35 acres, excluding the
wetlands, in the R-80 Zoning District; and
WHEREAS, on April 14, 2011, the Southold Town Planning Board granted Conditional
Preliminary Plat Approval upon the plat entitled "Subdivision Map Bayberry Estates -
Preliminary Plat", prepared by Howard W. Young, L.S., dated October 31, 2006 and last
revised on August 24, 2010 with conditions; and
WHEREAS on August 8, 2011, the agent submitted a completed Storm Water Pollution
Prevention Plan (SWPPP); and
WHEREAS, on August 23, 2011, the agent submitted a Letter of Water Availability; and
WHEREAS, on September 9, 2011, the agent requested an Extension of Preliminary
Plat Approval; and
WHEREAS, on September 13, 2011, a referral was sent to the Office of the Town
Engineer to review the submitted SWPPP; and

WHEREAS, on September 13, 2011, the agent submitted the Final Plat Application, Full
Environmental Assessment Form, six sets of the Final Plat and the Final Road and
Drainage Plans, a Draft Performance Bond Estimate, and the Town of Southold LWRP
Consistence Assessment Form; and
WHEREAS, on September 26, 2011, the Southold Town Planning Board, at their Work
Session, considered issuing an extension of Conditional Preliminary Plat Approval; and
WHEREAS, on October 4, 2011, the agent submitted Covenants and Restrictions and
an Open Space Conservation Easement; and
WHEREAS, on October 17, 2011, the Planning Board extended Conditional Preliminary
Plat Approval; and
WHEREAS, on October 20, 2011, the agent submitted one copy of the Final Plat
stamped by the Suffolk County Department of Heath; and
WHEREAS, on November 10, 2011, the agent submitted Exhibit A of the Covenants
and Restrictions; and
WHEREAS, on December 27, 2011, the Office of the Town Engineer responded with
comments to the referral sent; and
WHEREAS, on March 12, 2012, the Planning Board accepted the Town Engineer's
comments; and
WHEREAS, on July 26, 2012, the Assistant Town Attorney submitted a Draft Drainage
Easement to the Planning Department; and
WHEREAS, on August 28, 2012, the agent was sent a revised Open Space
Conservation Easement, a Draft Drainage Easement, and the Draft Covenants and
Restrictions; and
WHEREAS, on September 21, 2012, referrals were sent to the Office of the Town
Engineer, the LWRP Coordinator, the Suffolk County Planning Commission and the
Southold Town Fire District; and
WHEREAS, on September 24, 2012, the agent submitted the Final Plat Application Fee
in the amount of $500.00; and
WHEREAS, on September 28, 2012, the Southold Fire District responded to the referral
and requested that a fire hydrant be installed on the n/e corner of Doctors Court and
O'Malley Drive; and
WHEREAS, on October 5, 2012, the Office of the Town Engineer responded to the
referral with comments; and

WHEREAS, on October 9, 2012, the agent submitted an Open Space Conservation
Easement; and
WHEREAS, on November 8, 2012, the Planning Board reviewed the referral responses;
and
WHEREAS, on November 19, 2012, the Suffolk County Planning Commission
responded with comments; and
WHEREAS, on November 19, 2012, the Planning Board, at their Work Session,
requested that changes be made to the Final Plat per referral comments, and accepted
the Draft Bond Estimate; and
WHEREAS, on November 30, 2012, the Town of Southold Local Waterfront
Revitalization Program (LWRP) Coordinator reviewed this application, and has
recommended the proposed project be found consistent with the policies of the
Southold Town LWRP; and
WHEREAS, on December 3, 2012, the Planning Board reviewed and accepted referral
responses from the Suffolk County Planning Commission and the LWRP Coordinator;
and
WHEREAS, on December 17, 2012, the agent submitted three set of the Final Plats and
the Final Road and Drainage Plan; and
WHEREAS, on December 17, 2012, the Southold Town Planning Board set the Final
Plat Public Hearing and made a determination of a Negative Declaration; and
WHEREAS, on January 14, 2013, the Final Hearing on the Final Plat was held and
closed; and
WHEREAS, on February 11, 2013, the Planning Board reviewed the comments from
the Public Hearing; and
WHEREAS, on February 11, 2013, the Planning Board, at their Work Session,
requested 12 Paper Copies and 4 Mylars of the Final Plat be submitted with an
approved Health Department Stamp; and
WHEREAS, on February 27, 2013, the applicant submitted 12 Paper Copies and 4
Mylars of the Final Plat with an approved Health Department Stamp; and i
WHEREAS, pursuant to Southold Town Code §240-21. Technical Requirements, this
application meets all the requirements for Conditional Final Plat Approval; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that this proposed
action is consistent with the policies of the Town of Southold LWRP; and be it
further

RESOLVED, that the Southold Town Planning Board hereby accepts the Draft Bond
Estimate in the amount of $441,390.00; and be it further
RESOLVED, that the Southold Town Planning Board hereby grants Conditional Final
Plat Approval upon the Final Subdivision Plat entitled "Clustered Subdivision of
Bayberry Estates -Final Plat", prepared by Howard W. Young, L.S., dated July 12,
2011 and last revised on November 19, 2012. This approval is conditioned upon the
successful submission and acceptance of the following items/conditions:
1. Submission of a Park and Playground Fee in the amount of $119,000.00
($7,000.00 per created lot (17)) pursuant to § 240-53. Reservation of
parkland on subdivision plats containing residential units.
2. Submission of an Administration Fee in the amount of $26,483.00
pursuant to §240-37(A) (6% of the Bond Estimate) of the Southold Town
Code.
3. Submission of $828,800.00 to comply with the affordable housing buy-out
amount (the 2010 buy-out rate is 207,200.00 x 4 = 828,800.00) pursuant
to §240-10 (B)(c)(2)(a). Technical requirements of the Southold Town
Code.
4. Submission of the Performance Bond in the amount of $441,390.00
pursuant to the Bond Estimate calculated by the Office of the Town
Engineer, dated October 4, 2012.
5. Submission of an Interim Road and Maintenance Agreement to the
Planning Department. The Interim Road and Maintenance Agreement
must be reviewed and accepted by the Planning Board.
6. The Covenants and Restrictions, Open Space Conservation Easement,
Interim Road and Maintenance Agreement, and Drainage Easement as
accepted by the Planning Board must be filed with the Suffolk County
Clerk. The liber and page number of the above referenced documents
must be recorded on all Final Plats.
7. Submission of Draft Road Dedication Papers.
8. Pursuant to §240-41 (C) Monuments. All monuments must be installed
that specifically outline the newly created property boundaries.
This approval is valid for 180 days from the date of the resolution unless an
extension of time is requested by the applicant and approved by the Planning
Board. No more than two extension periods of 90 days each may be granted. If
conditions are not met within 360 days of the Conditional Final Plat Approval, the
application for Final Plat must be re-submitted along with the corresponding fee.

WHEREAS, on February 19, 2013, the agent sent a letter requesting an Extension of
Conditional Preliminary Plat Approval; and
WHEREAS, on March 5, 2013, the agent submitted the Final Plat Application and the
Final Plat Application Fee in the amount of $500.00; and
WHEREAS, on March 17, 2013, Conditional Preliminary Plat Approval expired; be it
therefore
RESOLVED, that the Southold Town Planning Board hereby grants an Extension of
Conditional Preliminary Plat Approval through June 18, 2013 on the map entitled
"Colony Pond Preliminary Plat" dated April 29, 2006, last revised July 13, 2012, with
conditions.
The applicant is advised that specific covenants and restrictions and/or map
changes may be required depending on comments received from other regulatory
agencies, including the Town LWRP Coordinator, Town Engineer, Town Trustees,
Highway Superintendent, Suffolk County Planning Commission, Suffolk County
Department of Health Services, and the New York State Department of
Environmental Conservation.
This approval is valid for 90 days from the date of the resolution unless an i
extension of time is requested by the applicant and approved by the Planning
Board. This 90 day extension is the first of two extension periods of 90 days each.
If conditions are not met within 360 days of the Conditional Final Plat Approval,
the application for Final Plat must be re-submitted along with the corresponding

The following resolution was adopted at a meeting of the Southold Town Planning Board on
Monday, March 18, 2013:
WHEREAS, this approved site plan is for new construction of a building that includes 32,000 sq.
ft. of warehouse space and 2,200 sq. ft. of office space for a transfer station use on a vacant

WHEREAS, Peconic Recycling & Transfer Corp., is the applicant of the 2.1-acre parcel in the
LIO Zone, owned by Commerce East One, LLC, located at the north intersection of Corporate
Rd. & Commerce Dr., known as 560 Commerce Drive, Cutchogue; and
WHEREAS, on August 11, 2008, the Southold Town Planning Board granted approval on the
site plan entitled "Peconic Recycling and Transfer" prepared by Michael K. Dunn, dated July 8,
2007; and
WHEREAS, on August 11, 2011, the site plan approval expired; and
WHEREAS, in a letter, dated March 7, 2013, the applicant, Jonathan DiVello, requested an
Extension of Site Plan Approval; and
WHEREAS, at their March 18, 2013 Work Session, the Planning Board reviewed the original
site plan approval in light of any new Town Code requirements, and found that the site plan
remains in compliance (except for lighting which is addressed in the condition below); therefore,

The Southold Town Planning Board, at a meeting held on Monday, March 18, 2013
adopted the following resolution:
WHEREAS, this proposal is for a standard subdivision of a 7.2 acre parcel into two lots
where Lot 1 = 3 ac. to be preserved entirely as open space and Lot 2 = 4.2 acres
including a 1.6 ac. historic preservation/accessory structure area and 2.6 acres of
preserved open space in the R-80 Zoning District, SCTM#1000-31-5-6; and
WHEREAS, the Planning Board performed an uncoordinated review of this Unlisted
Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality
Review Act (SEQRA); be it therefore
RESOLVED, that the Southold Town Planning Board, pursuant to SEORA, hereby
makes a determination of non-significance for the proposed action and grants a
Negative Declaration.

action described below will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be prepared.

This proposal is for a standard subdivision of a 7.2 acre parcel into two lots where Lot 1

ac. historic preservation/accessory structure area and 2.6 acres of preserved open
space in the R-80 Zoning District.
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed. The
determination was based upon the following:

Impact on Land
The test hole (March 3, 2012) indicates that water is greater than -17 feet below grade.
The depth to groundwater is sufficient to meet the 3' separation distance required for
sanitary systems per Suffolk County Department of Health standards. No substantial
impact to groundwater is expected to occur if the project is implemented as planned.
The proposed action is not expected to result in a significant adverse impact on land.
Impact on Water
1. Water Supply
Public water is currently supplied to the existing residential structure. No significant
impacts to public water supply are expected.
2. Sanitary Disposal
In 1978, the Long Island Regional Planning Board published the Long Island
Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study
identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones
were distinguished based upon differences in underlying groundwater flow patterns and
water quality. The subject site is located within SCDHS Groundwater Management
Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an
allowable flow of 600 gallons per day (gpd) per acre in areas served by public water.
One existing residential structure will remain as a result of this subdivision. Lot 1 is
proposed to be preserved and, therefore, no residential use is proposed. Lot 2 is 4.185
acres with an allowable flow of 2,520 gpd.
The sanitary design flow is computed using SCDHS manual Standards for Approval of
Plans and Construction for Sewage Disposal Systems for Other Than Single Family
Residences. The manual establishes the design flow as follows:
S/NGLEFAM/LYDWELUNG: 300 gpd x 1 dwellings = 300 gpd
Based upon the calculations, the required gpd are less than calculated allowable flow.
The proposed application will conform to Article VI of the Suffolk County Sanitary Code
and will not be expected to adversely affect groundwater quality provided properly
functioning systems are designed and installed.
The sanitary system will be replaced with a new system.
Therefore, the proposed application would conform to Article VI of the Suffolk County
Sanitary Code and would not be expected to adversely affect groundwater quality
provided properly functioning systems are designed and installed.

3. Ground or Surface Water Quality or Quantity
A tidal wetland (Dam Pond) is located to the east, a NYSDEC Critical Environmental Area.
The subdivision involves no new construction/development, therefore, no significant
adverse impacts will occur to the natural features as a result of this action. The New York
Department of Environmental Protection issued an Article 25 Tidal Wetland permit (ID-1-
4738-04149/00001) for the action on 1/25/13.
4. Flooding
The proposed improvements are located within FEMA Flood Zone X, areas identified as
areas of moderate or minimal hazard from the principal source of flood in the area,
therefore, the potential impacts from threat of flooding are low.
Impact on Air
No substantial adverse change in existing air quality is expected to occur.
Impact on Plants and Animals
The parcel is located within a New York State Department of Environmental
Conservation Critical Environmental Area and a New York State Department of State
Significant Fish and Wildlife Habitat Area.
No construction or development is proposed. No significant removal or destruction of '
large quantities of vegetation is expected to occur. Correspondingly, no substantial
interference with the movement of any resident or migratory fish or wildlife species nor
impacts on a significant habitat area is expected to occur. The potential of the
proposed action to affect the occurrence of rare or threatened plants or animals on site
or within the vicinity of the site is low.
Impact on Agricultural Land Resources
The parcel is not currently in agricultural production. Therefore, no adverse impacts to
agricultural lands will occur.
Impact on Aesthetic Resources ~
The residential structures are not visible from New York State Scenic Byway State
Route 25.
No substantial adverse impacts to aesthetic resources are expected to occur.

Impact on Historical and Archeological Resources
The action is not expected to impact important historical or archaeological resources.
The applicant is placing a historic preservation easement on the 4.185 acres on lot 2.
The easement defines the use and protects the architecture of the structures.
Impact on Ogen Space and Recreation
No significant impacts to public open space or recreational areas will occur as a result
of this action.
Impact on Critical Areas
The proposed action is located within a New York Department of Environmental
Conservation Critical Environmental Areas, however, no development is proposed that
could significantly impact the area. The majority of the shoreline of Dam Pond will be
protected by an Open Space Conservation Easement.
Impact on Transportation
No significant traffic volume (generation) or flow will occur.
Impact of Energv
No major change in the use of either the quantity or type of energy will occur.
Noise and Odor Impact
No substantial change in noise or odor is expected to occur.
Impact on Public Health
No creation of a hazard to human health is expected to occur. No substantial increase
in solid waste production, leaching or drainage problems is expected to occur if the
proposed action is implemented as planned.
Impact on Growth Character of Community or Neighborhood j
The proposed action is not in a significant material conflict with a community's current
plans or goals as officially approved or adopted. i
Based upon such, no significant adverse impacts to the environment are expected to
occur should the project be implemented as planned.

Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an
allowable flow of 600 gallons per day (gpd) per acre in areas served by public water.
Therefore, the allowable nitrogen bearing flow for the overall 53.93 acre site is 32,358
gpd. The existing uses currently are assessed at 7,194.15 gpd; with the new addition,
the total calculated is 7,432.30, below the maximum allowable flow.
Therefore, the proposed application would conform to Article VI of the Suffolk County
Sanitary Code and would not be expected to adversely affect groundwater quality
provided properly functioning systems are designed and installed. ~
3. Ground or Surtace Water Quality or Quantity
An Erosion Control Plan (Page 3 of 6) has been submitted. The proposed drainage is
adequate to capture run-off from a 2" rainfall and therefore, potential impacts from
storm water runoff are expected to be low.
No surface water is located within the vicinity of the site.
4. Flooding
The proposed improvements are located within FEMA Flood Zone X; areas identified as
areas of moderate or minimal hazard from the principal source of flood in the area,
therefore, the potential impacts from threat of flooding are low.

The parcel is improved with existing buildings and a golf course. At this location, a
maintenance building currently exists and vegetation is comprised of grasses, portions
of which are maintained as a fairway. Therefore, the potential occurrence of rare or
threatened plants or animals on site or within the vicinity of the site is low.
No significant removal or destruction of large quantities of vegetation is expected to
occur. Correspondingly, no substantial interference with the movement of any resident
or migratory fish or wildlife species nor impacts on a significant habitat area is expected
to occur.

The parcel is not currently in agricultural production. Therefore, no adverse impacts to
agricultural lands will occur.

The parcel is located adjacent to a designated New York State Scenic Byway (S. R. 25),
however, the improvements are not readily visible from the roadway screened by a
stand of trees north of the Long Island Rail Road Tracks.

The action is not expected to impact important historical or archaeological resources.
Impact on Open Space and Recreation
No significant impacts to public open space or recreational areas will occur as a result
of this action.
