Regarding your concern to perform maintenance dredging under Wetland Permit#8029 issued on January 23, 2013 with corresponding Certificate of Compliance#1139C issued on July 31, 2015. The Board of Trustees reviewed,your approved N.Y.S. Dept. of Environmental Conservation permit modification issued on October 6, 2015 for a ten (10) year maintenance dredging permit, and determined that this modification would be deemed to be maintenance dredging pursuant to Southold Town Code, Chapter 275-11 Construction and Operation Standards - C. Dredging: (3)(a)[1] only maintenance dredging(as defined in §275-2) is permitted, unless the applicant owns underwater land or the applicant is requesting permission to dredge in connection with installation of low-sill bulkheads. All maintenance dredging permits shall be valid for a period no greater than 10 years. To perform maintenance dredging will not substantially change the scope of the Board of Trustees Wetland Permit#8029 which is valid for maintenance dredging-for ten (10) years, or until January 23, 2023. Southold Town Attention: Town Trustees Annex Building Southold, New York 11971 UPCOMING MEETING OR SESSION WITH PLANNING BOARD ON OR ABOUT DECEMBER 1, 2014 RE: Mill Creek Partners LLC 64300 Route 25 Southold, NY 11971 Dears Sirs: I understand that there will be a Work Session or Meeting regarding more changes at the Property known as the Mill Creek Partners ,LLC Apparently when the Town Trustees, and the Planning Board approve the initial Site Plan, and we had the initial participation of the Public, obviously the Planning Department has closed session meetings.for the changes. I come to this conclusion, because things that The Public would argue being Destructive to the Freshwater Wetlands and Peconic Bay are adversely going to effect the public without their knowledge, as the entire Plan has been changed without Public Invited Hearings. These excessive changes over this time should have required Trustee Board Public Meetings. This is becoming an entire new Plan than originally approved, and there have been no public Trustee Agenda's regarding all these new changes. It has become a regular policy in this Town to ask for a Plan to be approved by all Town Departments involved in the decision to approve or deny everything noted in the Plan. It then is approved because it is already anticipated by the Builder or Owners of the property, that they will then ask for additional things they want, or have already done without the knowledge of ALL involved Town Departments . This is why we have problems with our waters and seafood. There is not enough continuity with ALL Town Departments and the Public. Builders take advantage of all this. During your upcoming Meeting or Discussion,my concern is that the changes they want be denied if it effects their original Parking Spaces, and if it does, that they will try toget you to approve more parking in the Wetland area. If they knew in the beginning how many parking spaces they needed, then they should have not added so many changes. The Plan approved tells them how many Parking Spaces they are required to have within the Site. Please make note of these things, in view of the fact they have gone beyond the footprint of the property again, and all Departments involved are not aware of what these changes are. This places the Building closer to the Designated Fresh Water Wetlands. I also want it noted that they should not be allowed to use Valet parking as a way to park cars off the site and try to get that counted as parking spaces. They must abide, as noted, in the approval, to have the amount of Parking Spaces on the site in order to be counted. Builders have to start respecting our Natural Resources, and not make a business of destroying them. I would like these concerns addressed at the Meeting, as they are asking for yet another change. I do look forward to safer environmental decisions. I also think all Departments should discuss changes before allowing them on their own, as this is also a Fresh Water and Bay -Sound issue. Activities requiring drainage control permit. Soils on site consist of FD (filled land). Historically, the parcel was a brick manufacturing yard and dredged material deposit area. Freshwater wetlands occur to the east of the parcel. Marine wetlands occur on the parcel. Soil borings indicate that groundwater levels are greater than 6.5 feet. The depth to groundwater is sufficient to meet the 3' separation distance required for sanitary systems per Suffolk County Department of Health standards. The distance from the sanitary system to the surface water is proposed at the greatest practicable due to lot configuration. Impact of Water 2.1. Water Supply The site will be served by public water. 2.2. Sanitary Disposal Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. The sanitary design flow is computed using SCDHS manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: Staff spoke to the SCDOH reviewer on October 17, 2012. An alternative sanitary system is proposed due to very low permeable soils. Therefore, the proposed application would NOT conform with Article VI of the Suffolk County Sanitary Code and would be expected to adversely affect groundwater quality. A SCDOH Board of Review assessment is required. To mitigate the potential adverse affects to groundwater quality the Planning Board is requiring that the applicant pump -out the sanitary system bi-annually - once in May and once in October to reduce the amount of wastewater in the system. 2.3. Ground or Surface Water Quality or Quantity As indicated above, the action requires a NYSDEC SWPPP. The on-site drainage proposed will capture storm water and prevent it from entering surface waters. Bathroom facilities are located in the dock master's building, however, the NYSDEC is requiring that wastewater be pumped to the existing sanitary system south of State Route 25. 2.4. An area of AE occurs in the south of the parcel. Impact on Air No substantial adverse change in existing air quality is expected to occur. Impact on Aesthetic Resources The parcel is located south of a designated New York State Scenic Byway (S.R. 25) an important view shed as identified by the community. The existing restaurant building interrupts the view shed from S.R. 25. Impact on Historical and Archeological Resources The New York Department of State GIS- Public Access map was referenced for occurrence of archeo-sensitive areas on site. The area is included and identified as an archeo-sensitive site. The area is filled land (filled in the past with mostly soil and bricks) and the occurrence of significant historical or archaeological resources is low. Impact on Open Space and Recreation No impacts to public open space or recreational areas will occur as a result of this action. Impact on Critical Areas The proposed action is not located within a New York Department of Environmental Conservation Critical Environmental Area. Impact on Transportation The LEAF indicates that the generation of traffic would result in significant generation above present levels. The form states that upon completion of the project a total of 10 vehicular trips per hour will be generated. Pump -out station requirements for offsite disposal of wastes due to the chemicals used in vessels so that biological activity and functioning of on-site sanitary systems and cesspools are not damaged. The use of untreated/composite lumber on all decking of the docks, ramps, and floats. That the applicant adheres to all of the Town Codes that pertain to the proposed project. Concerns about using oil & bluestone material within the driveway area located at the North end of the property. The new proposed retaining wall along Route 25 should get a full drainage review by the Town Engineer. The "new" wetlands on the site is likely exempt as "man-made" under Chapter 275 as entire area was mined for clay to make bricks. Give water - dependent development precedence over other types of development at suitably zoned waterfront sites within Mattituck Inlet and Creek and the Village of Greenport. A. Ensure that public actions enable Mattituck Inlet, Mill Creek and the Village of Greenport to continue to function as centers of water -dependent uses. B. Protect and enhance the economic, physical, cultural, and environmental attributes which make up the character of Mattituck Inlet and Creek, Mill Creek and the Village of Greenport. 0 0 10.3 Allow for continuation and development of water -dependent uses within the existing concentration of maritime activity in harbors, inlets and creeks. In addition to Mattituck Inlet and Creek and the Village of Greenport, important concentrations of water -dependent uses are located at Orient Point, Orient hamlet, Gull Pond, Mill Creek/Budds Pond, Town/Jockey Creek, New Suffolk, James Creek and West Harbor. Protect and enhance the economic, physical, cultural, and environmental attributes which make up the character of these harbors, inlets and creeks. 10.1(b) Improve the economic viability of water -dependent uses by allowing for non -water dependent accessory and multiple uses, particularly water enhanced and maritime support services where sufficient upland exists. The term water -enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the water's edge. Water -enhanced uses are primarily recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and viability of water -dependent uses. The improvement of the restaurant (water enhanced use) supports the above policy. Note: That the Board of Trustees issued a permit to the current owners (TR -9671) for the action on November 16, 2011. A Storm Water Pollution Prevention Plan is on file.
