SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK C. OUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated Jan. 14, 2013, stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION.' The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The Applicant's property is a conforming 2.45 acre parcel in the R-80 Zone.
The northerly lot line measures 156.43 fi. along Treasure Pond Rd. The easterly lot line measures 392.20 fi. along
adjacent property, the southerly lot line measures 316.52 ft. along other property, and the easterly lot line measures
450.22 ft., along an unnamed, private ROW. The property is currently being improved with a single family
dwelling, and the proposed detached garage, as shown on the survey drawn by CME Associates Engineering, Land
Surveying & Architecture, PLLC, dated Nov. 30, 2012.
BASIS OF APPLICATION: Request for Variance from Article I11 Code Section 280-15 and the Building
Inspector's November 2, 2012, Updated January 3, 2013 Notice of Disapproval based on an application for
building permit for an accessory two car garage with shed and loft, at: 1) accessory building is proposed in a
location other than the code required rear yard.
RELIEF REQUESTED: The applicant requests a variance to construct a detached garage in a front yard location,
when Town Code requires accessory building to be located in a rear yard.
ADDITIONAL INFORMATION: This property has two front yards, one yard adjoining a private road named
Treasure Pond Road, and one yard adjoining a private ROW. Both roads dead end within the adjacent
neighborhood, and they serve as driveway access for several neighbors, and also as ROWs for their buried utilities.
This R-80 neighborhood is sparsely developed, and will remain so, well into the foreseeable future because most of
the property on the north side of Treasure Pond Road is deeded to the H.L. Ferguson Museum, and is designated as
a land conservation area, containing some nature trails.

ADDITIONAL INFORMATION: At the hearing the Board closed the hearing subject to information regarding the
setback to the nearest adjoining neighbor, the proposed use of the loft area within the proposed garage, why it
could not be attached to the main dwelling and the proposed front yard location. In a letter received February 20,
2013, the agent submitted the requested information; in a sworn affidavit by the owner it was stated the loft shall be
used as a workshop for his hobby and the half bath now included in the second floor plan is allowed per code
within an accessory structure. Additionally, an aerial photograph was provided and it noted the closest neighbor at
214 feet away and down hill of the subject property rear yard.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on February 7, 2013 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Some other properties within the neighborhood have
detached garages located within front yard areas. This R-80 neighborhood is quite sparsely developed. The 23.4
acre parcel north of Treasure Pond Road is deeded to the H.L. Ferguson Museum, to be used as a designated land
conservation area, with nature trails. The 1.84 acre parcel to the east is currently vacant. The 2.3 are parcel to the
south is improved with a single family dwelling. The 3.2 acre parcel to the west, directly across the unnamed
private ROW, is currently vacant. A detached garage in a front yard area of this particular property, located several
hundred feet away from the nearest neighbors, will have no adverse effects on the character of the neighborhood.
2. Town Law §267-b{3)(b){2). The benefit sought by the Applicant to construct a detached garage cannot be
achieved by some method, feasible for the Applicant to pursue, other than an area variance because this property
has two front yards, and because the sloping topography of the property makes the rear yard area unsuitable as a
location for the detached garage. The architect provided a sworn affidavit regarding the grade and the difficulty of
attaching the garage to the dwelling. It would cause a substantial hardship due to the hills throughout the
neighborhood. The proposed location is the only flat and reasonable area for the proposed garage.
3. Town Law §267-b(3}(b'/{3}. The variance granted herein is mathematically substantial, representing 100%
relief from the code. However, the proposed detached garage will have a front yard setback of no less than 108 feet
from Treasure Pond Road. The nearest neighboring dwelling is currently more than 250 feet from the proposed
garage, and any future development on the two remaining adjacent, and still vacant, parcels east and west of this
property will also likely be several hundred feet distant from the garage.
4. Town Law §267-b{3}(b){4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law §267-b{3'}(b){5'}. The difficulty has been self-created. The Applicant could conceivably construct
an attached garage, and the Applicant purchased the parcel after the Zoning Code was in effect and it is presumed
that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning
Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a detached garage located within a front yard area, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267~B, motion was offered by Member Homing, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT, the variance/variances as applied for, and shown on the survey drawn by CME Associates Engineering,
Land Surveying & Architecture, PLLC, dated Nov. 30, 2012. Subject to the following conditions,
Conditions: 1. No sleeping or cooking facilities permitted. Loft, shed and garage spaces shall remain non-habitable.
2. No central heat or AC.
3. Seasonal heating and cooling permitted as proposed.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department of a building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited
above, such as aherations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other
.feature of the subject properO; that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the rightto substiiute a similar design that is de minimis in nature for an alteration that does not increase lhe degree of nonconformity.

(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment
to nearby properties ifgranted, because: The property faces the Block Island Sound over a pond. However,
it is not a "waterfront parcel" therefore the garage requires a variance to be located in the front yard. A
new house has been constructed and the architectural style conforms to Fishers Island character. The
garage is located in the location of the driveway.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant
to pursue, other than an area variance, because: The property is naturally sloped and the location of the
garage is on a plateau. The location of the detached garage is located at the gravel driveway and maintain
the natural vegetation along the right of way.
(3) The amount of relief requested is not substantial because: The garage will be set back at a conforming
principal setback, however, the location is regulated. There is no alternative location, other than the "front
yard", because the parcel faces the waterfront.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions

APPEALS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
This assessment is intended to supplement other information used by a Town of Southold agency
in making a determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within the
Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold
Local Waterfront Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which includes all of Southold
Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect
the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior
to making a determination that it is consistent to the maximum extent practicable with

I ~m writing to clarify the dormer sizes for the proposed garage at the Hoey Residence on
Fishers Island. The dormers on the front and back are 9 feet 6 inches wide in an average
roof length of/4 feet. That result~ in 39 percent roof coverage. The dormers on each side
are 4 feet 9 inches in an overall roof length of 12 feet. That results in 39 percent roof
coverage. These calculations are based upon my conversation with Mike Verity of the

I, Paul Burke, being duly sworn, deposes and says that I am the architect of the subject premises
and I could not be present at the Southold Town Zoning Board of Appeals heating on February 7,
2013, therefore, I respectfully submit this affidavit in response to the questions asked by the
Southold Town Zoning Board of Appeals at the hearing:
1. The garage was never in the original scope of work for the project and the Hoeys decided to
add a garage after the construction of the house was in place.
2. The topography of the land does not allow for an easy attachment with the way the grade falls
away to the Northeast.
3. From an aesthetic point of view, it is much more elegant to have a separate "carriage house"
feeling to the garage rather than slamming multiple garage doors up against a house of this
nature.
4. Tucking the garage behind the hill and offto the side diminishes its impact on the site and the
house itselfi
5. There is no heat in the garage only electric and water.
6. A sink and toilet are generally permitted in garages, would be connected to the existing
sanitary system, and is a custommy convenience to most of the garages I have designed. The
proposed ½ bathroom in the garage is shown on the floor plans attached to the affidavit of Robert
Hoey as Exhibit B.

I, Robert Hoey, being duly sworn, deposes and says that I am the owner of the subject premises
and I could not be present at the Southold Town Zoning Board of Appeals hearing on February 7,
2013, therefore, I respectfully submit this affidavit in response to the questions asked by the
Southold Town Zoning Board of Appeals at the hearing:
I. Why was the garage not connected to the house?
Response: We originally planned on a gardening "potting shed" but we soon realized that a
garage would be needed. The house was already designed. We had spent hours with the
architect planning the design of the house and to add a connected garage would compromise the
design. Ultimately, my wife and I prefer the look of a stand alone garage. Also, for safety
reasons, we wanted to have the ears farther from the main house.
The architectural style we chose was similar to the other properties that the architect has designed
for clients in Newport where file garages are stand alone. We like the New England architecture
and the stand alone garage does not detract from the architectural details of the house.
2. Why was the front yard location of the garage chosen?
Response: As can be seen fi'om the photographs taken by Z & S, we have 2 front yards requiting
variances, I am told that I would need a variance to place a detached garage in a "side yard" and
the rear yard is a hill down to another house on Treasure Pond. The proposed location conforms
to all other required setbacks. Exhibit A
3. What is the loft used for- is it heated? You understand that it can not be sleeping quarters.
Response: The garage is not for sleeping. I collect antique weight driven clocks. The loft is for
displaying my clock collection and to work maintaining my collection. Seasonal heat and air
conditioning is an option but not a necessity for my clocks. The construction used on these 100
plus year old clocks was designed before HVAC and I remain true to the construction from way
back when they were built.
4. Will the garage have a bathroom and what utilities are intended for the garage?
Response: We wanted a toilet & sink (no shower) so elec~ic and water is planned. The toilet is
provided so that when we are working in the garage and dirty from gardening, planting and other
hobbies we don't have to track dirt into the main house. Attached are plans prepared by our
architect for the ½ bathroom. Exhibit B
5.Enclosed is a Google map showing the distance to neighbors.
Response: The house and garage is set back far from Treasure Pond Road, We wanted the
garage in the front yard, on the north side of the property, because our southerly neighbor has
their gravel drive along the south-west side of the property and we want to keep the area
vegetated for privacy and away from our neighbor.
I asked Richa<l Strouse of CME Associates Engineering, Land Surveying & Architecture, PLLC
to plot our house and garage on an aerial photograph which shows the location of our neighbors,

Our closest neighbor on the south-east, Saint Amand is 216 feet fi.om the back of our home and
down the hill.
6. Can the garage be connected & if so where?
Response: Connecting the garage to the house would detract from the architectural style and look
of the house. We have water views and open space views from the windows on the side of the
house, connecting the garage would impede the water view from the side yard. In addition, there
are balconies and porches on the north side which would be affected by the connection of a
garage to the house.
Other comments: The garage will enhance the character of the neighborhood, matches the New
England style architecture of the house, and does not block the waterfront views from our house.
We purposely chose the north side of the property in order to prevent any visual impact to our
home or to our neighbors.
I asked the contractor to provide additional photographs so that you can see for yourself the
surrounding properties. We have no neighbors other than at the bottom of the hill, the Saint
Amand home (rear yard) and on the west side, the Geniesse home, which also uses the right of
way. The proposed location of the garage is the most logical and least intrusive location.
Our house is positioned toward the rear of the property in order to enjoy the views of Treasure
Pond and the Ocean. Because of the elevation of the property the house has unencumbered
waterfront views which would be blocked by a garage.
I make this affidavit knowing that the Town of Southold Zoning Board of Appeals will rely on
the truth of the statements herein.
