SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type I1 category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated January 8, 2013 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION.' The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION' Subject property is improved with two one story brick, stucco, concrete
block buildings in the General Business "B" Zone and contains 2.8765 acres. It has 382.63 feet of frontage on
Peconic Lane, 368.97 feet on Main Road (aka State Route 25) 310.07 feet along the eastern property line and
361.77 feet on the southern property as shown on the site plan dated June 12, 2012, revised 12/14/12 prepared by
Robert I. Brown, RA.
BASIS OF APPLICATION: Request for Variance from Article XI Section 280-47 and the Building Inspector's
December 12, 2012 Notice of Disapproval based on an application for building permit for demolition and
reconstruction of a portion of an existing commercial building at: 1) less than the code required front yard setback
of 100 feet.
RELIEF REQUESTED: The applicant requests a variance to demolish and reconstruct a portion of the existing
building located at 80 feet 8 inches from Peconic Lane where the code requires a 100 foot front yard setback.
ADDITIONAL INFORMATION: The Zoning Board request comments on this application from the Planning
Board. In a memo dated February 7, 2013, the Planning Board, "stated no objection to the requested area variance
on the basis the building is existing, not expanding its footprint and is appropriate for the overall use of the site and
building." They further stated, "the proposed construction appears to be well screened by the existing buildings
and accessible by large vehicles from Peconic Lane."
FINDINGS OF FACT/REASONS FOR BOARD ACTION:

The Zoning Board of Appeals held a public hearing on this application on February 7, 2013 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law ~267-b(3){b}(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The ama is zoned for business and this proposal is in
keeping with the business zone. The building on the subject property is currently an abandoned car dealership in
disrepair and an eye sore. This proposal will be a positive improvement to the neighborhood
2. Town Law §267-b(3}¢b}(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The buildings exist in their non-conforming location and
the applicant is proposing to add an addition on top ora 39 ft. x 48 ft. section of the existing structure to create a
new cold room (38 ft. x 48 ft. x 28 ft.) for their business operation within the existing footprint, and a small
12'X14' (approx.) addition.
3. Town Law §267-b(3}(b}¢3). The variance granted herein is mathematically substantial, representing 19.2%
relief from the code. However, the area of the proposed construction is on the rear of the building.
4. Town Law l~267-b{3}(bl(4} No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law §267-b(3)(bl(5}. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of pumhase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an improved business building while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member
Schneider, and duly carried, to
GRANT, the variance as applied for, and shown on the site plan dated June 12, 2012, revised 12/14/12
prepared by Robert 1. Brown, RA.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department of a building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited
above, such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code, This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.
The Board reserves the right to substitute a similar de~'ign that is de minirnis in nature Jbr an alteration that does not increase the degree of
nonconformity.

The Planning Board received your request for comments regarding the above referenced
application to demo and reconstruct part of an existing commercial building. The proposed plan
is to remove existing wood structures attached to an existing building to construct a down slope
loading dock in connection to a beer production use on a 2.8 acre property in the General
Business "B' zoning district.
The application has been reviewed for site development and the Planning Board has no objection
to the requested area variance on the basis that the building is existing, not expanding its
footprint and appropriate for the overall use of the site and building. Furthermore, the proposed
construction would appear to be screened by the existing buildings and accessible by large
vehicles from Peconic Lane.

Good Morning Ladies & Gentlemen of the Board:
My name is Richard Vandenburgh and I am a resident of Southold Town. I have been a
resident of Southold for more than 20 years and have been actively engaged in our community in
many forms. I have been a partner in a local law firm for many years and have even appeared
before this board on occasion over the past 20 years representing a client or two. I have been an
active leader in the Cub Scouts and Boy Scouts of America in Southold Town. I am an active
member of the Greenport Business Development Board and have also served as President of The
Reydon Shores Property Owners Association for multiple terms. I have two children in Southold
Public Schools and have been married to my wife Ann for more than 20 years and who works for
the Hampton Jimey in Grcenport.
I stand before you today, not as an attorney representing a client's interest, but rather as an
individual and small business owner who has been attempting to pursue his passion by developing a
small but growing brewery business on the North Fork.
For those of you who may not be familiar with our business, my partner and best friend of
more than 30 years, John Liegey and I own Grcenport Harbor Brewery located in Greenport, next to
the Old Jail on Carpenter Street. n
John and I became best fi'lends in college and have enjoyed a life long passion for making
and enjoying well crafted and balanced ales and dreamed of opening our own brewery one day.
When the oppommity arose in 2008 to purchase the small, abandoned fire house on Carpenter
Street in Greenport, John and I jumped at the chance. We then worked on every available weekend
and holiday vacation to renovate the building with our own hands. John and I both have young
families and very understanding wives.
After purchasing the building, we scraped together enough of our own savings and borrowed
some money from family members in order to purchase a small brewing system that we have used
at Greenport for the past three and a half years. This system allows us to brew 465 gallons of beer
at a time. We first hired DJ Swanson as our head brewer in April 2009 and officially opened on
July 12, 2009. We have been lucky to receive high marks for our beer and have brewed more than
30 different styles since opening. We started distributing kegs of our beer to local restaurants and
pubs in the Greenport and Southold area from the back of my wife's car. At present, we only
produce draft beer and have not been able to offer any bottling due to our current space limitations.
After opening in 2009, word got out and made its way to beer lovers and enthusiasts from
Montauk to NYC. We were lucky enough to join forces with the well respected craft beer
distributor, Union Beer Company, who began distributing our locally made beer across the island to
NYC and upstate.
We received distinction for our well balanced and interesting styles in various publications
from the Wall Street Journal to Time Out New York Magazine. Our tasting room at the brewery in
Greenport became one of the favorite stops that people made when visiting Greenport in order to
see the brewing process and taste the beers. Our fan base grew and fi4ends and customers would
stop by regularly to fill their growlers at the brewery and enjoy a sampling of the various styles on
tap.
Our ability to make the beer continued to exceed our expectations and we hired another
Brewer, Crreg Doroski, and Sales Manager, Justin Wesnofske, both of local families here in
Southold.
Space in Greenport was getting really fight and we were close to reaching maximum
capacity at the end of 2010. So we made some short term physical changes at the brewery in order
to try and keep up with the growth of our small local business, but we realized that we would have
to look for additional space into which we could expand. We wanted to keep our business on the
North Fork and even though we realized that it would be much easier and overall less costly to
move our operations to an industrial park in Western Suffolk or Nassau County, we believed
strongly in keeping our production and brewing operations local and on the North Fork.
Finding the former Lucas auto dealership location at 42155 Route 25 in Peconic
appeared to be an ideal solution. As we maxed out our production capacity in Greenport at
the end of 2012, we envisioned renovating the Peconic location to support our growth and
move into bottling our beer. It was important to us to not only enhance the visual appearance
of the property, but to also create an efficient and sustainable process that will support our
growing business. To that end we determined it would be necessary to construct a new cold
room on the property to house our beer. Based on the interior dimensions, costs of renovation
and existing footprint, we are seeking to locate this building on the same footprint of a prior
structure.
John and I believe strongly in the positive impact this development will have for the East
End. It will provide more opportunities for sustainable jobs in the area, incorporate sustainable
practices and promote a level of ecological harmony in a manufacturing setting. We are looking to
incorporate environmentally sensitive technology and practices such as solar, rain water collection,
composting practices, effluent recapture techniques and passive heating and cooling innovations
that will really reflect the GREEN in Greenport Harbor Brewing.
Both John and I are extremely proud of the Crreenport Harbor brand and are as involved in
the hands on development of this parcel and our business as one could be. I personally have spent
and will spend many days at the site with my tool belt on and shovel in hand working to make this
property as aesthetically pleasing and acceptable to all our local neighbors as possible. We hope
that they and all of Southold Town will be proud to call Southold the home to some of the finest,
locally made craft beer on Long Island. It is with that serious objective and responsibility in mind
and never forgetting our humble beginnings that has helped us build long lasting and very friendly
relationships with all our neighbors in Greenport and beyond.
It is with that perspective that we ask that this board to consider and approve our application.
