ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Cutchogue, in the Town of Southold, County of Suffolk, and State of New York, bounded
and described as follows:
BEGINNING at a cement monument located on the southwesterly side of a road known as New Suffolk
Avenue, at a point formed by the dividing line between the westerly line of the land formerly of Annie S.
Walker and the easterly line of the land now or late of Frederick S. Taggart;
RUNNING THENCE in a straight line part of the distance, along said dividing line and through a cement
monument South 14 degrees 7 minutes East 345 feet;
THENCE South 75 degrees 53 minutes West and at right angles to the last course, 303 feet to another iron
pipe from another angle in the line of the land formerly of Adrian c. McCall, now deceased;
THENCE South 14 degrees 07 minutes East along the land formerly of Adrian C. NcC. all, now deceased, a
distance of 266.80 feet to the center of a locust tree',
THENCE South 38 degrees 13 minutes East 136 feet to an iron pipe and an oak tree to a point in the high
water mark in Peconic Bay;
THENCE westerly and northerly along the westerly and northerly side of Down's Creek to a chisel mark on the
sea wall on the highwater mark of Down's Creek Channel, which chisel mark is on the dividing line of the
property hereby conveyed and the property formerly conveyed to Adrian C. NcC. all and Harjorie H. McCall, his
'I~NCE northwesterly, along said dividing line between the land hereby conveyed and the land of Adrian C.
P1L-~Call and Harjode H. HcCall, 131.6 feet to a cement monument;
THENCE northwesterly still along said dividing line North 14 degrees 07 minutes West 283.50 feet to a cement
monument on the southwesterly side of New Suffolk Avenue; and
THENCE northwesterly, along the southwesterly side of New Suffolk Avenue, 100.42 feet to the cement
monument at the point of BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part hereto of, in and to the land under
water in the bed of Down's Creek Channel, in front of and adjoining the premises described.
BEING AND INTENTED TO BE the same premises conveyed to the party of the first part by Deed recorded in
the office of the Clerk of the County of Suffolk on in Liber 10868 Page 060.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the par[y of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
