WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00) and other
varuable consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, lying and being
at Cutchogue, Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at the intersection of the southerly line of School House Road and the westerty line of
No~h Street; RUNNING THENCE along the westerly side of North Street, South 40 degrees t3' 10"
East 503.40 feet to land now or formedy Case; RUNNING THENCE along lands now or formerly of
Case and Baxter, South 52 degrees 53' 50" West, 201.66 feet; RUNNING THENCE along said land
now or formerly of Baxter, North 40 degrees 15' 20" West, 492.43 feet to the southerly line of
School House Road; THENCE along said southeHy line of School House Road, North 49 degrees
46' 50" East, 201.66 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the. same premises conveyed to the party of the first part by deed
dated 5/2911985, recorded 616/1985 in Liber 9805, Page 194.
This conveyance is made in the ordinary course of business of the party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center tines thereof,
TOGETHER with the appurtenances and ail the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever·
AND the party of tho first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as ~foresaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the .right to receive such
consideration as a trust fund to be applied flint for the purpose of paying the cost of the improvement and
will apply the same flint to the payment of the cost of the improvement before usin~ any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read "parties" w'nenever
the sense of this indenture so requires.
