RESOLUTION- OTHER: WHEREAS, the Town Code of the Town of Southold, pursuant to § 275-5 (C) reads as follows: "The Trustees may issue a temporary emergency permit where specific exigent circumstances exist that may result in personal or property loss or damage. Upon expiration of temporary permit or before the date of expiration, the applicant must apply for a permit as set forth in §§ 275-5, 275-6, 275-7; and WHEREAS, the Board of Trustees issued permits between 1990-1995 for storm related emergency work, recognized as "emergency permits" and those permits were, by definition, temporary in nature; and WHEREAS, due to Superstorm Sandy, exigent circumstances exist that may result in personal or property loss or damage to some applicants before this Board; and WHEREAS, applications to repair or rebuild structures described in permits issued between 1990-1995 recognized as "emergency permits" would be required to apply for a permit pursuant to §§ 275-5, 275-6, 275-7 and include the requisite Local Waterfront Revitalization Program (LWRP) review, Conservation Advisory Council (CAC) review, notices, and stamped plans and public hearing; and WHEREAS, the Board of Trustees recognizes the need for expedited review of applications to repair or rebuild due to Superstorm Sandy; and NOW THEREFORE BE IT, RESOLVED that the Board of Trustees hereby finds that permits issued between 1990- 1995 as "emergency permits" shall have full force and effect of a wetlands permit issued pursuant to §§ 275-5 (A), 275-5 (B), 275-6, 275-6 of the Town Code. ROBERT O'BRIEN requests a Wetland Permit and a Coastal Erosion Permit to construct 143 linear feet of new navy-style vinyl sheet piling bulkhead immediately in front of the existing Hurricane Sandy storm damaged wood sheathing bulkhead, 6"x6" horizontal whalers and pilings; removal of a section of the west jetty needed to accommodate the installation of new vinyl sheathing; removal of existing 22 linear feet of wood bulkhead return at west property line; installation of 22' of a new navy-style vinyl sheet piling bulkhead return; the lower beach stair is to be removed and reinstalled after the new bulkhead is constructed; the portion of the upper wood plank terraced stair removed for installation of the tiebacks and deadmen will be reconstructed in-kind; the damaged lower rubble stone wall will be reconstructed to the same height and length that existed prior to the storm; re-vegetation of the disturbed slope areas will consist of rosa Virginia, rosa rugosa or equal planted at four to five foot on center; the level four- foot ground area between the top of the bulkhead and base of the lower rubble stone wall will have filter fabric installed, ballasted with a blend of 1" to 6" beach stones.
