JAMES S. SCHADE, residing at 365 Mockingbird Lane, Southold, New York 11971 and DEBORAH J.
SCHADE, residing at 455 Main Street, Greenport, New York 11944, party of the first part, and
G. PALMER SCHADE, residing at 1385 Calves Neck Road, Southold, New York 11971, party of the
second part,
WITNESSETH, that the party of the first part, in consideration of TEN .....................................

release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
All that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York known
and designated as Lot 52 on a certain map entitled "Map of Highpoint Meadows, Section 3" and
filed in the Office of the Clerk of the County of Suffolk on March 19, 1990 as Map Number 8912,
more particularly bounded and described as follows:
BEGINNING at a point on the Northeasterly side of Mockingbird Lane where the same is
intersected by the division line between Lots 52 and 53 on the aforesaid map; said point or place
of beginning being also distant the following two courses, curves and distances from the
Southeasterly end of a curve having a radius of 40.00 feet a length of 62.83 feet said curve
connecting the Easterly side of Tuthill Road Extension with the Northwesterly side of Mockingbird
Lane.
1) North 55 degrees 56 minutes 20 seconds East 145.00 feet;
2)
Northeasterly, Easterly and Southeasterly along the Northwesterly, Northerly and
Northeasterly sides of Mockingbird Lane along the arc of a curve bearing to the right
having a radius of 230.00 feet a distance of 230.82 feet to the true point or place of
beginning;
RUNNING THENCE from said point or place of beginning along the division line between Lots 52
and 53 North 23 degrees 26 minutes 20 Seconds East 275.40 feet;
THENCE North 88 degrees 56 minutes 32 seconds East 127.09 feet;
THENCE South 23 degrees 29 minutes 07 seconds East 75.00 feet to the division line between
Lots 51 and 52;
THENCE along said last mentioned division line South 39 degrees 17 minutes 20 seconds West
270.75 feet to the Northerly side of Mockingbird Lane;
THENCE along the Northerly and Northeasterly side of Mockingbird Lane the following three
courses, curves and distances;
1)
Westerly along the arc of a curve bearing to the left having a radius of 60.00 feet a
distance of 54.71 feet;
2)
Westerly and Northwesterly along the arc of a curve bearing to the right having a radius of
40.00 feet a distance of 28.49 feet;
3)
Northwesterly along the arc of a curve bearing to the left having a radius of 230.00
feet a distance of 17.71 feet to the division line between Lots 52 and 53 at the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 2126196, recorded in Liber 11766 page 539 in the office of the Suffolk County Clerk.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center [ines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of this indenture so requires.
