The Committee discussed two main concerns brought up by the applicant in regard to draft easement
language. The first pertained to the applicant's request for particular wording pertainin9 to NYS
Agricultural and Markets protection, and the second pertained to requirements within the easement
for Land Preservation Committee review. The Committee clarified its position and drafted a letter to
send to applicant regardin9 these two items.
SCTM #1000-120-3-2 & 11.8 (DiVELLO)
Review applicant's request pertaining to excluded areas.
The initial review of the PDR application at the January $, 2012 LPC meeting included review of the
proposed excluded/Reserve Areas. At that time, the Committee discussed restrictions which would
prohibit the excluded/Reserved Areas from being subdivided from the easement areas. The
restriction was discussed with the applicant and the applicant request further review of the proposed
restriction. The Committee reviewed its decision and decided to revise the restriction to allow for
subdivision of the excluded/Reserve Areas from the easement area so Ion9 as any resultin9
easement area is merged with another easement area so that it contains at least 10 acres of
preserved land and the resultin9 easement area is permanently attached to an area of land
containing at least 2 acres with all building rights intact. The 2 acre area must be restricted from ever
being subdivided from the merged easement area.
