BETWEEN JOAN BARTOSIEWICZ, individually and as Executrix of the Last Will
and Testament of ALFRED J. BARTOSIEWICZ a/k/a ALPHONSE J.
BARTOSIEWICZ, late of 56 Russell Street, Brooklyn, New York, deceased, (Kings
County Surrogate Court File No. 5563/95) party of the first part, and
JOHN BARTOSIEWICZ and FRANCES BARTOSIEWICZ, Husband and Wife,
residing at 56 Russell Street, Brooklyn, New York, party of the second part,
WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by
said Last Will and Testament, and in consideration of One Hundred Thirty Thousand
($130,000.) Dollars paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and Improvements thereon erected,
situate, lying and being North of the Village of Southold, in the Town of Southold,
county of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point in the Northerly line of Soundview Avenue distant 250 feet
Easterly when measured along said line of Soundview Avenue from a monument
set therein, intersected by the Easterly line of land formerly of Richard C. Addy, now
the Westerly line of Charnews, and from said point of beginning;

BEING and intending to be the same premises conveyed to ALFRED J.
BARTOSIEWICZ and JOAN BARTOSIEWICZ, as Tenants in Common by deed from
ALFRED J. BARTOSIEWICZ and JOAN BARTOSIEWICZ, his wife, dated December
14, 1994 and recorded in the Office of the Clerk of Suffolk County on February 6,
1995 at Liber 11713, Page 500:

anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement
and will apply the same first to the payment of the cost of the improvement before using any part of the
total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this Indenture so
requires.
