hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
All those certain plots, pieces or parcels of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE Block 17 - Lot 4A, Block 17- Lot 4B and Block 17 - Lot 4G, all as shown on the
Map of Fishers Island Development Corporation, which said Map was filed in the Office of the Suffolk County Clerk
on September 25, 1991 as Map No. A421, said Block 17 - Lot 4A being the first described parcel and the same
premises described in the deed to the party of the first pad and Adhur H. A. Kuypers, dated November 30, 2005
and recorded in the Office of the Suffolk County Clerk on December 12, 2005 in Libor 12424 page 774, and said
Block 17 - Lot 4B and Block 17 - Lot 4G being the same premises described as Parcel A and Parcel B,
respectively, in the deed to the party of the first part and the said Arthur H. A. Kuypers, dated November 30, 2005
and recorded in the Office of the Suffolk County Clerk on December 14, 2005 in Libor 12425 page 497, the party
of the first part and the said Arthur H. A. Kuypers having originally acquired said Block 17 - Lot 4B and Block 17 -
Lot 4G by deed recorded in the Office of the Suffolk County Clerk on March 16, 1996 in Libor 11766 page 262, and
the party of the first part having acquired the undivided one-half (~) interest of the said Arthur H A. Kuypers by
deed of even date herewith intended to be recorded in the Office of the Suffolk County Clerk immediately prior to
the recording of this deed.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETH ER with the appurtenances and all the
estate and rig hts of the party of the first part in and to said premises; TO HAVE AN D TO H OLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second pad
forever,
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the rig ht to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

BEGINNING at a point in the Southeasterly line of a Private Road, said point being
located at the Northerly corner of the herein described tract and also located 1630.41
feet West of a point which is 274.20 feet North of a monument marking the United
States Coast and Geodetic Survey Triangulation Station "Chocomount 2" and thence
running South 46" 45' 00" East 228.21 feet to a point; thence South 63" 55' 30" East
171.23 feet to a point; thence South 18" 44' 50" West 168.17 feet to a point in the
Northerly line of another Private Road, said point being at a point of curve to the left
having a radius of 706.21 feet and the direction of whose radius at that point is South
02° 02' 54" East; thence Southwestwardly, along said road line and following the arc
of said curve 144.68 feet to a point; thence South 76" 12' 50" West 40.41 feet along

"Chocomount 2" (which said "Chocomount 2" monument is located on the summit of
the highest hill on Fishers Island, N.Y. about two and one quarter miles west of the

for the benefit of the premises described as Block 17 - Lot 4G (hereinafter "Lot 4G"),
for purposes of ingress and egress to and from Lot 4G and the private road adjoining
Lot 4G on the east and southeast, said easement being 16 feet in width and located
premises known and designated as Block 17 - Lot 4H, Map of Fishers Island
Development Corporation (Map No. A421 filed September 25, 1991) (hereinafter "Lot
4H"), and said easement having southeasterly, northeasterly and northerly limits that
are more particularly described as follows:
BEGINNING at a point at the northerly end of a road forty feet wide, said point being
located South 68 degrees 56 minutes 20 seconds East, 20.00 feet from a monument
located at the northeasterly corner of Lot 4G, said monument also being 184.98 feet
North of a point which is 884.39 feet West of another monument marking the U.S.
Coast and Geodetic Survey Triangulation Station "Chocomount 2"; and
RUNNING THENCE North 21 degrees 46 minutes 40 seconds East, 32.19 feet to a
point of curve to the left having a radius of 131.31 feet and the direction of whose
radius at that point is North 85 degrees 54 minutes 07 seconds West;
THENCE northerly and northwesterly, following the arc of said curve, 263.70 feet to a
point on the last course described in the above description of Lot 4G, which point is
located South 45 degrees $6 minutes 20 seconds East, 71.23 feet from the point at
which such last course begins.
SUBJECT TO the right of the party of the first part or any future owner of Lot 4H to
terminate the aforesaid easement by filing an instrument to such effect in the Office of
the Suffolk County Clerk; provided, however, that prior to so terminating such
easement, the party of the first part or such future owner of Lot 4H shall provide funds
to the party of the second I~art or the then current owner of Lot 4G in an amount
sufficient to pay for the construction of a new driveway of comparable quality and width
to the existing driveway wh ich now serves Lot 4G and is located in the above-described
easement area as of the date hereof. At the option of the party of the first part or such
future owner of Lot 4H, the proposed new driveway may be located wholly on Lot 4G
or partially on Lot 4G and partially on Lot 4H and, if it is located partially on Lot 4H, the
party of the first pad or such future owner of Lot 4H shall grant to the party of the
second part or the then current owner of Lot 4G an easement similar to the one set
forth herein over that portion of Lot 4H on which the proposed new driveway is to be
located.
