Thank you. I am going to take comment on the agenda items in a second. I just want to acknowledge, first we have Legislator for the First Legislative district, Albert Krupski in the audience tonight. And I also want to say, the last few days have been very long, we like to space our state of emergencies at least a year apart, we haven't been so lucky. Peter Harris, our Highway Superintendent, this year, Peter, I can't say enough about you, your men, all the people that work for your department and the Department of Public Works. When you read about what has been taking place in other towns, you are on top of it, you did an outstanding job. Thank you for all that hard work. I would invite anybody that would like to comment on any of the agenda items to please feel free to do so now? On the agenda? Anything on the agenda? Sure, by all means Marie. Marie Domenici MARIE DOMENICI: Made Domenici, Mattituck. At the work session, you guys were talking about cell phone towers and I guess we are going to be installing one rather close and during the discussion I didn't hear anyone talk about fall zones or drop zones. And nor did I hear any discussion about the proximity to this building, how far it would be from here. SUPERVISOR RUSSELL: That would all be subject to the current town code, if there are standards already built into the code, if they are seeking relief from those standards they would not need to go to the Zoning Board of Appeals. I can't speak to, I don't, I remember drafting a legislation a bunch of years ago, I don't remember exactly what those setback issues are. But all that would have to be, in other words, just because it is being located on town property would not exclude it from the site plans process. It would still have to go through the permitting like any other application. MS. DOMENICI: Because if you look at the cell tower that is adjacent to the police department, I mean it is adjacent to the building and technically if you have any belief system in the health hazards of being that close to electromagnetic fields because that does have reason for concem February 12, 2013 Page 4 Southold Town Board Meeting Minutes because it does have health issues associated with it, so the concerns that I would have would be for the building, the people who work in this building, that would be all of you. That you would have exposure to the emf and it is like (inaudible) either you believe in emf or you don't, but emf is real and it does cause various types of illnesses including leukemia and cancer and things of that nature. So what I would caution you in considering you know, where you would be putting it, you should really take that into consideration. And the other thing is, I noticed with cell towers is they don't have the same kind of regulations associated with them as we do for wind towers. Wind towers have fall zones and things of that nature. And they are less impacting in the negative way but there is a cell tower over in Mattituck on Penny Lumber's property and it looks like a flagpole if you will but it is really close to 48, it has no fall zone. So I think there's, it is like an oxymoron where you are worried about whether a windmill would fall on you versus a cell tower. SUPERVISOR RUSSELL: Okay, there are two very fundamental differences. Cell towers are regulated by the FCC. We are limited to what types of restrictions we can legislate because we are preempted by federal law. Wind turbines have no such preemption. We are not, you know, they are not regulated by a federal agency and we try to promote wind technology where we can. We just don't have that, unfortunately, level of scrutiny. And I will give you a good example, I wanted to pass legislation that would require cell tower installers to have back up generators that would be more than just a few hours that we are getting now with the battery back up. Generators, because of emergency management preparedness. The problem is, I can't really legislate that because the FCC oversees that. it is preempted by federal law, so all those setbacks, fall zones, all those issues a lot of that gets dictated by the federal agencies. MS. DOMENICI: Well, the same thing with flagpoles. I mean, if you walk into any post office, the flagpole is right there. There is no real fall zone if you will, so it is kind of makes me think that there should be some type of consistency when you are talking about tall towers and the possibility of them falling. Would they fall? Perhaps not. But I think the guidelines should be kind of consistent with that. So again, and I am only saying this for you guys, I mean, you know, if that cell tower is going to be right you know, within an arms length of this building, you will have the exposure to the emf and you are going to have the potential of you know, god forbid if it falls, you know, does it have an impact on the people who work in this building. So that is the only reason why I am bringing this up. How many cell towers do we currently have in the Town ofSouthold? I thought we were up over 14 or 167 SUPERVISOR RUSSELL: I don't, not being an assessor anymore I don't stay on top of the inventory but at last count it was at least 14. let me just also point out that they are permitted in the industrial zones, so if that cell tower wasn't located on town property, they can just go 50 feet across the street to a property and locate it on private property and I don't think the electromagnetic field impact would be diminished at all by the 100 feet, moving it 100 feet north. MS. DOMENICI: That is true. SUPERVISOR RUSSELL: One of the benefits of locating it on town property is we are going to have the site obligations of having cell towers, at least the public gets the benefit because any February 12, 2013 Page 5 Southold Town Board Meeting Minutes revenue derived from that would be used to offset the taxes, so at least there is a broader public benefit to locating them on town sites, town properties. MS. DOMENICI: Absolutely. Right. SUPERVISOR RUSSELL: Rather than private companies. MS. DOMENICI: Okay. Thank you for your time and I have other things I will talk about after the meeting. BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Purpose. The purpose of these Amendments is to protect the health, safety and wellbeing of residents using Town recreational areas by enacting regulations pertaining to dogs and other domestic animals on Town-owned recreational areas, beaches, children's play areas, picnic areas and athletic fields. II. Chapter 193 of the Code of the Town of Southold is hereby amended as follows: §193-3.1. Regulations concerning dogs or domestic animals. A. Prohibition. No person shall bring a dog or other domestic animal onto: 1. recreation areas, picnic areas, children's play areas and/or athletic fields that are posted with signage indicating "No Dogs or Domestic Animals Allowed" or "Dogs or Domestic Animals Prohibited"; 2. bathing beaches during such times that a lifeguard is on duty; 3. an area that is within 50 feet of any recreation area that is posted for protection of piping plovers and other endangered species. Dogs or other domestic animals are permitted on all other recreational areas unless specifically prohibited in §193-3 I(A), subject to the following: 1. All dogs or domestic animals shall be under immediate supervision and control of the owner or other responsible person (the owner or responsible person has the ability to leash the dog or other animal immediately). 2. All dogs or domestic animals brought onto children's play areas, picnic areas or athletic fields shall be leashed at all times. All dog or domestic animal waste shall be removed in accordance with §83- 28(B). The Superintendent may, in his or her discretion, promulgate additional rules and regulations as necessary. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law. It is the intent and purpose of this law to allow retail sales areas within bonafide Light Industrial Park uses and Light Industrial uses to further the viability and stability of such uses in the Town of Southold if certain requirements are met. It is also the intent of this law to preserve property values and the health, safety and welfare of the community. II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows: ARTICLE XIV Light Industrial Park/Planned Office Park (LIt) District §280-58. Use regulations. B. Uses permitted by special exception of the Board of Appeals. The following uses are permitted as a special exception by the Board of Appeals as hereinafter provided, subject to site plan approval by the Planning Board: (9) Retail sale of items manufactured, assembled, processed and produced on site, subiect to the following conditions: (a)The premises is located within a designated Hamlet Locus (HALO) zone; (b) Retail floor area shall be no more than 15% of the gross floor area of the building, including all areas having public access, not to exceed 2,000 square feet. (c) Adequate on-site parking must be available for the retail sales area as determined by the Planning Board and as set forth in §280-78; (d)Resale of items produced off site is prohibited; February 12, 2013 Page 10 Southold Town Board Meeting Minutes (e) Should a site contain multiple L10 uses, such uses may utilize a single retail sales area. In such instances, the single retail floor area shall be no more than 15% of the total combined gross floor area of all such uses, including all areas having public access (not to exceed 2,000 square feet). Outdoor storage and display of retail items is prohibited. ARTICLE XV Light Industrial (LI) District §280-62. Use regulations. B. Uses permitted by special exception of the Board of Appeals. Speaking on behalf of the Southold Town Democratic Committee, I would like to formally object to the screening process that took place in the selection of Al Kmpski's vacant seat. I believe it was unfair certainly to, I know a lot of our people in the Democratic party, I can't speak for other parties but certainly it was unfair for asking our people to be screened by the leader of the Republican party and that screening February 12, 2013 Page 41 Southold Town Board Meeting Minutes committee. We felt that the decision should have rested with the Town Board, I know ultimately it did but we would have preferred to see the vetting process take place by perhaps a committee on the Town Board and it is our hope that should a vacancy occur again that that process would be followed. That is, the Town Board do the screening and the vetting. Quite honestly, a lot of our people, we knew the seat was open, to go before the Republican screening committee at Republican headquarters in Cutchogue, we just felt like we were being, playing with a stacked deck. And that is all I have to say. SUPERVISOR RUSSELL: Are you unhappy with the result? MR. TILLMAN: I have always liked Jimmy but we don't politically think alike. But he is a good guy. The fact is that politically parties are part of the process, that is the reality, you know it, you are a chairman. They have input in decision making. Do they guide the decisions, to they dictate the decision making? No. at the end of the day, we picked someone who is not a Republican. In fact, he is someone that your party has supported time and time again. You appointed him to the Zoning Board of Appeals in 2004. you appointed him, as chairman of that Zoning Board in 2007. He is an independent thinker, he has knowledge of the code, he is a fiscal conservative, he also, most importantly to many of us, represents the easterly portion of this town. Right now, when you look at this dais, particularly when Albert was sitting here, it looked the Mattituck High School alumni association. It is nice to see someone from the easterly section of town. The voices of that community being heard. Excluding Martin, 1 am sorry. MR. T1LLMAN: It is not Jimmy per se. And I understand the geographical balance you are trying to reach. It is the process that we object to. COUNCILMAN TALBOT: Art, I would disagree with you on that. If the seat was or this Board was nominated by the Democratic party and a seat was up and I was told I had to go and screen as a Republican in front of the Democrats, I would had to take issue with that as well. MR. TILLMAN: That is all we are saying. COUNCILMAN TALBOT: Inaudible. MR. TILLMAN: I mean, the results probably would have been the same anyway but it is the process. SUPERVISOR RUSSELL: As a reality, we have to know that we are going to appoint someone that at the very least has a 50/50 shot at being able to get a nomination just in June. The nominating convention is in June. It would seem to be a waste of people's time to, not, to appoint them and then have no hope of running. It doesn't, I think the result speaks for itself. February 12, 2013 Page 42 Southold Town Board Meeting Minutes We made two appointments tonight. None of them was a Republican. One of them is registered in the Democratic party and he is a Planning Board member from Fishers Island and one is a registered Conservative. We try to be independent and open minded as best we can. MR. TILLMAN: As I say, I am not objecting to who you appointed, I am objecting, we are objecting to the process. While people just don't feel comfortable, in this case, going to Judge Rudy Bruer's office or Republican headquarters being interviewed by the Republican screening committee and I think you could understand if the shoe was on the foot of a foot, as Chris said, anybody would feel that way and I just think if we think that in the future for our vacancies we prefer to have it handled by the Town Board. SUPERVISOR RUSSELL: It was handled by the Town Board. At the end of the day... MR. TILLMAN: Ultimately, yes, of course you made the decision. But, we won't belabor the point. COUNCILMAN TALBOT: I would also add to that that I didn't get one call or email or anything, someone come tap me on the shoulder and say they were interested. You know, you have 5 people up here that were going to vote on it. MR. TILLMAN: Right. In fact, I didn't know what the process even was going to be until I got a call from Tim Kelly and he said are you going to be screening and I said no, we just told anybody that may be interested to send their resumes to the Town Board. As it turns out, we did not have a lot but that is the way it went. I think maybe there should have been some sort of notice in the newspaper somehow to come here, which is, you know, once you are elected you are expected to act as statesmen for all of the people. As I said last week, we are both from minority parties. You have 39 percent of the registered voters, we have 26 percent of the voters. So whether we get elect somebody elect, whether we elect somebody or a Republican gets elected, you still represent all of the town and the fact of the matter is, there is an awful lot of independents and blanks out there and when they see this system conducted this way, I would guess they might see it like the Democrats see it because on face value it looks like you are playing with a stacked deck and it is kind of biased. I know you are looking for the best candidate. SUPERVISOR RUSSELL: If the Republican committee was the dominating influence here, I am not sure it would have been Mr. Dinizio's name that was read tonight. We had to do the best we could and the reason so many people are Independents in this town, let's face it, they are not registering in the Republican party or the Democratic party, they are registering as Independents. We went with someone that has been supported by both sides for so many years, who can certainly not be accused of being a Republican standard bearer. For all of the years I have known Jim, he has probably opposed as many Republicans as he has supported. I think in 2005, he supported the man that ran against me. I don't blame him, Bill Edwards is a good man. But the reality is we tried to find someone that was a voice for those independent thinkers. That is exactly why we arrived at Jim as a board, a board of six, a board of five, I am sorry. February 12, 2013 Page 43 Southold Town Board Meeting Minutes MR. TILLMAN: And it would have been nice if we could have seen how it worked with five (inaudible) but I guess that is not to be. Well, anyway, on behalf of my party I have said what I have to say and I would hope you would reconsider, if it happens again that it would not take place that way. Thank you. SUPERVISOR RUSSELL: Okay. Who else would like to address the Town Board on any issue? Marie? Marie Domenici MARIE DOMENICI: Marie Domenici, Mattituck. First of all, I would like to congratulate Mr. Ruland for being chosen for the Deputy Supervisor. COUNCILMAN RULAND: Thank you, ma'am. MS. DOMENICI: And Mr. Dinizio for his being chosen and also I would like to thank Pete Harris because his team always does a great job. My block is always clear. So I have nothing but good things to say. But now that Mr. Harris is here, can we talk about the puddle on Aldrich Lane? My favorite topic. Has there been any further discussion about fixing that puddle? COUNCILWOMAN DOHERTY: Last time you mentioned it I had a conversation with one of the park district members and he assured me that they were trying to work out that area, that it's a flooded area and a lot of the water is coming from the park district property onto the road and they didn't have a solution as of that conversation, what was that? A couple of months ago. I know Pete Harris can speak to it if he wants to but he has done what he could on the road, he can't take care of all the runoff from that property, they have to take care of the runoff on their own but I am sure financial you know, is the issue. But the park district has to do something with the water on their property. MS. DOMEN1CI: Thank you. I have spoken with the park district probably a year ago about this and it always came down to you know, we are not sure if it is us or the department of highway, so I mean, this is a minor detail, I mean, it is not like we are talking Sandy here. We are talking about a minor detail and I don't mean to make light of it but it has been there for 10 years, it is a park, West Nile virus is something that is, you know, can be easily, you know, kids and people at the park could be easily affected by that and I just think that that is a health issue and perhaps we should try to get some remediation whether working with the park district and I appreciate your intervention in finding out but we need to have a little more pressure from the people who have the can do and must do to make it happen. COUNCILMAN TALBOT: I think that you asked the question at the perfect time, being that Pete is here tonight. The highway superintendent, who is an elected official just like we are. He can come up and answer the question on his end of it. MS. DOMENICI: Okay, I appreciate hearing from that. One other thing, Orient spraying? SUPERVISOR RUSSELL: Yes, they actually scheduled three hearings. The first hearing on the 23rd l meant to go to, I got, unfortunately sidetracked with another issue that needed somewhat February 12, 2013 Page 44 Southold Town Board Meeting Minutes immediate attention. They have another heating scheduled. It is on my calendar to be there and I will raise the issue then. It is done through vector control, through the Suffolk County Department of Health. MS. DOMENICI: When will that take place? SUPERVISOR RUSSELL: It is on my calendar, you can check with Lauren tomorrow. She can tell you when the hearing is. MS. DOMENICI: Okay, thank you. And for the veterans, for the cold war veterans. Why are you limiting that to only cold war veterans? Why not veterans in general and is there an impact or cost to the community? SUPERVISOR RUSSELL: We are actually expanding the law. Actually, exemptions are what is called permissive legislation, we can only opt in at a local level by voting and we can only extend the exemption to those that are defined by the state law. In thins instance, all veteran era, combat veterans whether they served in a combat zone or they didn't serve in a combat zone, are entitled to exemptions. The cold war exemption were designed for veterans that served but who fell in between the dates of armed conflicts. Between Korea and Vietnam, Vietnam etc. All this did was increase the amount of benefit that those cold war veterans would get. It would more or less equalize them with what we would call non combat veterans. Veteran's who served during a period of war but not actually in a combat zone. MS. DOMENICI: Thank you. SUPERVISOR RUSSELL: It is not a lot of money, it is just something to say thank you for your years of service. MS. DOMENICI: And I support that. One other question, if the people of the community are obligated to recycle their garbage, you know putting cans and plastic and papers and all of that which I fully support, something has come to light about a corporation in town that doesn't recycle anything. And everything they do, Styrofoam, plastics, paper, doesn't matter. Just goes out to the bin and then it is carted away. Why is that allowed and I don't know if the town is even aware of it, I am just bringing it up but we as citizens have to recycle and I am all about recycling but this organization negates everything we do. Everyone in this room who recycles, this, one day of garbage from this organization negates everything that we do. Is there any monitoring of businesses and recycling or is that just something that is not .... SUPERVISOR RUSSELL: Businesses are required to recycle just like homeowners are. Is their recycling rates where we would like them to be, from the commercial segment? No. but they are getting better each and every year. We have expanded and we have tried to work with local carters to provide dumpsters for these, so they can cull out the paper, the cardboard and the other things. It is an ongoing process. We are in the process now because of all those issues that were somewhat well publicized with a carter in town, we are trying to reach out to the business community to get them more involved. We have asked the superintendent who runs the transfer February 12, 2013 Page 45 Southold Town Board Meeting Minutes station to reach out to develop this educational and informational program. We actually just put (inaudible) the renewable energy committee in touch with the local schools to create these informational programs to expand recycling. We can all do better. That commercial enterprise is probably not making the same effort others are. We can all do better but I still think, when you look at the larger picture, Southold's recycling rates are still among the best on Long Island. MS. DOMENICI: No, I think we do a good job but this one place, just... SUPERVISOR RUSSELL: I would doubt that refuse is coming to our facility then. It is probably being hauled out of town to a private transfer station. MS. DOMENICI: I don't think so. but I just wanted to ask the question because then we need more oversight because if they can produce enough garbage in a day that people in this room couldn't do in a month and that was my concern, like how is that allowed to happen? SUPERVISOR RUSSELL: Are you sure it is coming to the town transfer station. MS. DOMENICI: I will make a final phone call and I will let you know. SUPERVISOR RUSSELL: Many local carters will avail themselves of the private tipping facilities up west. We don't capture all the commercial garbage in Southold Town. Far from it actually. MS. DOMENICI: Okay. Well, thank you very much. COUNCILMAN RULAND: I would say to you, if I might? I would say to you that during the discussions of the issue that the Supervisor referred to where the Town of Southold is in fact involved in litigation with one carter that operates in the town, it is, and we had had only superficial discussion in the beginning about we needed to, that issue has to be resolved, it is in the courts, it is going to be resolved and it is certainly my intention and I know with the others that the key as I would see it, and in discussing it with a number of people, the key rests with the carters. And there is maybe some light at the end of the tunnel in that there aren't t hat many. And like so many things, once the issue that's before the courts is resolved, the next issue is commercial accounts. And that includes dumpsters and that includes the ever problem of that sometimes there are dumpsters at residential properties which aren't supposed to be. And the key always is the carter. But I do believe that being familiar with a number of institutions that are frustrated with their recycling because it is not always picked up when they say it is going to be picked up, they put it out, things happen, then they have to clean it up. And the carters have indicated in the past that this could be an expensive proposition if they had to retool in some way but if you look at it from a common sense point of view and the Supervisor had said many times before, all that you don't throw away as solid waste is taken away for free. And there is a, let's face it, there is money to be made in garbage and there are people who specialize in doing it. but there is no better way and we wrestled with this as a Board for the last many, many months, there is no better way to deal with it than we know of except at the source separation. Once you mix it with garbage, it is extremely difficult to separate it. so when you separate at the source and we February 12, 2013 Page 46 Southold Town Board Meeting Minutes have had this discussion, I don't want to belabor this but we have had this discussion recently at the youth board and the students and the schools are beginning to see that a recycling effort on their part, alright, can actually have a budgetary, a plus. Because again, the less you throw away, what you pay to have taken away, the less you have to spend doing that. and at the same time, those things that you cull out at the source can be recycled. And this is a whole area that I agree with you 100 percent, everybody can do better in that area. But again, I think the key is with the carters and I am not blaming the carters, but I think over time there are certain entities that generate a whole lot, that for instance you may see that they have separate cardboard recycling dumpsters because they generate a lot. And 1 think that as time goes on, as part of a perhaps 21st century business model, that that has to extend to more of the businesses, more of the restaurants, more of the heavy users, alright, which if you can point it out and they can understand that the less they throw in that one that has to be paid to be taken away, the less money they will spend to have it taken away, i.e. you don't have to have it picked up once a week or twice a week maybe only once a week or every other week because the other stuff can be recycled and it is culled out at the source. But we have seen, the Supervisor and I personally have seen when it is co-mingled with the solid waste, it is impossible. I don't care what people say, it is impossible. You would need an army of people and it is just not logistically feasible. I will say also that in Florida where one company basically dominates the waste, which is waste management, there are systems that you can put everything in one dumpster and when it comes out the other end at this facility, it is all separated and only the very, or it is extremely expensive. It is something that I am not sure that any company in our area is going to want to undertake. We had talked about regional approaches and we talked about the light at the end of the tunnel, you might have heard me say this once before, where in fact the light is actually the train and the train is telling you West Virginia, Pennsylvania, Ohio are not going to take your solid waste anymore. What are you going to do with it? and we all need to be thinking about that, especially business because it will have a negative impact on business. MS. DOMENICI: Well, if it, and I appreciate what you just said but if there is no accountability to these people who may not be doing as they are supposed to be doing and we obviously don't have the resources to go out and look in everybody's garbage and say these are the good guys and these are the bad guys but at the end of the day, that is a revenue generator for us because if we find people who are not diligent and not doing what is expected of them, we can, there is money to be made there in fines and I am saying huge fines because any time you want someone's attention, you either hit them up with money or give them money back and if you are hitting them up for money through penalties then maybe we will get more compliance. SUPERVISOR RUSSELL: Let me just point out, that anybody that throws garbage out, they pay a premium. Nobody gets to throw garbage out for free in Southold Town. Or if you go to a private transfer station. It is in their best fiscal interest to recycle because all of the recyclable material gets accepted for free. Everything that goes in that dumpster gets charged a premium to be thrown out. MS. DOMENICI: Okay. February 12, 2013 Page 47 Southold Town Board Meeting Minutes COUNCILMAN TALBOT: Marie, just quickly to finish up on that, I had stopped at the landfill today with the intention of talking to Jim Bunchuk down there. I brought up, the end of last year regarding the yellow bags, with the intention of possibly doing something different down at the landfill. Some of the stuff that Bill was talking about, this particular company that I had spoke to that proposed to build something down at the recycling center down there where they could get 75 to 80 percent recycling rate, we are at 43 percent, the best on Long Island which is a crying shame because you have got around the rest of the country, San Francisco does 80 percent recycling which for a city that large is fantastic. I read something today to the Board, it was about food waste and if you are able to separate food waste out of the thing it sends your recycling rates sky rocketing. So the intention is to head in a different direction with what we are doing, whether it be with the facility that we have there and the personnel that we have there, if we are not able to accomplish it with that, then maybe head in a different direction. But the 43 percent recycling in this area is a joke, truthfully. So what you are saying, there is a lot of education to be done. Benja always liked to talk about having a recycling coordinator, whether it be him, somebody else or just getting people out there talking about it. Bill is correct, after I had this conversation with the Board and with this particular company, people started coming up to me and talking about it and one kid who is a, I think he is 8th or 9th grade in school, his family brings one little yellow bag to the landfill a week because they recycle everything and he specifically goes through every little piece of plastic, cardboard, everything to separate and it is just, he feels guilty now if they don't, so it is, we can get to that rate and this year I hope to get it up to well over 50 to 75 percent, in that range at least. MS. DOMENICI: Thank you. Correct me if I am wrong, does the recycling center recycle Styrofoam? COUNCILMAN TALBOT: I do not know what they do with the Styrofoam. MS. DOMENICI: I was told that they don't, and the only thing that they would take is the peanuts because people come in, go the dump and say I am shipping something, let me use the peanuts but if you are talking about pieces of Styrofoam, we don't recycle that and that is something that stays in the environment for .... SUPERVISOR RUSSELL: We don't .... MS. DOMENICI: And I was told the reason why the town doesn't do it is because it is too expensive to do. SUPERVISOR RUSSELL: The problem with Styrofoam is that it takes up a lot of space on truck. The shipping is, there is just no market. There is no secondary market that sells Styrofoam. So to cull it from the waste stream at this point doesn't make fiscal sense. There is no secondary waste stream to absorb it. and we don't take the peanuts either, they get thrown out with the regular trash. MS. DOMENICI: Then why do we recycle if we are putting stuff that is going to stay in any landfill forever? February 12, 2013 Page 48 Southold Town Board Meeting Minutes SUPERVISOR RUSSELL: Because we cull out the things that do have a secondary market, that there is a buyer for. There are no buyers for Styrofoam, that is why it doesn't get culled out separately. There was a time that we used to separate it down there but we could find no market for it and what happened is, if we cull it out, what are we going to do with it? We have no place to take it. MS. DOMENICI: But the investment is in the environment. SUPERVISOR RUSSELL: But there is no secondary market. There is no place to take it to. That is why it gets thrown out with the municipal solid waste. COUNCILMAN TALBOT: It must go somewhere in this country, you know, there is not a whole landfill full of just Styrofoam. Hopefully with those things, we will bring them all to light this year. Get something going in the right direction. MS. DOMENICI: Okay. Thank you very much for your time. SUPERVISOR RUSSELL: Sure. Just before Art goes, is there anybody that hasn't talked yet, would anybody like to go? ! like to sort of have the policy of letting everyone speak once and then they can go again. Peter Harris, Superintendent of Highways PETER HARRIS, SUPERiNTENDENT OF HIGHWAYS: Peter Harris, Superintendent of Highways. Regarding Aldrich Lane, the drain, the fact that the reason why I haven't installed a new drainage system there is the fact that the park district property is unstable material and it drains out into the shoulder of the road so it is carrying the fines which will contaminate the drainage system, so if the parks department goes and either raises their property so that they retain their water and where it doesn't come out and contaminate the town system, then I don't have a problem putting a new drainage system in there but if you are going to leave it status quo and have a parking area that is basically washing out into our property and then contaminating the system over a course of years then the system is no longer going to function again and that is why we haven't had it done. So that answers that. COUNCILMAN RULAND: Excuse me, Pete. Would you be amiable to sit down with representatives .... MR. HARRIS: Absolutely. Absolutely. COUNCILMAN RULAND: Everybody in the same room, instead of the going back and forth. MR. HARRIS: Absolutely, Bill. COUNCILMAN RULAND: Okay. Okay. February 12, 2013 Page 49 Southold Town Board Meeting Minutes MR. HARRIS: I just wanted to thank you again, Scott for your kind words pertaining to storm Nemo, where the heck they come up with these names I don't know but Southold was very fortunate to have a very dedicated group of individuals that work for the town to put the time and the effort in that they did. Probably my single biggest challenge that I am going through right now is the multitude of phone calls, nasty phone calls, from residents, when are you coming to take that snow out of my driveway that you put in it? I mean, you know, and it sounds funny but it is not funny. These people are dead serious. You have got a four foot wall of snow across my driveway and I can't get out, we are not in the business to do people's driveways and the only thing I could suggest maybe was whether the, I don't know, hire manual laborers to go to elderly people's homes that they can't get out and shovel or contact the county sheriff to get people from the county jail to come out and work during the day cleaning out driveways but, I mean, I get beat up and I am just saying to myself, I am watching television and I am watching roads in Brookhaven and Islip and Smithtown and Huntington and people can't, you know, the road has a foot and a half of snow or two foot of snow and my roads are clear and I am getting beat up because the roads are clear because we put the snow and closed off the driveways. SUPERVISOR RUSSELL: Pete, do what I do. Give them Legislator Krupski's number. MR. HARRIS: I could give him Eddie Romaine's number but I don't think it would help them. But in all sincerity, I feel, I feel for them, and I have heard every single excuse why I need to get there to clean their driveways out but realistically, I can't. I try to tell them, not for nothing, the first time that if I were to go there and go to clean your driveway and I break something or destroy something, you are going to want to sue the town because you came in on my property and caused damage. It is just a fact of life that, you know, I didn't ask for this size storm so we all have to deal with it but it's you know, and I try to be as polite as I can as they are yelling at me or my secretary's or whoever happens to be the lucky one to answer the phone. But it's, you know, like I said after going through the storm and coming through and everything, to get the roads back open in a fashion, I mean, right now I have a crew of guys up in Mattituck doing the village to clear the snow off the sidewalks in the surrounding areas there in the business district in the town portion of the town. You know, we are trying to get it quick back to normalcy as possible but like I said, my biggest part of the day right now, the last two days is probably fielding 50 or 60 phone calls of people wanting the town to come and clean the driveways out. And like I said, as much as I understand where they are coming from, that they may not physically be able to do it, [ just can't, so I don't know, it is the first time, this is the first time since I have been in office in 11 plus years of being in office, the first time I ever had anybody complain to come clean driveways out. And so, I just hope anybody that is watching, it is not that we don't have compassion for you, we do but I just can't do it. Thank you. Legislator Albert Krupski, Jr. ALBERT KRUPSKI: Good evening. I just first want to thank Pete Harris because he and his crew did such a good job. By the time I got out on the road, it was Sunday and I was amazed to see because I was watching the news to see what was going on, I was amazed to see, Pete, how good the roads were. It was really a job well done, thank you. congratulations to Councilman Ruland. Very good, very well deserved. I am not surprised, the supervisor has confidence in. COUNCILMAN RULAND: Thank you. February 12, 2013 Page 50 Southold Town Board Meeting Minutes MR. KRUPSKI: Congratulations to Jim Dinizio. You guys, I am sure it was a difficult, well thought out choice. Jim, my only advice to you is good luck, this is a very good Board to work with. You know, you can talk to everybody, you can agree, you can disagree, you can have a vote and you can move on and get a lot of work done. And as you see tonight, how they operate, you will have a lot of success there. And I know I haven't been here in a month but I am happy to see that the Goldsmiths inlet revetment is still on the agenda. SUPERVISOR RUSSELL: Would anybody else like to speak? Art? Art Tillman MR. TILLMAN: Yes. A couple of things, regarding the cold war veterans reduction, I happen to fall into that. do we have to resubmit paperwork again or it's just taken care or'?. SUPERVISOR RUSSELL: No, you should check with the Assessor's tomorrow but I am quite certain it is an automatic adjustment on the tax roll. MR. TILLMAN: Okay. Secondly, I have a small part time job and I sell natural gas, if any of you may not know, the industry has been deregulated now and so I go around to greenhouses and different places and try to sell gas, I go to the biggest users. And there is a situation here that is really putting the greenhouses and eastern Long Island at a serious economic disadvantage. Eastern Long Island hospital and I know of at least two greenhouses, possibly three, who would love to get natural gas. In the case of the two greenhouses, one is literally I would say 100 yards from the line on Route 48, the other one is maybe a quarter of a mile, those growers that do not have natural gas are forced to use fuel oil and they are put at a serious disadvantage with other growers. And the same with Eastern Long Island hospital. It would save them hundreds of thousands of dollars, literally I think, if they could get natural gas. My question is this, ifI recall about 20-25 years ago, Cablevision refused to run their cable down roads that did not have enough houses. It just wasn't economically feasible. And if I recall correctly, the Town Board said at that time, that if you want to service our town, that is Cablevision, you must provide cable to everybody. And they did. And neighbors of mine that never had cable all of a sudden got cable, based upon that Town Board decision. My question is, since National Grid has been unwilling to date to extend gas lines to some very big users, would it be possible for the Town Board to make the same type of decision and say to National Grid if you want to sell gas in our town, they you have to supply all of our greenhouses, all of our people. I spoke to Patty Acampora, who as you probably know is on the public service commission, and the public service commission is totally behind this notion of extending gas to areas such as ours. Now there is a degree, there is a degree of unfairness, it seems up the island, natural gas is plentiful and available in most areas. Out here, you are lucky if you get it. and I was just wondering if you guys can investigate and ..... COUNCILMAN TALBOT: First of all, it's a little self serving for yourself there... MR. TILLMAN: Yeah. February 12, 2013 Page 51 Southold Town Board Meeting Minutes COUNCILMAN TALBOT: But for years there was a moratorium on natural gas in Southold Town and they put those pumping stations in such as the one at McDonalds in Mattituck, another one there is Southold and then they got rid of them when they increased the size of lines coming out, so gas is readily available. Did LIPA or National Grid give them a reason why they weren't going to do it? SUPERVISOR RUSSELL: Just so you know, I met with them on several occasions. The demand for natural gas is enormous, I have met with officials there. The problem is, they are an agency in transition. You know with National Grid with all this ownership issues going on. One of their key employees lives right here in Southold Town and he has been trying to help me get their attention and they keep saying, look if you know anybody that is interested, just have them call this number. I said I will put everyone in a room for you. and if you are going to go into Bayview, I will have a community meeting in Bayview. If you are going to go to Nassau Point, I will do all that. the problem is with the legislation you are talking about, if I am not mistaken, that was actually enabling legislation that was passed by Assemblyman Sawicki at the time, that allowed towns to do that as part of the cable franchise agreement. That is a little bit different because there was a rapid expansion of Cablevision at the time. A lot of the natural gas, some of it has been here for many, many years. You can't un, you know, you can't remove it and they have shown no interest in expanding. I am sorry, I shouldn't say that, middle management has shown an interest in expanding. Upper management hasn't really figured out how they are going to expand and then develop those key charges they would assign to homeowners etc., that also involves a federal regulatory agency as well. They just don't have a game plan yet because again, they are an organization in transition. But we have been trying time and time again because the demand is so high. MR. TILLMAN: These guys are really hurting with the fuel oil. I just thought maybe there could be some kind of consensus or some way to lean on them as our governmental body. SUPERVISOR RUSSELL: They are regulated at the state and federal level. I am not sure that we would have the authority under the law, to do that but we could certainly look at it and .... MR. TILLMAN: Wasn't Cablevision regulated? SUPERVISOR RUSSELL: Yes but what happened was, at the time I think the appeal was made to the state. So that I believe it was Assembly Sawicki at the time, who was one of the co- sponsors of the legislation that allowed towns to incorporate that in, the franchise agreements. MR. TILLMAN: Okay. SUPERVISOR RUSSELL: 1 can find out, you know, you have to remember, I think that was like 1983 and I was just out of high school. 1 don't remember exactly what happened but I think I recall Assemblyman Sawicki at the time. National Grid is foreign owned. Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. I have two things, one is going to be positive and the other is just a question. I got caught in the city of Fr/day night, so I came out Saturday afternoon and to a little shine on Mr. HaMs, there was a very clear change as I drove out and I saw the Southold sign and no longer rode through moguls. I mean, it was like driving down a ski slope. I came out about 4:30 Saturday afternoon. The expressway was horrible but not to cast anything on anybody west of us but it was clear that the work had been, once you hit that Southold sign it was like clear sailing. The second thing is what A1 said, we are again, with Goldsmiths. We have seen it revised and changed and we have all the players in the room now. Can we get a date? SUPERVISOR RUSSELL: Yes, we should. For some reason, Pete, we are going to rely on you a little bit for some of the in-house. Right now it is difficult because of the snow removal and some of the other things that are .... MR. DUNN: Snow removal, Sandy. It just goes back and back and back. And before you know it, it will be Memorial day and everybody is on the beach and you can't do it then. SUPERVISOR RUSSELL: We want to make sure that doesn't happen. MR. DUNN: So, can we get a time frame. I don't want to put anybody against the wall tonight but can we get a time frame to get a time frame? How about that? MR. HARRIS: Jamie is actually the lead .... Because Jamie told me the last time I spoke to Jamie and I have full faith in Jamie, the last I spoke to Jamie he told me that it was again you were trying to schedule it .... MR. HARRIS: Inaudible. Bill Funke, $outhold BILL FUNKE: Bill Funke, Southold. This isn't terhbly important but just another kudo to Pete Harris. I was supposed to go to Rocky Point for work today and I got a call from the woman I work with saying don't even try it. You'll get lost in the pot holes and the ice on the roads. And she mentioned that she came out here, she went to somewhere in Cutchogue and couldn't believe how fantastic this place looked. The roads were a dream compared to everything in Brookhaven, where she was trying to drive around for two days. Which kind of and then his complaints kind of reminded me, when I lived in New Jersey you had five or six towns where you couldn't get anybody to run for office. I mean, nobody would run for any office in town because as soon as you got elected, the phone calls started. I guess you guys know about that. but there they had very little power to do much. All they did all day long was answer complaints. Most of them pretty puny. And that was it, word got around and nobody ran for office.
