That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be [he estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board a[ a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of [he said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. Herrmann En-Consultants, Inc. 1319 North Sea Road Southampton, NY 11968 RE: PATRICIA CONGDON O'BRIEN 5000 GREAT PECONIC BAY BLVD., LAUREL SCTM# 128-4-1 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meetings held on Wednesday, January 23, 2013 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of PATRICIA CONGDON O'BRIEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 21, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinatorfortheirfindings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to remove existing storm damaged timber bulkhead (including +6' section of bulkhead and existing return located beyond westerly property boundary) and construct in its place approx. 96 If. of vinyl bulkhead, a +16' vinyl return along the westerly property line, and a +36' return along the easterly property line; and backfill with approx. 500 cy. of clean sandy fill to be re-vegetated with native planting to restore storm eroded area landward of bulkhead to pre-storm conditions was found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x14' steps and reconstruct 4'x8' steps to beach was found to be Inconsistent with the LWRP, and, 2 • • WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit on existing structures; and deck dimensions will conform to code, and WHEREAS, Public Hearings were held by the Town Trustees with respect to said application on January 23, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of PATRICIA CONGDON O'BRIEN to remove existing storm damaged timber bulkhead (including +6' section of bulkhead and existing return located beyond westerly property boundary) and construct in its place approx. 96 If. of vinyl bulkhead, a +16' vinyl retum along the westerly property line, and a +36' retum along the easterly property line; reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x14' steps; reconstruct 4'x8' steps to beach; and backfill with approx. 500 cy. of clean sandy fill to be re-vegetated with native planting to restore storm eroded area landward of bulkhead to pre-storm conditions, and as depicted on the site plan prepared by En-Consultants, Inc., last dated December 17, 2013, and stamped approved on January 23, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions remove existing storm damaged timber bulkhead (including +5' section of bulkhead and existing return located beyond westerly property boundary) and construct in its place approximately 96 linear feet of vinyl bulkhead, a +15' vinyl return along the westerly property line, and a +35' return along the easterly property line; reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x14' steps; reconstruct 4'x8' steps to beach; and backfill with approximately 500 cubic yards of clean sandy fill to be re-vegetated with native planting to restore storm eroded area landward of bulkhead to pre-storm conditions. are CONSISTENT with the LWRP. The proposal to reconstruct in prior location a 14'x20' storm damaged wood deck and 4'x14' steps and reconstruct 4'x8' steps to beach are INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. r ' • • A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structures described were not constructed pursuant to Southold Board Trustees regulations and a Chapter 275 Wetlands and Shorelines permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
