Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following. 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Pentut is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject [o the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of [he said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. Domino ~`~~y ~~O Telephone (631) 765-1892 Fax (631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD January 23, 2013 Douglas & Benita Pearsall 1725 Oak Drive Southold, NY 11971 RE: DOUGLAS 8~ BENITA PEARSALL 520 WEST SHORE DRIVE, SOUTHOLD SCTM# 80-1-49.1 Dear Mr. & Mrs. Pearsall: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, January 23, 2013 regarding the above matter: WHEREAS, DOUGLAS &BENITA PEARSALL applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 21, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the existing bulkhead; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on January 23, 2013, at which time all interested persons were given an opportunity to be heard, and, 2 • • WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of DOUGLAS 8~ BENITA PEARSALL to reconstruct the storm damaged 62' long bulkhead in-place using 12' vinyl sheathing, 6"x6" CCA top & bottom stringers, 10"x16" fencer piles 6' on center, 4"x6" top clamp, 2"x8" ACO perpendicular cap, 1 "x10" tie rods, backing system of 8"x8" backing piles, all wood to be CCA, hardware to be hot dipped galvanized; additional fill if needed to be supplied from off site, and as depicted on the project plan prepared by Douglas & Benita Pearsall, received on November 21, 2012, and stamped approved on January 23, 2013; and as also depicted on the survey prepared by Roderick Van Tuyl, Land Surveyor, last dated November 8, 1976 and stamp approved on January 23, 2013. Please be advised that I have been contacted by Benita Pearsall who has advised -that she is in the process ofseeking Trustee approval for certain repairs to the bulkhead located on the bay side of her property in Reydon Shores private community, Southold, New York, Mrs. Pearsall has further advised that the Southold. Trustees are seeking consent and approval from Reydon Shores Property Owners Association (RSPOA) prior to .:approving the Pearsall application to proceed with those repairs to that portion of the bulkhead in front of her property that appear to be at or above the mean high water mark... and lying on or north of the property line of the Pearsall property, (Referring to November 8, 1976 Survey performed by Van Tuyl) Mrs. Pearsall has assured me that in addition to any necessazy permits required, she will be supplying the necessary proof of insurance from her licensed contractor performing the work that will list RSPOA, Inc. as an additional insured while having the work performed. 'Therefore, please allow this letter to confirm that RSPOA has no objection to the Pearsall application which seeks to repair and replace those necessary portions of the aforesaid bulkhead that are Ipcated directly in front of the Pearsall property and extending Southeast to the wood steps From the end of Oak Drive to the beach, and provided the bulkhead is not enlarged or proved from its prior location.
