CIMINO, husband and wife, both residing at 41 Whitney Street, Westbury, New York, 11590 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT certain plot, piece or parcel of land, situate, lying and being at Southold, Town of Southold, County of Suffolk and State of New York, known and designated as Lots 222, 223 and one-half of Lot 224, all of Lots 242-246 and one-half of Lots 241 and 247, as shown on a Certain map entitled, "Map of Goose Bay Estate" and filed in the Office of the Clerk of the County of Suffolk on November 13, 1934 under Map No. 1176; said lots and part of lots when taken together are more particularly bounded and described as follows: BEGINNING at a monument on the northwesterly side of Birch Avenue at the division line between Lots 221 and 222 as shown on the above mentioned map, which point is southwesterly 95.06 feet from the intersection of the southwesterly side of Cedar Avenue with the northwesterly side of Birch Avenue; RUNNING THENCE along the northwesterly side of Birch Avenue, south 49 degrees 56 minutes 40 seconds West, 50.00 feet to a monument; THENCE North 40 degrees 03 minutes 20 seconds West, 240.00 feet to a monument set on the southeasterly side of Oak Avenue; THENCE along the southeasterly side of Oak Avenue, North 49 degrees 56 minutes 40 seconds East, 120.00 feet to a monument; THENCE South 40 degrees 03 minutes 20 seconds East, 120.00 feet to a monument; AiNr=A-raut,sdoxum a3a ��3� 3NIVMU'd OUVM03 L661 T I W THENCE South 49 degrees 56 minutes 40 seconds West, 70.00 feet to a monument; THENCE South 40 degrees 03 minutes 20 seconds East, 120.00 feet to a monument set on the northwesterly side of Birch Avenue the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed dated September 27, 1988 recorded in the Office of the Clerk of the County of Suffolk on October 17, 1988 in Liber 10714 page 294. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
