Date: October 22, 2018 FOIL Exempt Enforcement Matter: This matter came to the attention of the entire Board of Trustees during the course of my research on behalf of the Board for a pending Wetland Permit application for a residential dock nearby which is undergoing a comprehensive environmental review involving numerous environmental and safety concerns.The offending structure was viewed by the entire Board on October 10, 2018 from the public shore at the foot of Town Harbor Lane, Southold and appears to have short-circuited the Wetland Code application process in a premeditated fashion,violating not only the permit apllication process as well as construction standards with an illegal enlargement as will be described herein.A brief executive discussion among the entire Board,Trustee Clerk, Elizabeth Cantrell, and Assistant Southold Town Attorney, Damon Hagan,followed,with my offer to reduce our concerns to writing and contact your Office for assistance.The Board does not want this structure setting precedent for docks in the vicinity or any attempt to by the owners of the pending application nearby to leverage their position in any fashion. History: 1985 Dock under prior owner, Dier, illegally expanded seaward and added concrete materials without US Army Corps of Engineers (USACOE) approval (file correspondence reveals the matter then under review of the US Attorney),with construction beyond the scope of their original approval expanding the fixed dock from the original permitted length of 210'to 230' as measured from the bulkhead. It appears to have been subsequently permitted by USACOE and NYSDEC at a time when the Town/Trustees may have had limited jurisdiction/involvement for the work in the bays. 2012 Agent for the current owner,Wendell, Suffolk Environmental Consulting, applied for a dock repair of the said dock, claiming it storm damaged post-tropical storm "Sandy". The agent requested the matter be put on the January 2013 Trustee calendar after the matter was tabled December 12, 2012 as a consequence of the Trustee field inspection(s), revealing serious questions that the dock was non-functional prior to "Sandy". Attorneys for the owner,Solomon and Herrera, PLLC,formally withdrew the Wetland Permit application in writing and requested the hearing be removehad from the calendar in a letter dated February 1, 2013,which would have been honored in the ordinary course of business. October 10 2018: Monthly Trustee field inspection, by the entire Board, from the foot of Town Harbor Lane, revealed a totally reconstructed dock, appearing longer than the prior remnant. Subsequent scaling of the structure from Google Earth reveals a catwalk of approximately 250' long as measured from the bulkhead. It appears we have a series of owners who have grown a catwalk illegally from 210'to 230' to 250' in what appears to be a premeditated fashion. Please put this matter under your review and issue violations as appropriate. Clerk, Cantrell, has started the enforcement file and Damon Hagan is available to assist with language. Located: 355 Terry Lane, Southold. SCTM#65-1-20 Inspected by: John Stein, Doug Hardy The CAC does Not Support the application based of the following: • The structure is excessive and is a navigational hazard; • Impediment to the other waterfront property owners; • The seaward end was not staked and no soundings were provided in the application; and • The structure would be an imposition on the Public Trust Doctrine.
