REASON FOR APPEAL Continued
I. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the parcel has been held in single and separate ownership
since 1959, on which there has stood since prior to 1959 a single family
dwelling in the very Southwest corner the the parcel, as shown on the survey
accompanying this appeal, which could have been suitably divided into 2 parcels
w~i~288 m~inft, and 22616 sq. ft., the first with a frontage of 164.68 ft.
on Main Bayview Road and the second with a frontage of 125.32 ft. on Main Bayview
Road. Thereafter, in 1973, amendment of Article III, Section 100-31 was enacted
rendering each of the proposed parcels too small on which to maintain the current
residence and to construct a residence on the other.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the proposed sub-division and set-off for a
single family residence on each parcel would conform to the existing pattern of
the neighborhood, improve both proposed parcels, and enhance their general
appearance and that of the neighborhood.

Dear Mr. Stigliani:
At the hearing held on April 15, 1988, you had an opportunity to
present your appeal of the department's ruling on the subject application.
In accordance with the provisions of Article 2, Section 220, of the
Suffolk County Sanitary Code, the determination of the Board of Review is
as follows.
Based on the information submitted, tka Board denied the request for a
variance for the 2 lot development. Article 6 is intended to protect water
quality by establishing limits on density of population. Approval of this
development will have an adverse effect on the groundwater.

Appeal # 3627,Lillian Vishno. The Planning Board wishes to
emphasize its prior position as stated in its last review of
May 11, 1987. A copy of same is enclosed.
Appeal # 3389Theodore Petikas. The Planning Board wishes to
re-emphasize its prior position that since more than 50% of the
property is located within the Agricultural - Residential zone,
there can and should be no encroachment of the business zone
into the residential zone under the Town Code.

Appeal # 3561 Dorothy Robertson. The Planning Board wishes to
reemphasize its prior position as stated in its last review of
