A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested forthe reason that Appellant desires to set-off a portion of the subject
property (Lot #2 on survey submitted herewith), creating two (2) lots with insufficient
area and lot depth, and one lot (Lot #2) with insufficient lot width.

REASON FOR APPEAL
Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because Appellant would be unable to set-off the proposed
30, 758 sq. ft. vacant portion of his property to create a separate
building~lot.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because this property is over-sized ±n
comparison to the other properties in the vicinity. The neighboring
properties are of similar size and shape to the proposed lots requested
by this appeal. The lot width of Lot #2 on the survey submitted herewith
is greater than the lot width of the majority of the surrounding properties.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the granting of Appellant~ request for a
variance would permit the creation of two (2) lots each of which is
complimentary and entirely consistant in size and shape with the
neighboring properties.

We have an application pending before the Board of Appeals
for approval of two proposed lots, 30,758 sq. ft. and 40,500 sq.
ft. concerning property located at the north side of Pine Neck
Road, Southold, fronting along Jockey Creek.
Our records show that the property in question is not on
a filed subdivision map and appears to be subject to the
requirements of Article VI for this proposed division.
Since it is our understanding that the applicant has not
applied to your agency since our review process commenced, we
would like to request your input and comments as to the quality
and sufficiency of water and the effects of private sewage sys-
tems, particularly since this involves parcel(s) under 40,000
sq. ft. in area.

The Health DepartJnent's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article ¥ and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
conmercial development such as Article XII. The Lead Agency is requested
to forward a copy of this for~ to the applicant with its findings.

personally visit them at their Stony Brook office for instructions and application
