Upon the Petition of the Town of Southold, duly verified on the 3~ day of August, 2006 and
all of the papers submitted herewith, and the Court having found that the procedural requirements
of the Eminent Domain Procedure Law have been complied with, it is
ORDERED, that thc Petition in all respects is hereby granted, and it is further
ORDERED, that'the Petitioner is directed to fil'e said Order together with the acquisition
map with the Clerk of the Court and the Clerk of Suffolk County, and it'is further
ORDERED, that the. Suffolk County Clerk shall record and index this Order against the
property condemned, and it is furthcr
ORDERED, that title to the property situated in the Town of Southold, County of Suffolk
and State of New York, described in the Petition and more fully de~ribed as follows:

ALL that plot, piece of parcel of land, situate, lying and being at Southold in the Town of Southold,
County of Suffolk, State of New York as shown on a survey prepared by L.K. McLean Associates,
P.C. dated January 18, 2005, said parcel being more particularly bounded and described as follows:
BEGINNING at a point at the southwest comer of the subject parcel, on the division line between
property ofGeorge C. and .Margaret A. Stankevich on the north, and property of the Town
of Southold on the south; said point being the following two (2) courses and distances from the
intersection of the easterly boundary of Hortons Lane with the northerly boundary of Main Street;
i) North 30 degrees 17 minutes 40 seconds West, a distance of ~ 12.54 feet to a point;
North 60 degrees 22 minutes 20 seconds East, a distance of 163.26 feet to the point
at the aforementioned southwest comer of the subject parcel, said point being the
point of beginning;
Thence from said point of beginning, North 31 degrees 44 minutes 10 seconds West, along the
proposed division line through the property of George C. and Margaret A. Stankevich, a distance of
13 ! .0g feet to a point at the southwest comer of other property of the Town of Southold on the
division line between the subject parcel on the south and said property of the Town of Souhtold on
the north;
Thence North 58 degrees 13 minutes 30 seconds East, along said division line between
the subject property on the south and property of the Town of Southold on the north, 155.52
feet to a point on the westerly boundaD; line of other property of the Town of Southold;
Thence along said division line between thc subject parcel and property of the Town of Southold,
the following two (2) courses and distances:
1)
South 29 degrees 44 minutes 50 seconds East, a distance of 136.82 feet to a point at
the southeast comer of the subject parcel; thence
2) South 60 degrees 22 minutes 20 seconds West, a distance of 150.87 feet to a point
at the southwest comer of the subject parcel, said point being the point or place of
beginning.
Said parcel of land containing 20,514 ~uare feet or 0.471 acres, more or less.
Shall vest upon the filing of the Acquisition Map and this Order, which ever last occurs, with
the Clerk of Suffolk County, and it is £urther
ORDERED, that any claim, demand or notice of appearance for damages filed pursuant to
Sections 503 and 504 of the Eminent Domain Procedure Law must be made and filed and served
within three (3) years of the service ofthe Notice of Acquisition by filing same with the Clerk of the
Court and with the Town Auomey of the Town of Southold, 53095 Route 25, P.O. Box 1179,
Southold, New York 11971, or any further address should the location of Town Hall be changed in
the intervening period of time.
