The revised report (see attached) details minor differences from the original report that does not affect the issuance of a Building Permit, therefore; no further action is necessary and the report has been provided for you to be documented in your official file. Lanza, AICP Planning Director Town Hall Annex Building 53095 Route 25 Southold, New York 11971 RE: SprintPCS Wireless Application Site: NY07XC789 41405 Route 25; Peconic, New York Dear Ms. Lanza, APR 1 8 B1B At your request on behalf of the Town of Southold, New York, CityScape Consultants, in its capacity as telecommunications consultant for the Town, has considered the merits of an application submitted by SprintPCS Wireless along with Nextel ("Applicant"), to make changes which will consist of modification of the existing Sprint CDMA cellular/text communications service and the Nextel iDEN services on the tower. The Applicant will replace their six (6) existing antennas which are supported by six (6) 1&5/8 inch feed lines located at one hundred thirty (130) feet on the existing one hundred forty-two (142) foot monopole type support structure to the Applicant's ground equipment, seefigure 1. The final installation will consist of three (3) new panel Type antennas and three (3) Hybriflex feed lines with provisions to excite the three (3) 800 MHz remote radio heads and the three (3) 1900 MHz remote radio heads. The six (6) existing 1&5/8 inch feed lines and the six (6) existing CDMAJiDEN panel antennas will be removed. All the changes will occur at the one hundred thirty (130) foot level. The existing facility is owned by the Town of Southold and is located at 41405 Route 25 in Peconic, New York, 28546, see figure 2. This application for a new wireless facility will not substantially change the service area but will modify both Sprint and Nextel to provide fourth generation (4G) services into the immediate area of the Island. SprintPCS along with Nextel plans new electronic ground equipment within their existing shelter in the leased ground compound, see figure 3. The proposed new SprintPCS/Nextel facility meets the provisions of the federal act, the provisions as indicated in the Town Ordinance and CityScape recognizes that the facility would meet the necessary requirements. The SprintPCS completed project will have three (3) new multiband and upgraded antennas for both the Nextel- iDen operation at 800 MHz and the SprintPCS operation at 1900 MHz; one set for each sector and interconnected by one (1) Hybriflex line per sector for a total of three (3) Hybriflex feed lines, seefigure 4. The proposed tower additions are detailed within the structural analysis which does confirm that following the SprintPCS installation the tower is capable of this additional new antenna array. Telecommunications Site Review New York Antenna Upgrade The Applicant proposes to utilize spectrum that operates near the frequency band used by Southold and Suffolk County public safety, but is not expected to cause any interference. The Applicant knows of FCC rules regarding interference. The applicant did not submit any documentation confirming federal limitations of radio frequency energy concerning exposure to humans. That has been customary in other applications in Southold. The changes in the antenna and feed lines have an impact on the safety of the tower support structure; therefore a structural analysis was required to assure the necessary safety measures are not impaired. The final tower rating will be 75.4% out of an allowable 105%, see figure 5. That is a high amount of stress for a tower with only three (3) additional carriers. CityScape believes there should be capability for two (2) additional carders plus additional Town of Southold communications equipment. The Applicant provided a letter to confirm compliance with the FCC rules regarding subject facilities and the Applicant's provided Construction Drawings indicate the feed lines shall be installed within the monopole structure. CityScape concludes that all requirements have been met to satisfy the federal oversight, state of New York statutes and the Southold Town Codes and is of the opinion that the approval for construction of this application is warranted to facilitate improved SprintPCS/Nextel wireless services in the general area. CityScape confirms the proposed site is properly designed to accommodate all of the Applicant's requests within the property limits. The site has been designed by experts and has been managed, constructed and operated by professionals with expertise in telecommunications site design and construction. This practice corresponds with the desires of the Town. Being this application has been found to be complete, in compliance with both federal oversight and the Town codes; CityScape recommends approval for SprintPCS along with Nextel to construct and install the proposed new facility in accordance with the construction drawings dated January 18, 2013. Pursuant to §280-130A of the Southold Town Code, the Planning Department is seeking to provide a brief report to the Building Department concerning the proposed wireless communications up-grades to determine whether they meet the guidelines for wireless facilities. Pursuant to §280-74A(d) of the Town Code, the Planning Board will hire a Technical Consultant to aid in the review of the application and hereby requires the submission of $8,500.00 into an escrow account with the Town Comptroller's Office to cover the cost of the Technical Consultant's review. Please remit a check in the amount of $8,500.00 payable to the Town of Southold. Any unused portion of the Technical Consultant's fee will be returned to you. WHEREAS, Section 704 of the Telecommunications Act of 1996 mandates that local government cannot prohibit the provision of personal wireless services and requires local government to not unreasonably discriminate among providers of functionally equivalent services; and WHEREAS, the Town desires to engage the services of the Consultant to perform for the Town consulting services regarding the review and analysis of wireless application reviews (Application Review) to ensure the Town's compliance with the aforementioned provisions and other existing federal regulation and legislation, to ensure the wireless carrier's compliance with Town's regulations, and to assure the need for, and minimize the aesthetic impact of, these facilities on the surrounding areas of the Town; and WHEREAS, the Consultant desires to consult with appropriate Town staff as an independent contractor of the Town; and NOW, THEREFORE, in consideration of the mutual benefits and conditions set forth below, the parties hereto agree as follows: Scope of Services to be performed by Consultant. Consultant shall perform those services described in Exhibit "A", attached hereto and incorporated herein by reference. In performing such services, the Consultant shall comply with all federal, state, and local laws and regulations applicable to the performance of such services. The Consultant shall perform services diligently and completely and in accordance with generally accepted professional standards of conduct and performance. Duration of Contract. This Agreement shall be in full force and effect for a period of ~ year(s) commencing upon execution of this Agreement. This agreement shall renew automatically for successive annual terms, unless terminated by either party, thirty (30) days prior to expiration of the then current term. 3. CityScape's methodology carefully follows the federal and state regulations and includes an initial checklist of the material submitted for completeness. CityScape will provide to the Town a detail list of submittals which will be required in order to fully evaluate an Application. The Town will forward to CityScape any application submittal package, or arrange for CityScape to receive submittals simultaneously from the applicant, for which a review is required. If an a;~;>lieation is deemed incomplete, CityScape will conform to the Town's policy regarding proper stakeholder notifications while maintaining the FCC shot clock (if applicable). Copies of any additional information furnished by the petitioner will be copied and provided to the Town. CityScape's review and evaluation will include, but is not limited to: · Accuracy of data and application completeness of submission; · Assurance that the Town works within the confines of the FCC "shot clock" (if applicable) and meets the time allowed for disposition of telecommunications applications; · Applicability of analysis techniques and methodologies; · Validity of conclusions reached; · Compliance with all applicable federal, state, and local structural codes. · Whether the proposed wireless telecommunications facility complies with the applicable approval criteria set forth in the town's local regulations; · Determination if the search ring is adequate based on generally accepted cellular, PCS, ESMR, ISP, paging and other engineering principles for the intended site; · Evaluation of proposed height based on capacity, coverage or upgrades; · Evaluation of the site option and/or any alternative site location options and collocations/modifications/upgrades; · Evaluation of compliance with existing Town and other ordinance and regulations (i.e., setbacks, tower separations, ordinance definitions, etc.) · Compliance with all Town zoning requirements to include but not limited to correctness of concealed design, low profile antenna installation, maintaining the correct number of approved zoning collocations and assurance of matching concealment; · Compliance with the Telecommunications Act of 1996 and other applicable federal laws, rules and regulations; · Compliance with state wireless statutes; · Evaluation of aesthetic impacts and possible mitigation of, stmctnres, shelters, containers and landscaping to provide a more aesthetically pleasing solution; · Evaluation of Federal Communications Commission (FCC) Radio Frequency (RF) exposure compliance; · Evaluation of Compliance with Public Safety Communications systems; · Other lawful matters deemed by the Town to be relevant to determining whether a proposed wireless telecommunications facility complies with the provisions of the Town's regulations. Exhibit A (page 2 of 2) When all submission items are deemed complete, CityScape within fiReen (15) days, will submit to the Town, a written report summarizing the petitioner's request and detailing the findings. CityScape will provide the Town with an agreed upon number of copies, submitted via Federal Express, next day delivery, of the written analysis. A PDF copy of written analysis is available upon request via electronic mail. Upon request and advanced scheduled notice by the Town, CityScape will attend related zoning hearing(s) for expert testimony and will also be available to generate any follow-up submittal letters pertaining to expert testimony regarding a petitioner's application. Application Review Fees The Application Review fee includes an initial review for "technical completeness," evaluation of the application and submitted materials and/or follow-up review and/or letters on same application. There will be no incidental charges associated with the review fee (i.e., faxing, emailing, printing and reproduction costs). The site review may include attendance, as requested in advance by the Town, at related planning/zoning hearings to provide expert testimony and assistance to the Town. The review fee will be paid directly to the Town by the applicant, through the Town's application and review process. Conclusion: 1. We certify that the proposed installation will be structurally sound and will handle the proposed Sprint modifications. Our assessment has been made assuming all information provided is accurate and that the site has been properly erected as per the original drawings and maintained on a regular basis. 2. The final equipment load on this structure with the removal of the old equipment will be comparable to its original design. 3. Based on the antenna loads and visual inspection of the existing antenna mounting system it appears that the mount is capable of supporting the existing and proposed equipment without causing any overstress condition in the mounting system. It also has (6) 1-5/8" feedlines routed inside the monopole. Sprint has proposed remove all the existing antennas to install (3) new APXVSPP18-C-A20 and (6) RRH units. (3) New 1-1/4" Hybriflex cables will be added and the (6) 1-5/8" coax cables will be removed, The antennas will be attached to the pipe mount on the face of the T-Arms on the middle pipe. The RRH and filter equipment shall be mounted to the arm portion of the T-Arm on new pipes and as close as possible to the monopole. Additionally stabilizer arms should be installed to support the T-Arms. Refer to the Construction Drawings by Westchester Services, LLC dated 12/17/2012 for mounting details. The monopole will remain in compliance with the New York State Building Code, the TIA-222-F standard, ASCE 7-05 and the AISC standard. The wind loads were calculated for a basic wind speed of 85 basic mile wind speed mph without ice. Conclusion: 1. We certify that the proposed installation will be structurally sound and will handle the proposed Sprint modifications. Our assessment has been made assuming all information provided is accurate and that the site has been properly erected as per the original drawings and maintained on a regular basis, 2. The final equipment load on this structure with the removal of the old equipment will be comparable to its original design. 3. Based on the antenna loads and visual inspection of the existing antenna mounting system it appears that the mount is capable of supporting the existing and proposed equipment without causing any overstress condition in the mounting system, Table 1 - Sprint Configuration (3) APXVSPP18-C-A20 T-Arms w/ Proposed 130' (6) RRH stabilizer rods (6) Panel Antennas Existing 130' (to be removed) T-Arms Sprint currently has a total of (6) existing antennas mounted to T-Arms. It also has (6) 1-5/8" feedlines routed inside the monopole. Sprint has proposed remove all the existing antennas to install (3) new APXVSPP18-C-A20 and (6) RRH units. (3) New 1-1/4" Hybriflex cables will be added and the (6) 1-5/8" coax cables will be removed. The antennas will be attached to the pipe mount on the face of the T-Arms on the middle pipe. The RRH and filter equipment shall be mounted to the arm portion of the T-Arm on new pipes and as close as possible to the monopole. Additionally stabilizer arms should be installed to support the T-Arms. Refer to the Construction Drawings by Westchester Services, LLC dated 12/17/2012 for mounting details. The monopole will remain in compliance with the New York State Building Code, the TIA-222-F standard, ASCE 7-05 and the AISC standard. The wind loads were calculated for a basic wind speed of 85 basic mile wind speed mph without ice. This structural evaluation is based on the following documents and assumptions: · Monopole mapping from Com-Cell dated 1211012012 · Following data was assumed based on the mapping: Section 1: 0'-42' 0.5 thick Section 2: 42'-82' 0.375" thick Section 3:82'-112' 0.3125" thick Section 4:112'-142' 0.25" thick 50 ksi steel for the pole and 36 ksi for the base plate. · Architectural Drawings dated 12/17/2012 and field information as prepared by Westchester Services, LLC.
