WlTNESSETH, that the party of the first part, !n consideration of Ten Dollars + plus other good and valuable consideration
by the party of the second pad, does hereby grant and release unto the party of the second part, the heirs or successors and assigns
of the party of the second part forever,
ALL that certain plot, piece of parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the Mattituck, Town of 5outh~ld, County of Suffolk and State of New York, known and designated
as Lot 1, Block 1, on a certain map entitled, "Captain Kidd Estates", and filed in the office of the Clerk of the
County of Suffolk on January 19, 1949 as Map No. 1672.
Subject to covenants and restrictions of record.
Subject to zoning, building and health laws and regulations of the Town of South old, Suffolk County,
New York, and any Government Agency having jurisdiction.
Subject to any water supply and sewerage disposal system which shall be made in accordance with
the plans approved by the New York State Department of Health..
Subject to the approval of all building plans and specifications in writing of Dawn Estates, Inc.
Being known as and by the street address 2230 Central Drive, Mattituck, New York 11952.
BEING and intended to be the same premises conveyed to the party of the first part herein by Joseph
Carlton and Jo~.ann Carlton by deed dated April 22, 1996 and recorded in the Suffolk County Clerk's office
on March 6, 1997 in Liber of deeds 11819 at page 515.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above
described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the
first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever.
AN D the party of lhe first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the
consideration for this conveyance and will not hold the right to receive such consideration as a trust fund lo be applied first for the
purpose of paying the cost of the improvement and wilf apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and
has good right lo convey the same; that the party of the second part shall quietly enjoy the said premises; thal the said premises are
free from incumbrances, except as aforesaid; that the party of the first part will execute or procure any further necessary assurance
of the title to said premises; and that said party of the first part will forever warrant the title to said premises.
The word ~party" shall be construed as if it read 'parties' whenever the sense of this indenture so requires.
