In response to the letter dated May 4, 2012 from the Board Chair with respect to the previously submitted application, please note: • There is no indication that the Board of Appeals met in a properly noticed meeting and actually voted on the application previously submitted. The Board Chair has no independent authority to reject an application submitted to the Board of its approval. • Both the prior application, and the application submitted with this letter meet all of the criteria of Chapter 205 of the Town Code, and the Board of Appeals is without authority to reject the application. The Town Code sets forth no standards by which to judge an application which is submitted and which complies with the Town Code. Simply stated, there is no basis for the Board to reject the application and the application must be approved by the entire ZBA. • There is no criterion in the law which establishes a maximum number of events that a winery may hold in any one year. • There is no basis in law to deny the application based upon alleged code violations or hearsay accounts of alleged State Liquor Authority infractions. Review of applications made pursuant to Chapter 205 makes no provision for the denial of the permit on such criteria. • Denial of the application"in the interest of the health, safety and welfare of the residents" is without any basis in the Town Code. Special event permits for wineries need only comply with the provisions of Chapter 205-1(E)(1)-(4) and are entitled to the issuance of the permit. Upon submission of a complete application, this is a ministerial act and is not discretionary. • The Board (or the Board Chair) cannot refuse to process an application which is fully compliant with the Town Code, and then subsequently have the Town prosecute alleged violations based upon an applicant's failure to obtain a permit. The applicant is entitled to the immediate issuance of each of the special event permits applied for, and will take all legal action necessary to protect its interests and seek compensation for any wrongful damages it may suffer. Accordingly, any completed application that is not submitted 30 or more business days prior to the scheduled event will not be accepted - nor considered - by the Office of the Zonine • Board of Appeals without a waiver from the Board Chairperson. Reasons for requesting an • expedited review must be submitted in writing to the Chairperson. • The Town reserves the right to request additional information from an applicant to address issues • related to the health, safety, and welfare of the community at the discretion of the Chairperson • and Office of the Zoning Board of Appeals. • When is a Permit Required? • • Wineries and/or organizations planning events at wineries must obtain a permit from the Zoning • Board of Appeals for events that are outdoors, open to the public, and where the number of • attendees exceeds the maximum occupancy of the public area of the winery building. • Local fraternal, charitable, or religious organizations that are planning a public event that will • NOT be held at a winery, must apply for an event permit at the Town Clerk's Office. • Gatherings in private homes that are by invitation such as graduations, weddings, family • reunions and parties are considered private events and do not require permits. To Obtain a Permit You Must Submit to the Zonin Board of Appeals: • 1. A completed application form signed by the owner and the event manager 5-012 C «k 5 • 2. A valid Certificate of Insurance in the amount of One Million Dollars with the Town of Southold as an additional insured, and with event dates noted • 4. A Parking/Event Plan: consisting of a survey, site plan and/or aerial view of the subject • property that includes the locations of on site parking, sanitary facilities, and tents or • other temporary structure(s). (See application form for details) • 5. Events for three hundred (300) or more people require submission and approval of a traffic control plan acceptable to the Town of Southold AND a qualified traffic controller • must be provided at the event. By acceptance of this permit, applicant agrees to adequately supervise and direct all parking to be on the winery • premises or at another site, and to provide parking assistants and any additional traffic controls necessary for this • event. Parking is strictly prohibited on ANY Town County or State Roads or Rights of Way. • 2. Traffic control at events for three hundred (300)or more people shall be provided by a qualified traffic controller • in accordance with the attached,approved traffic control plan • 3. One "on-premises" sign not larger than six (6) square feet in size may be displayed not longer than thirty (30) days before this event, and removed immediately after the event. On-site food preparation is NOT permitted, although food may be catered subject to all Suffolk County Department of Health regulations. • 9. Issuance of this permit does not authorize in any manner occupancy of the principal building exceeding the • legal limitations under the fire code or other codes which would prohibit such increased occupancy. 12. Access shall be provided for emergency vehicles, to all public assembly areas, all buildings, all work areas and any additional area where emergencies may occur. Two emergency-fire exits and exit paths from the building(s) on the property, to a public way of remote safe area,shall remain open and unobstructed at all times. _ 13. Music, when outdoors, is required to stop at the time specified in the permit. Placement of the speakers must be approved by the winery management in a location that affords the greatest protection from noise intrusion upon adjacent properties. 14. Where possible, live bands rather than disc jockeys will be encouraged. When disc jockeys are used, the decibel levels will be monitored to ensure acceptable levels. 15. Organizers of the events will be required to use an approved disc jockey recommended by the winery or have their own disc jockey sign a contract agreeing to the above. If they do not honor the contract, the winery will have the right to remove the disc jockey from the premises. 16. Owner assures that all fire, safety, building, and other Taws will be complied with. 17 ADDITIONAL CONDITIONS: ANY VIOLATIONS IN CONNECTION WITH THE CONDITIONS LISTED HEREIN WILL TERMINATE THIS PERMIT. A clear fire lane will also be established. In the event of an emergency situation personnel will contact the proper agency and direct them to that •location. • •Ingress Traffic. PES personnel will be in clearly marked by wearing safety vests and will be in communication with each other by radio. All guests arriving to Vineyard 48 will enter *from the West Entrance. Personnel will provide clear instructions as to where particular *vehicles are to park. Personnel cars will be provided parking spots in the main Vineyard 48 •parking lot. Commercial vehicles will unload all passengers in front of the winery's main •entrance. *Egress Traffic: Personnel will direct all commercial vehicles to the posted marked parking •location on Depot Lane. No vehicles will be directed by staff to park on any public *highways or roadways. All commercial vehicles returning to the winery to pick up their •passengers will leave the depot lane parking area and enter through the back of Vineyard 48, adjacent to the railroad tracks. All departing traffic will exit the winery onto County Road •48. • *All self parked vehicles will do so in a neat and organized, row by row fashion on Vineyard 48's property.
