GREENPORT, L.L, NEW YORK. 11944 June 17, 1980 Mr. George Fisher, Building Inspector Southold Town Hall Main Road Southold, New York 11971 Dear George: You have asked my opinion with respect to the following state of facts, to wit: The Board of Appeals previously granted variances to permit the cre- ation of three contiguous lots, each of which had an existing dwelling located thereon. Thereafter the property owner purchased land in the rear of these lots, which newly-acquired land has frontage on another street. The question you ask is whether the property owner is required to add the newly-acquired property to the three under- sized lots upon which variances were previously granted. The effect of granting area variances by the. Board of Appeals is to permit the lots in question to be used and sold in accordance with the variance previously granted. A variance is not personal to the appli- cant but runs with the land. It would be my opinion that in the absence of a condition imposed by the Board of Appeals in granting the variance, which required the owner to merge any after-acquired contiguous land with the lots for which the variances were granted, that the owner is not required to add such after-acquired land to the lots upon which variances were granted. RESOLVED, that whereas, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Robert W. and Anita M. Feagles was submitted to the Planning Board on June 16, 1980, and an application fee of $100.00 was paid on June 16, 1980, and WHEREAS, a public hearing was held on the said subdivision application and final map at the Town Hall in Southold, New York, on July 14, 1980 at 2:15 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said plat and application, Now, therefore, be it RESOLVED that the application of Robert W. and Anita M.
