Meeting held on Wednesday, July 17, 2013:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit #7962 to construct a 3.5'x4' wood platform and 3.5'x8'
steps to beach; and as depicted on the revised site plan prepared by En-Consultants,
last dated June 19, 2013 and stamped approved on July 17, 2013.
Any other activity within 100'. of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 12, 2012 regarding the above matter:
WHEREAS, En-Consultants on behalf of LEWIS TOPPER & MARGARET
SAVERCOOL applied to the Southold Town Trustees for a permit under the provisions
of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated November 14, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 12, 2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of LEWIS TOPPER &
MARGARET SAVERCOOL to construct approx. 55 linear feet of vinyl bulkhead in place
of (and up to 18" higher than) existing storm damaged timber bulkhead; construct a
10' easterly return; and backfill bulkhead and storm eroded area with approx. 100 cubic
yards clean sand/loam fill, with existing armor and covenanted 10' wide non-turf buffer
landward of bulkhead to remain upon completion of the bulkhead reconstruction; and as
depicted on the site plan prepared by En-Consultants, last dated November 12, 2012
and stamped approved on December 12, 2012.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

AUTHORIZATION
Pursuant to [he provisions of Chapter 275 of the'1'own Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on December 12. 2012,
and in consideration of application fee in the sum of $250_00-paid by En-Consultants and subject to the Terms
and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to construct approx. 55 ?inear feet of vinyl bulkhead in place of
(and up to 18" higher than) existing storm damaged timber bulkhead; construct a
10' easterly return; and backfill bulkhead and storm eroded area with approx. 100
cubic yards clean sand/loam fill, with existing armor and covenanted 10' wide non-turf
buffer landward of bulkhead to remain upon completion of the bulkhead
reconstruction; and as depicted on the site plan prepared by En-Consultants, last dated
November 12, 2012 and stamped approved on December 12, 2012.

TERMS AND CONDITIONS
The Permittee T ewis Tonper & M~rearet Savercool, residing at 120 Terrv Path Mattituck,
New York as part of the consideration for the issuance of the Pernrit does understand and
prescribe to the following:
1. That the said Board of'1'mstees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation perConned pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Pennittce
assumes full liability with respect thereto, to the complete exclusion of the Board of
Tmstees of the "town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension maybe made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the shucture or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
Cor revocation of this Permit by resolution of the said Board.
5. Tltat there will be no umeasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Tmstees,
the work shall cause unreasonable obstruction to free navigation, the said Pemuttee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of [he completion of the work
authorized.
9. That the Permittee will obtain all other permits and cotuents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

With the recent heavy rainfalls, we are reminded once again of the problems Southold
Town has with storm water runoff. With over I00 road ends terminating at creeks, bays,
inlets, or Long island Sound, as well as all of the lawns and homes lining our miles of
shoreline, 100's of thousands of gallons of storm water runoff enters our wetlands every
year.
Carrying sediment that prevents sunlight from reaching aquatic plants, nutrients from
animal waste and lawn fertilizers that promote algae blooms detrimental to shellfish, and
bacteria and other biologicals that in high doses can be harmful to swimmers, storm water
runoff is one of the Trustees main public safety concerns. So important, in fact, that
Southold has a Storm Water Management Code.
Southold Town's Chapter 236 provides an outline for how people need to deal with storm
water runoff from their properties. For example, new construction or renovation is
required to contain any potential runoff to the wetlands from the construction by
installing hay bales and silt fencing. This acts as a barrier and keeps our wetlands clean.
Another example in Chapter 236 is that every building must have provisions to collect
and disperse, ON-SITE, at least a 2 inch rainfall. This is usually handled by installing
gutters, leaders and dtywells to the home. The Trustees also have a standing policy of
requiring pervious non-turf buffets along bulkheads and at tops of bluffs that help keep
run off from entering the wetlands and prevents erosion to bluffs. These are important
measures to keep our wetlands safe and clean!
Before deciding to renovate or build, the Town Trustees urge you to check our website
and the other department's websites to make sure what you are planning to do meet the
Town's Codes. These codes have been developed for the good of all citizens. And the
wildlife all around us too!

Pursuant to the provisions of Chapter 275 of the Town Code of [he Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on December 12. 2012,
and in consideration of application fee in the sum of $250.00 paid by En-Consultants and subject to the Terms
and Conditions as stated in the Resolution, the Southold Town Board of "Crus[ees authorizes and permits the

Wetland Permit to construct approx. SS linear feet of vinyl bulkhead in place of
(and up to 18" higher than) existing storm damaged timber bulkhead; construct a
10' easterly return; and backfill bulkhead and storm eroded area with approx. 100 _
cubic yards clean sand/loam fill, with existing armor and covenanted 10' wide non-turf
buffer landward of bulkhead to remain upon completion of the bulkhead
reconstruction; and as depicted on the site plan prepared by En-Consultants, last dated
November 12, 2012 and stamped approved on December 12, 2012.

TERMS AND CONDITIONS
The Permittee Lewis Topper & Marearet Savercool residinP at 120 Tery Path Mattituck,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
l . That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Pennit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Pennittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses [o the Town of Southold.
8. That the said Board will be notified by the Permittee of [he completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 12, 2012 regarding the above matter:
WHEREAS, En-Consultants on behalf of LEWIS TOPPER 8~ MARGARET
SAVERCOOL applied to the Southold Town Trustees for a permit under the provisions
of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated November 14, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 12, 2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent

Path (a/k/a 3606 Camp Mineola Road), Mattituck, Town of Southold, County of Suffolk, State of
New York, described in the Suffolk County Tax Map as District 1000, Section 123, Block 6,
Lot 13 which is more particulazly bounded and described as set forth in Schedule "A" annexed
hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of
Trvstees of the Town of Southold (hereinafter the "Trvstees'~ pursuant to Chapter 275 of the
Town Code of the town of Southold or its successor, and vazious activities conducted upon the
property may thus be subject to the regulation and approval of the Trustees prior to being
conducted;
WHEREAS, the DECLARANT therefore made application to the Trustees for a permit
pursuant to the Wetlands Law of the Town of Southold to undertake certain regulated activities;
and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such
regulated activities, the Trustees required a 10 foot wide "non-turf buffer" adjacent to the
bulkhead;
NOW, THEREFORE, the DECLARANT does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there
shall be established and subsequently maintained a 10 foot wide "non-turf buffer"
adjacent to the bulkhead as defined by Chapter 275 of the Town Code; and
2) These covenants shall run with the land and shall be binding on the
DERCLARANT, his heirs, assigns, purchasers, or successors in interest and may

En-Consultants on behalf of LEWIS TOPPER 8~ MARGARET SAVERCOOL requests a
Wetland Permit to construct approximately 55 linear feet of vinyl bulkhead in place of (and up
to 18" higher than) existing storm damaged timber bulkhead; construct a +/-10' easterly return;
and backfill bulkhead and storm eroded area with approximately 100 cubic yards clean
sand/loam fill, with existing stone armor and covenanted 10' wide non-turf buffer landward of
bulkhead to remain upon completion of the bulkhead reconstruction. Located: 120 Terry Path,
Mattituck. SCTM# 123-6-13
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP.
Consider requiring the installation of pervious filter cloth landward of the bulkhead
pinned to the soil and buried (depth undetermined) to act as a splash pad that would
dissipate wave enerav and resulting erosion during storm events. The buried depth of
the filter cloth is dependent upon if vegetation will be installed in the buffer and the root
depths required.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

timber bulkhead with untreated vinyl sheathing and maintaining the covenanted 10' nonturf buffer landwazd of the
bulkhead, the project will effectively maintain the historically preexisting conditions along [his bulkheaded shoreline
without any change in or significant adverse impact on the adjacent unvegetated wetland area or tidal waters of the Town.

The removal and replacement of the existing bulkhead should be determined to be exempt from Waterfront Consistency Review
pursuant to Section 268-5 of the Town Code, but to the extent that the raising of the bulkhead height and addition of a return may
constitute a reviewable "action," the project is consistent with Policy 4. Specifically, [he project seeks to replace an existing timber
bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location and up to 18" higher to provide a reasonable
increase in protection for the upland property and existing residence against erosion and flooding caused by storm surge. The existing,
developed site has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1992, and
there is no viable non-stmctural alternative means of maintaining and protecting the upland portion of the property in its current
location. Without replacement and maintenance of the bulkhead the subject and adjacent properties would be exposed to severe erosion,
flooding, and damage to the residential stmctures located thereon.
