That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. These addresses are the addresses given tome by the Tax Assessor's Office for property on the tax map identified as 1000-53-6-38.2. and 100-53-6-37.1 respectively. I know that Mrs. Keifer (1000-53-6-38.2) is spending the winter in Florida, and that her mail was being forwarded. However, because I was concerned that the return receipt would not be sent back to me in time for the hearing, I called Mrs. Keifer and e-mailed her and asked her to notify me when she received the notices and plans. Mrs. Keifer advised me on Monday, December 10, 2012, by phone and by e-mail that she had received the notices, survey and plans. However, I have not received back the return receipt in time for the hearing. Attached please find the e-mails (Exhibit A) I sent to Mrs. Keifer (1000-53-6-38.2) and the e-mail she sent back to me advising me that she has received my letter and "gives me permission to do any alteration to my property." Mrs. Keifer said she was unable to FAX me a letter because she had torn the meniscus in her knee and cannot walk and get out of the house. I also attach a Track and Confirm (Exhibit B) webpage from the U.S. Postal Department showing that my certified mail to Mrs. Keifer (1000-53-6-38.2) was delivered on December 10, 2012. With regard to Dr. Basilice (1000-53-6-37.1), Track and Confirm notice from the U.S. Postal Department shows that two attempts were made to deliver the certified mail with no success. (Exhibit Q.
