Meeting Hall, 53095 Main Road, Southold, NY. Supervisor Russell opened the meeting at 4:30
PM with the Pledge of Allegiance to the Flag.

Motion To: Motion to ENTER into Executive Session
On motion by Justice Louisa Evans, seconded by Councilman William Ruland, it was
RESOLVED that the Town Board of the Town of Southold hereby enters into Executive
Session at 11:29 AM for the purpose of discussing the following items:
EmploYment history and performance of a particular person or persons or matters leading to the
appointment, emploYment, promotion, discipline, suspension, dismissal or removal of a
particular person or persons. Collective bargaining negotiations necessary to formulate strategy
regarding the PBA and CSEA Unions. Pending and current litigation strategy concerning the
following matters: Town of Southold et al. v. Metropolitan Transportation Authority, et al.;
Town of Southold v. Go Green Sanitation Inc., et al.

SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance to the Flag. I am
going to ask everyone to please remain standing for a moment of silence in memory of the
victims of the Sandy Hook incident. Thank you. Alright, before we get to the regular agenda,
what we would like to do is we are going to honor Don Dzenkowski who is retiring from his
position as Senior Bay Constable after 29 years of service to this town and to the people of this
town. Don, would you please come forward and Chief, do you want to come up? (Supervisor
presents proclamation at this point) Don, this isn't enough. After all of what you have done for
the people of this town. Thank you.

CHIEF MARTIN FLATLEY: I have your retired badge for you. And really just quickly, on
behalf of everybody that you have ever worked with or for in the Southold Town police
department, I just want to congratulate you on that 29 years of a great career and great service to
the police department. I know I for one, who has worked there the whole time you have, really
appreciate it and you are a great (inaudible).
DON DZENKOWSKI: Inaudible. I would just like to thank the town for the proclamation, it's
really nice, I wasn't expecting anything. So thank you very much.
SUPERVISOR RUSSELL: Okay, I would ask anybody that would like to comment on any of

that the Town wishes to exercise its option to renew its Agreement with Winter Brothers
Recycling to supply the Town with MSW Haul and Disposal Services through June 30, 2014, at
prices specified in Winter Brothers Recycling's bid of May 21,2011, and accepted by the Town
Board on June 21,2011, subject to the approval of the Town Attorney.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 18th day of December, 2012, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 111~ Coastal Erosion Hazard Areas and Further
Amendments to Chapter 275~ Wetlands and Shoreline".
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
15th day of January, 2013 at 7:32 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 111~
Coastal Erosion Hazard Areas and Further Amendments to Chapter 275, Wetlands and
Shoreline" reads as follows:
LOCAL LAW NO. 2013
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 111~ Coastal
Erosion Hazard Areas and Further Amendments to Chapter 275~ Wetlands and
Shoreline".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The Town of Southold has the authority to administer a Coastal Erosion Management Program
within its jurisdiction. One purpose of this chapter is to establish standards and procedures to
protect natural protective features, expanding the definition to include wetland areas. Another
purpose of this chapter is to regulate development activities in coastal areas subject to coastal
flooding and erosion in order to prevent damage or destruction of natural protective features and
other natural resources. Regulating how to calculate the building area with more specificity will
aid in preventing unnecessary damage to the natural protective features and protect human life.
A coastal erosion management permit is necessary for the installation of cable service landward
of the shoreline structures, consistent to other similar services. Reference to Chapter 236,
recognizes certain activities that require a coastal erosion management permit and also fall
within the regulations of Stormwater Management.
II. Chapter 111 of the Code of the Town of Southold is hereby amended as follows:
§111-6. Definitions.
ADMINISTRATOR -- The local officials responsible for administrating and enforcing this
chapter. The Southold Town Board of Trustees is hereby designated as the "Administrator." The
Administrator designates the Southold Town Police Department, Bay Constables and the Office
of Code Enforcement as responsible for the enforcement of this Chapter.

L1VABLE FLOOR AREA -- All spaces within the exterior walls of a dwelling unit, exclusive
of garages, breezeways, unheated porches, cellars, heater rooms and approved basements having
a window area of less than 10% of the square foot area of the room. Usable floor area shall
include all spaces not otherwise excluded above, such as principal rooms, utility rooms,
bathrooms, all closets and hallways opening directly into any rooms within the dwelling unit.

NATURAL PROTECTIVE FEATURE - A nearshore area, beach, bluff, primary dune,
secondary dune, wetland or marsh and their vegetation.
PRINCIPAL BUILDING - A building in which is conducted the main or principal use of the lot
on which said building is located.
UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter
include but are not limited to elevated walkways or stairways constructed solely for pedestrian
use and built by an individual property owner for the limited purposes of providing
noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns,
open timber piles or other similar open work supports with a top surface area of less than 200
square feet or which are removed in the fall of each year; normal beach grooming or cleanup;
maintenance of structures when normal and customary and/or in compliance with an approved
maintenance program; set up and maintenance of temporary wildlife protective structures;
planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and
secondary dune areas in order to maintain or increase the height and width of dunes; routine
agricultural operations, including cultivation or harvesting; and the implementation of practices
recommended in a soil and water conservation plan as defined in § 3, Subsection (12), of the Soil
and Water Conservation Districts Law; provided, however, that agricultural operations and
implementation of practices will not be construed to include any activity that involves the
construction or placement of a structure.
WILDLIFE PROTECTIVE STRUCTURES - Structures, temporary in nature, used for the sole
purpose of protecting nesting and habitat of wildlife species.
§111-10. Structural hazard area.
The tbllowing restrictions apply to regulated activities within structural hazard areas:
A coastal erosion management permit is required for the installation of public service
distribution, transmission or collection systems for gas, electricity, water or wastewater
and cable service. Systems installed along the shoreline must be located landward of the
shoreline structures.
§111-1 I. Nearshore area.

Clean sand or gravel of an equivalent or slightly larger grain size is the only material
which may be deposited within nearshore areas.-Ampdeposit~ and wi!! requires a
coastal erosion management permit.
§111-12. Beach area.
Active bird nesting and breeding areas must not be disturbed unless such disturbance is
pursuant to a specific wildlife management activity approved, in writing, by the New
York State Department of Environmental Conservation.
§111-14. Bluff area.
Bluffs protect shorelands and coastal development by absorbing the often destructive energy of
open water. Bluffs are a source ofdepositional material for beaches and other unconsolidated
natural protective features.
The following activities are prohibited on bluffs:
(4) Disturbance of active bird nesting and breeding areas, unless such disturbance is
pursuant to a specific wildlife management activity approved, in writing, by the
New York State Department of Environmental Conservation.
§111-25. Appeal to Board of Review.
The Coastal Erosion Hazard Board of Review may, in conformity with the provisions of this
chapter, reverse or affirm, wholly or partly, or may modify the order, requirement, decision or
determination of the Administrator, including stop or cease-and-desist orders. Notice of such
decision will forthwith be given to all parties in interest. The rules and procedures for filing
appeals are as follows:
A. Appeals may be made only by the applicant in the underlying decision.
~.B~. Appeals must be filed with the Town Clerk within 30 days of the date of the adverse
decision.
B.C~. All appeals made to the Coastal Erosion Hazard Board of Review must be in writing on
standard forms prescribed by the Board. The Board will transmit a copy to the Commissioner of
the New York State Department of Environmental Conservation for his information.
C~.D~. All appeals must refer to the specific provisions of this chapter involved, specify the
alleged errors, the interpretation thereof that is claimed to be correct and the relief which the
appellant claims.
§111-27. Coastal erosion management permit.
A coastal erosion management permit will be issued for regulated activities which comply with
the general standards (§ 111-9), restrictions and requirements of the applicable sections of this
chapter, provided that the following are adhered to:

Permits will be issued by and bear the name and signature of the Administrator and will
specify the:
(5) Period of permit validity. If not otherwise specified, a permit will expire mae~a~
two years from the date of issuance.
§111-29. Powers and duties of Administrator.
The authority for administering and enforcing this chapter is hereby conferred upon the
Administrator. The Administrator has the powers and duties to:
Designate the Southold Town Police Department, Bay Constables, and/or the Office of
Code Enforcement to enforce ............................. wolat~ons of th~s Chapter and
notice of violations m-against property owners or to other responsible persons.
III. Chapter 275 of the Code of the Town of Southold is hereby amended as follows:
Purpose.
In order to continue to protect the natural state of the shorelines and wetlands within the Town of
Southold, while balancing the rights of property owners, it is the purpose of these amendments to
simplify the permit process, codify and clarify existing policies and conform certain regulations
to environmentally accepted practice.
§ 275-4. Exceptions.
The provisions of this chapter shall not require a permit for the following:
(10) Installation of new or replacement windows, roof shingles, solar panels, siding, or
doors, on existing upland structures and second story additions that are made .... j

§ 275-11. Construction and operation standards.
General. The following standards are required for all operations within the jurisdiction of
the Trustees:

(a) Platforms associated with stairs may not be larger than 33 100 square feet.
IV. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
V. EFFECTIVE DATE

SUPERVISOR RUSSELL: Alright, that concludes the agenda. Would anyone like to address
the Town Board on any issue? Pete?
Superintendent of Highways Peter Harris
PETER HARRIS: Good evening members of the Board. Peter Harris, Superintendent of
Highways. I just wanted to bring to everyone's attention in the town tonight, first I would like to
start with the emergency preparedness team that prepared prior to superstorm Sandy. We had a
great plan, it was put into effect. Post storm cleanup, due to the fact that we were authorized to
work overtime to remove debris, we were right in on that 30 day window that FEMA was
looking for the reimbursement. I think the town's employees served the taxpayers of this town
immensely and did a terrific job. Thanks to Lloyd Reisenberg fbr securing those vehicles
through the county debris management that helped call along with the fleet and workforce of the
highway to get that debris to the compost facility. This town doesn't know how fortunate we
were compared to other towns on Long Island and New Jersey that were totally devastated. Not
that we didn't have residents that were devastated and lost their homes but we missed the direct
bullet. We got wounded but we didn't take the direct hit. I just have to say that Southold Town
came out and in my opinion and its employees did a fantastic job of getting this town back to
order in a very reasonable amount of time. I think we learned from, you know, what's the

chances of having two storms two years in a row? And last year we learned a lot of things as far
as when we were doing recovery from the storm in the amount of time that it took us to get the
mess cleaned up and we did it in less than half this year. We had probably just as close as much
amount of debris on the ground. But through emergency preparedness, working with Lloyd
Reisenberg, being prepared right from the outset, post storm and getting resoumes here. This
town can be well thankful of its employees. They did a yeoman's job. There are still some
things out there that are being done, I mean, we have trees that are still standing that probably
there is quite a few that are going to end up having to come down but you know, there are road
ends that are going to need to be fixed but Jamie Richter, the day we met with FEMA, he had a
whole plan of things that had to be taken care of and numbers and dollars and cents values of
what it would cost to rehabilitate them. Thank god that mother nature was on our side, it didn't
hit us bad with snow, so that we were able, I was able to take the overtime assets from
unexpended snow overtime that could pay for the overtime for this cleanup, that the town didn't
have to go and look to try to scramble to where we were going to get the money to pay these
people. The money was there and its not costing the taxpayers any, you know, we didn't have to
go out and get any extra money from someplace else. So I just wanted to say thank you to the
Board, thank you to the members of the Emergency Management and to the employees of the
town. Thank you.
COUNCILMAN KRUPSKI: Thanks, Pete, for the hard work.
SUPERVISOR RUSSELL: Yes, Pete, just so everyone is aware. Pete is actually one of the
members of the Emergency Management Committee. We actually put in some very long days
and even longer nights in at the police station basement, prior to the event, during the event and
then post event and Pete still hasn't stopped because of the enormous amount of cleanup that
needed to take place that Pete had overseen the whole time. So, thank you for everything, Pete.
Who else would like to address the Town Board?
Benjamin Schwartz, Cutchogue
BENJA SCHWARTZ: It's been a while. Benja Schwartz, Cutchogue. I have been hearing fi'om
a lot of people that they miss seeing me up here. I miss seeing all of you. A lot of things have
happened. Hurricane Sandy was not as serious a storm as we thought it was. It was a severe
storm though and we did suffer some damage. Maybe we were lucky but maybe also I am
thankful to the man who planted the trees after the '48 hurricane on my property that the trees
that he planted were a little bit to the side and fell down on the side of the house, missed the
house. There was another big tree right in the middle of the front of my house which I cut down
probably about 20 years ago that might have ended up right in the house. 1 think we, I would
also like to express gratitude to the employees who did a tremendous job working very hard after
the storm. But I don't think we are doing enough, I don't think we are ready for the next storm.
I don't think that two storms in a row was completely a coincidence or an accident. Do you all,
up on the Town Board there, do you believe in free will?
COUNCILMAN TALBOT: Depends.
MR. SCHWARTZ: Do you believe we have the power to influence the future? Do you believe
that, 1 do, I believe that every person has the power for better or worse and 1 believe that if we

don't use the power for better then we end up fbr worse. I don't think we have to debate global
warming but I think as our Town Board, you are designated the official leaders of our town and
you have the power to control many things in our town. In terms of storms, the end of Pequash
Road demonstrates to me after every storm that our infrastructure, our roads are designed to
shoot the water that runs off the road out towards the harbor and then the water that the storm is,
the waves coming in we get erosion and a washout. We lucked out this year that the county
dredge just came through a month or so after the storm and deposited a lot of sand. I think the
highway department usually is the one that has to bring the trucks of sand down there every time
we have a storm. I had the pleasure of visiting Nassau Point last week, I took a, someone there
from the south fork who grew up on the bays on the south fork and he was blown away by the
beauty and just how wonderful, we have some beautiful places out here. The only part of that
walk which was not attractive at all was the end of the road. The way the storm drain is set up,
there is a concrete pad to try and shoot the water out into the bays and the harbors. Well, we,
that used to be the thing to do but now we know better but we are still doing it. a lot of specific
issues that we have been dealing with, that we have dealt with in the past year, not going to go
into details. I did have a man call the police on me last week because I was taking a video tape
of him and his 4 workers, they had 5 gas powered backpack leaf blowers. He asked me what I
wanted him to do and I said use a rake. He said a rake? Rakes, no, no rakes. He told me if I
didn't like him making all that noise on Sunday morning, at 7:30 Sunday morning, I should call
the police. I said no, we don't need to call the police, we can talk about it. he said I have
nothing to talk to you about, go call the police. I said if you want to call the police, call the
police. The police asked me what the law was. I said I looked it up but I can't understand it.
they said, well, if you are a lawyer and you can't understand it, how is everybody else supposed
to understand it? just passed that noise law last year. It is extremely unclear. It looks to me like
commercial people are covered but it talks about residential use of light equipment and
commercial servicers. And then they start talking about snow throwers. Well, I don't really
have much problem with snow blowers but there is no mention of leaf blowers and leaf blowers
are a problem because of the noise and because of the damage that they do to our environment,
to the soil, to the earth, to the things that grow in the soil that keep the healthy soil, so that the
water doesn't run off and cause problems and so that we have a natural balance, a healthy strong
eco-system, that we don't have things like infestations of ticks and huge populations of deer. We
have to make a difference, we have to change, we have to believe that we can do it and that we
have free will. There was another example. I see that the supervisor is tired of listening to me
but you know, I have a few more things to say and I would like to discuss something with you
but I just, have people been, ! don't know, I got here late today, I was working. I had to drive
pretty fast, I barely had time to look around but I did, I still saw some beautiful things. I think
we all need to slow down and look around. Not to take our eyes off where we are going. We
have to keep an eye on where we are going. This event over in New Town Connecticut, there
has been a lot of news stories, a lot of coverage. The day it happened, I was glued to the radio.
Didn't take long to realize that the people on the radio didn't have too much to report, the facts,
they were just trying to inform people but they didn't have the information to do it. So they said
what they said and then there's been a lot of reports in a lot of papers and all of that but 1 have
only seen one report that really answered some of the questions that I have. Obviously, anyone
who goes into a school and mows down 6 year olds is got a problem and is at fault, is doing
something wrong. But knowing what we know now, that the guns were purchased by the mother

and that the mother used to take that child and go shooting with him and that the child was a
troubled child but disregarding that, anyway this report, did you hear about the, did you know
that what the, what organization is in New Town? The town where this occurred. Did you hear
about the national shooting sport foundation? They claim on their website that they are the voice
of the firearms industry in the United States. And their headquarters is in New Town. Right
there, you know, you think is this a coincidence? What happened in New Town, happened in
New Town. Not only that, they have a couple of shooting ranges in New Town. But they are
completely booked. They have waiting lists. People cannot, people, so many people in New
Town want to go shooting that they can't get into the shooting ranges, so they are shooting at
home. So this is a problem, this is a problem that New Town has been discussing. Now we
don't have very many people here but I know that there are some more listening but I think that
this is something that it is not just the child that committed the act or the family of that child or
the school system there, it is the community. Well, the community in New Town, the leaders of
that community, the Republican leaders and the police chief came to the community last summer
and said we have gun problem, we have potential for worse problems in New Town and we
need to pass some laws to control some of these gun owners that may not be acting properly.
Well, the community came to town meetings and said no, no. we don't want any laws, we don't
want any control. Well, I think we need people to come to this town government and I think we
need some laws. I am not sure about guns but I am concerned about guns in Southold Town.
Guns, you know, one thing my mother taught me, she made it very clear, over and over again.
Guns are not toys but you know, the national shooting sport association would beg to differ.
They put explosives on their targets so that when they hit the target, the target explodes. They
say that's a lot of fun. It might be fun but I don't think it should be legal. I think we need to
protect our children. I think we need to protect our future. I think we need to do more to control
the noise in our town. I am not trying to put anyone out of work. You can get paid for using a
rake. As well or better than for using a leaf blower. In many instances a rake is more effective
and it is even easier to use. I mean, some of these leaf blowers are no fun, if you have ever tried
some of these commercial leaf blowers. It is a lot of work. Well, the last thing I wanted to
discuss with you all tonight was something I mentioned a while ago but I probably put it the
wrong way but do you know the difference between a crowd and the cloud? I wonder. I wonder
if how many people in this town or you know, even like the news media knows the difference
between a crowd and the cloud. Does anybody have any idea what I am talking about? I don't
hear anybody volunteering.
COUNCILMAN KRUPSKI: I don't know what you are talking about.
MR. SCHWARTZ: Okay. The cloud, it is unfortunate in my personal belief that they use a
name like the cloud, maybe they should just call it the silver lining or whatever but the cloud is
the collective consciousness of electronic consciousness let's say. And I started out myself, I
won't go into the history but starting with a little dumb terminal that would access a remote
computer from Princeton to a computer to a computer network in an office to the internet but the
cloud is how the US patent office is effectively trying to start to understand patent applications
because they cannot hire people in government who know enough to understand all the various
patent applications that come in. so they publicize the applications and they have a very
elaborate method to filter the comments that are made. They get a lot of comments and a lot of

them are nonsense but some of them are from very intelligent and useful and helpful information
that is provided and that is the consensus of the research that I have done and experts that I have
read for government basically is that cloud sourcing government is the answer to understanding
the complexity of the modem world and learning how to address the problems and the
opportunities and I wouldn't be here if I didn't believe that there were opportunities. But the
difference between the cloud and the crowd is that the crowd doesn't have a leader and anybody
who leads the crowd is a fraud, so whether you are a government official or news media, who
probably by the way will not report on any of what I am saying tonight, if the past experience is
any indication, you will not read about this in the Suffolk Times because it is just Benja. And
what does Benja know? Well, believe me, it is not just me. I think long and hard but I do my
research. In my estimation, this government for the last 50 years that I have been around has had
a track record of following the crowd. Now, I don't believe that's the way that we can make
progress. It is not an intelligent method of operation to just follow the crowd and I think we,
global warming is an issue which maybe we can't change the world but we do change our local
environment. Last thing I will talk about tonight is just how easy that can happen. You know,
when I walk out my back door, I built a patio behind my house and on one side of my door, I
used what is called bluestone, like slate. You want to talk there, Jill?
COUNCILWOMAN DOHERTY: I am sorry.
MR. SCHWARTZ: Okay, because I am almost finished but I thought I had the floor.
COUNCILMAN TALBOT: You have had the floor, Benja.
MR. SCHWARTZ: Well, the bluestone is on one side of the door and the other side has concrete
blocks with little beach stone pebbles. Light colored blocks. And in the summer, walk out there
or in the winter, one side is hot and one side is cold. Now, living in Cutchogue, known as the
sunniest town in New York State, we should understand the importance of micro climates. I
have suspicion that the newer method of road construction that we are employing using these
black roads are causing heat, significant heat enough to affect our local weather. Maybe not the
global weather but the global weather I believe is impacted by the collective infrastructure the
humans are building all over the globe and if we don't take responsibility for our own
community, then how can we expect the rest of the world to be responsible? Have a happy
