WITNESSETH, that the party of the first part, in consideration of ten ($10.00) dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors a~d assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being at East Marion Town of Southold County of Suffolk and State of New York, being more particularly bounded and
described on Schedule A annexed hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated October 5,
1995 and recorded in the Suffolk County CIerk's Office on July 13, 1998 in Liber 11904 at Page 85.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first pad has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AN D the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the same for any other purpose. The word "pady" shall be
construed as if it read "parties' when ever the sense of this indenture so requires.

BEGINNING at a point in the southem line of Main Road formerly known as Kings
Highway, being the same beginning comer as appears in Deed Book 5338 Page 477
as recorded in the Register of Deeds of Suffolk County, State of New York, and
RUNNING THENCE with the eastern line of the now or formerly of Charles R.
Mosback and wife, Lucile W. Mosback property as described in said deed, South 17
degrees 39 minutes 30 seconds East, 350 feet to a new comer; said comer being the
now or formerly Robert Alois Mosback comer;
THENCE a new line South 70 degrees 33 minutes 40 seconds West transversing a
right of way leading from the Main Road to Orient Harbor, 364.75 feet to the westem
line of the property conveyed to Charles R. Mosback by deed dated 11-2-62 as
recorded in Book 5287; page 580 as recorded in the Register of Deeds of Suffolk
County, State of New York;
THENCE with the western line of said Mosback property North 29 degrees 37
minutes 40 seconds West, 207 feet to the northwest comer of the now or formerly
Mosback property as described in said deed recorded in Book 5287 Page 580;
THENCE with the now or formerly Mosback property North 64 degrees 05 minutes
30 seconds East, 248.94 feet to a comer in the western edge of said right of way
leading to Orient Harbor;
THENCE with the western edge of said right of way North 01 degrees 40 minutes 10
seconds west, 186.10 feet to the southern edge of said Main Rod formerly known as
Kings Highway;
THENCE South 78 degrees 56 minutes East to another comer in the southern edge of
said road;
THENCE continuing with the southem edge of said r~)ad South 83 degrees 76
~ninutes East 54.14 feet to the point of BEGINNING.
Being all the lands as described in a deed in Book 5338 page 477 and a portion of the
lands as described in Book 5287 page 580 all of the Suffolk County Registry, State of
