The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the information available to me, my recommendation is that the proposed action existin.q 50 slip marina & 8,989 s.f. restaurant, parking areas and sitP, drainage is CONSISTENT with the LWRP. The program supports the marina use in the area known as Mill Creek through policies 10.1 and 10.3. 10.2 Promote Mattituck Inlet and Creek, Mill Creek and the Village of Greenport as the most suitable locations for water-dependent uses within the Town of Southold, Mattituck Inlet and Creek, identified by the state as a regional Maritime Center, and the Village of Greenport are the primary focus of madtime activity within the Town of Southold. Give water-dependent development precedence over other types of development at suitably zoned waterfront sites within Mattituck Inlet and Creek and the Village of Greenport. Ensure that public actions enable Mattituck Inlet, Mill Creek and the Village of Greenport to continue to function as centers of water-dependent uses. It is recommended that the Board require indigenous, drought tolerant plants in landscaping to reduce the need to irrigate and fertilizer application. Specifically, identify the large ornamental grasses proposed on the plans. The proposed location sanitary system for the Marina/Dock Master bud n.q is INCONSISTENT with the below listed policies. 5.1 Prohibit direct or indirect discharges that would cause or contribute to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 8. providing and managing on-site disposal systems: protect surface and groundwater against contamination from pathogens and excessive nutrient loading by keeping septic effluent separated from groundwater and by providing adequate treatment of septic effluent, encourage the evaluation and implementation of alternative or innovative on-site sanitary waste systems to mmediate on-site systems that currently do not adequately treat or separate effluent, encourage the use of alternative or innovative on-site sanitary waste systems where development or redevelopment of grandfathered parcels would otherwise increase the level of negative impacts on ground or surface waters, including wetlands. 5.4 Limit the potential for adverse impacts of watershed development on water quality and quantity. Protect water quality by ensuring that proposed expansion or intensification of existing watershed development results in: 1. protection of areas that provide important water quality benefits Limit the individual impacts associated with development to prevent cumulative water quality impacts which would lead to a failure to meet water quality standards. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The septic tank is located 89+ feet from the freshwater wetland to the east and 36+_ feet to the tidal wetlands to the west. The leaching pools are located 86 feet from the freshwater wetland to the east and 31+_ feet to the tidal wetland to the west. The proposed location does not meet required Chapter 275 setbacks (below). D. Setbacks. [Amended 10-11-2005 by L.L. No. 17-2005] (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary. Sanitary leaching pool (cesspool): 100 feet. Septic tank: 75 feet. It is recommended that wastewater resulting from the dock master building bathrooms be disposed of via a connection with the existing sanitary system landward of the Restaurant Building.
