Has permission been obtained from the county to place a dock structure on the lands/waters? (SCTM# 122.-4-4.8) Costello Madne Contracting Corp. on behalf of ERIN & MATTHEW CUNNINGHAM requests a Wetland Permit to;. Located: 2980 Ole Jule Lane, Mattituck. SCTM# 122-4-17 The proposed action to remove 30' of existing bulkhead and retaining wall and construct 30' of new bulkhead in-place; top of bulkhead to be level with existing adjacent bulkhead; construct 25' of core stone rock retainer; construct a 4'x8' wood deck; provide a 10' wide non-turf buffer landward of the new bulkhead and core stone rock retainer has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. The proposed action to construct a 4'x12' fixed catwalk; provide water and electric service to offshore end; install 1,8501b. boat davit; install a 32"x16' seasonal ramp onto a 6'x20' seasonal float secured by two 8" diameter anchor pilings is INCONSISTENT with the LWRP and listed policy standards provided below. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards of the Southold Town Code: No dock shall be erected or extended if, in the opinion of the Trustees, such structure would adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland areas. See below response. Within creeks and other narrow waterways, no dock length shall exceed 1/3 the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel. The dock structure has the ability to impede naviqation of the channel. A sandbar occurs to the west of the dock making the navigable channel narrow. The placement of a vessel at the dock terminus would further impede navi.qability. The dimensions of a vessel have not been shown. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in/ands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The dock structure will extend into public water and result in a net decrease in public access to/on public underwater lands. It is recommended that alternative vessel moorin.q option is considered to accommodate a vessel. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, sh~completc this CCAF for proposed actions that are subject to the Town of Soathold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.norttffork.net), the Board of Trustees Office, the Planning Depmtment, all local libraries and the Town Clerk's office.
