Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed second floor addition is EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "B' which states: B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins, jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks). The action is not located within the Coastal Erosion Hazard Area. The proposed new septic system is recommended as CONSISTENT with the LWRP. Additionally, review of the attached aerial indicates that the majority of developed neighboring properties are non-compliant with respect to rear yard setbacks, bulkhead setbacks and, in some instances, side yard setbacks, all of which have not resulted in any form of adverse impact to this neighborhood, and in fact, define it. Consequently, no undesirable change to the character of the neighborhood is anticipated in the granting of this variance request. (~2) The benefit sought by the applicant CANNOT be achieved by so,ne xnethod feasible for the application to pursue, other than an area variance, because: The benefit sought CANNOT be achieved by any other practicable method in that the choice to expand the habitable space vertically (i.e., and-Story Addition) rather than horizontally (i.e., outwards towards the street) was dictated by both practicality and cost efficiency concerns. Consequently, the applicant wishes to request variance relief rather than comply with the Code. (3) The amount of relief requested is not substantial because: The amount of relief is not substantial in that the current dwellinv has been non- compliant with respect to the requested variance relief herein for over 60 years without any form of adverse impact to the surrounding area. Consequently, in fully expanding the ~"a-Story of the existing 1 1/~-Story Dwelling. we CANNOT deem this request for variance relief as being substantial. (3) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The physical or enviromnental conditions within this area will NOT be adversely effected in that the single-family dwelling has existed herein, non-compliant with respect to the requested variance relief herein, for over 60 years without resulting in any form of adverse physical/environmental impact to the surrounding area. Additionally, wetlands approvals from both the New York State Department of Environmental Conservation (NYSDEC) and the Town of Southnld Board of Trustees for this project have been obtained. Finally, as part of this project, the older septic system will be abandoned, and a new, SCDHS fully-compliant, sanitary system will be installed further from surface waters. Consequently, we believe that the physical/environmental conditions of the surrounding neighborhood will not only be maintained, but improved upon. (6) Has the alleged difficulty been self-created? ( ) Yes, or ( X ) No. No. The property and the current improvements hereon have existed in this capacity for years (i.e., single-family residence with bulkheading), with only the introduction of restrictive regulations that result in this proposal requiring variance relief. Consequently, this difficulty has not been self-created.
