The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action is
CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

AREA }?tRI.4NCE REASONS:
(1) An undesirable change will not be produced in the CItARACTER of the neighborhood or a
detriment to nearby properties if granted, because:
The property is well screened from the road with a large hedge of evergreen trees/shrubs,
therefore the tennis court will not be visible from the road. An evergreen hedge is also proposed
along the west property line to screen the tennis court from the adjacent property.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because:
The property has an existing residence with attached garage, a driveway, a pond and large areas of wetlands.
There is not enough area for the tennis court in the front yard. Placing the tennis court in the rear yard would
be too close to the water and would have a negative impact on the shoreline.
(3) The amount of relief requested is not substantial because:
The relief requested is substantial however the applicant is willing to place covenants and
restrictions on the tennis court as the Board sees appropriate to mitigate the neighbor concerns
or future possible conflicts.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district because:
The proposed tennis court is shown at 65 feet from the wetlands and 50 feet off the road. It will
be well screened and the fence will be black chain link no higher than 4.0 feet. No lighting is
proposed and the tennis court will be used seasonally and only during the day light hours.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

Upon receipt of an application for a Pre-existing Certificate
of Occupancy, I made an inspection of this one and one half
story framed dwelling with attached two-car garage. I was
admitted to building by Mrs. Saland who accompanied me during
this inspection which began at approximately 9:50 A.M..
The first floor consists of a kitchen, dining room, living
room, half bathroom, and storage room. The second floor has
three bedrooms and two full bathrooms. Heat is furnished to
all rooms from an oil hot water furnace located in full cellar.
The following violation of the Housing Code, Chapter 52,
Town of Southold, New York, was found:
Garage: outside stair to loft requires handrail on
open side - Article III, Section 52-27 B.
Inspection completed at approximately 10:15 A.M..
