A site inspection was conducted on July 24, 2012.
MURRAY GAYLORD #6585 - Request for Variances from Article XXII Code Section 280-116(B) and
Article XXlll Section 280-124 based on an application for building permit and the Building Inspector's
June 21, 2012 Notice of Disapproval for demolition and reconstruction of single family dwelling, at; 1)
less than the code required bulkhead setback of 75 feet, 2) less than the code required minimum side
yard setback of 15 feet, 3) less than the code required rear yard setback of 50 feet, located at: 765
Beechwood Road (adj. to Groat Peconic Bay) Cutchogue, NY. SCTM~1000-116-4-20.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
'Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action is
CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures from
flooding and erosion hazards are suggested:
Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard
areas may be warranted fo~.
a. structures which functionally require a location on the coast or in
coastal waters.
b. water-dependent uses which cannot avoid exposure to hazards.
c. sites in areas with extensive public investment, public
infrastructure, or major public facilities.
c. sites where relocation of an existing structure is not practicaL
Due to the partial demolition of the existing structure, lot configuration and
environmental sensitivity; relocation of the existing residential structure is not practical.
The structure is located within an AE El 6 Flood Zone and the applicant proposed to raise
the grade of the site and elevate the structure to reduce potential impacts from flood
hazards.
The Board of Trustees required the establishment of a naturally vegetated 10' wide, non-
turf vegetated, buffer landward of the bulkhead under Permit No 7765 issued on March
12, 2012.
Additional Recommendations:
1. Due to the environmental sensitivity of the parcel and water body - it is recommended
that the Board consider prohibiting the application of fertilizer, herbicide and pesticide
on the lawn area.
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
